HomeMy WebLinkAboutARTECH R 3,1 (0.5 9-0039-003 ORIGINAL Contract No. Tax ID: 91-1013447 CONTRACTUAL AGREEMENT FOR PROFESSIONAL SERVICES The City of Auburn Parks and Recreation Department agrees to contract: ARTECH Attn: Mike Hascall,Director of Operations 2609 First Avenue Seattle, WA 98121 Telephone: 425-254-0224 to perform the following professional services: To restore the benches that are part of Artist Michele Val Slyke's sculpture "Every Year the Salmon Return"located at Roegner Park,601 Oravetz Road,Auburn,Washington. Such work will include the following components: • Remove and replace the bench backs and facilitate sandblasting,priming and re-powder coating. • Provide safety barriers on site • Prepare and repaint steel supports cast into the concrete on site • Replace all wood components in the benches • Remove graffiti from enamel panel components The Contractor shall notify, and receive approval from the Cultural Programs Manager for any substitutes, changes, or cancellations in the above-named performed services. Subcontracting of the services of this contract is not allowed unless prior approval is received by the department. The agreed fee to be paid is $3,978 as outlined in proposal from contractor dated February 13, 2003, and constitutes full compensation for all services. A copy of said proposal is attached hereto, and incorporated herein and designated as Exhibit A, and made a part hereof by reference. The agreed fee will be paid in 1 payment following the completion of the work and upon receipt of an invoice from contractor mailed to Auburn Parks and Recreation, 910 9th Street SE, Auburn,WA 98002. Payment will be made in accordance with the City Finance Department's standard business practices. The Contractor hereby agrees to save the City harmless from all loss or damage occasioned to it or to any third person or property by reason of any negligent acts or omissions on the part of the contractor,his or her employees, or person working directly or indirectly in the performance of the contract including joint acts or omis sions, and shall give the City prompt notice of any such damage, loss or injury. The Contractor agrees and understands that he/she is an independent contractor and not the agent or employee of the City. The manner and means of providing the professional services herein are under the sole control of the Contractor. The Contractor shall be solely responsible for reporting his/her hours, earnings, income tax, and social security to the applicable federal and state agencies. The Contractor understands that he/she is not entitled to any of the benefits provided by an employer to employees including but not limited to, disability and unemployment insurance. The missing lir►k, the sand blaster, finally got his business moved and is up and running. He needed to look at the benches to get an accurate cost and be did that recently.
