RE: Legal Services Retention Agreement: King County Inquest Challenges
Dear Kendra:
Thank you for choosing Keating, Bucklin & McCormack, Inc., P.S. ("KBM") to
provide legal services described more fully below. I look forward to representing the City
of Kent. To ensure as clear an understanding as possible as to the basis of our
procedures and charges in rendering the requested legal services, I have prepared this
letter for your review and consideration.
This confirms our agreement that you are retaining KBM to provide legal services
in the form of motions and briefing in four writ actions filed in King County Superior Court.
Our fees for legal consultation are $304 per hour for work performed by me or
another shareholder attorney, and $269 per hour for work performed by associate
attorneys. Please be advised that these billing rates may be subject to change on an
annual basis, and that by signing this retention agreement, you agree to pay such fees
as may be adjusted per our law firm's current rates.
We will split our fees two ways between the City of Kent and the City of Auburn,

with a combined cap of $20,000.00 that is subject to increase only with your approval.
The cap for Auburn will be $9,500 at this time.
Our firm will bill you monthly for attorney time at this rate and costs as they occur.
We will send detailed billings once a month directed to you. Our billings will indicate both
the attorney who is providing the work and a detailed description to the tenth of an hour.
In addition to our hourly rate, we charge for travel mileage at the rate established by the
Internal Revenue Service, and we charge for long distance, and postage expenses as
directly incurred along with any other direct costs incurred on behalf of the client. We will
advance costs as outlined, above, including court reporter fees as necessary. We do not
charge separately for administrative tasks such as secretarial drafting or paralegal fees.
Please be advised that upon termination of our relationship in this matter for any
reason, we will close our file. Our policy is to retain all relevant records for four years
after file closure and then destroy them.
If you agree with these terms please sign in the space below, retain a copy of this
letter for your files, and return the original to me in the enclosed self-addressed, stamped
envelope. We appreciate very much the opportunity to assist you in this matter, and I
look forward to working with you. If you have any questions regarding this agreement, or
should you at any time have any questions regarding the nature of our services, please
do not hesitate to contact me.

An Inter-Agency Agreement describing the criminal justice services provided and/or received by
an agency must be in place.

Parties who enter into this agreement must adhere to the regulations set forth in the ACCESS
Operations Manual and the CJIS Security Policy. This Inter-Agency Agreement must be current
and approved by the CJIS Systems Agency (CSA), the Washington State Patrol (WSP), before
agencies adopt the policies and procedures set forth by the agreement.
Termination of Agreement
This agreement shall remain in effect unless terminated by either agency upon thirty (30) days
written notice. The agency terminating the agreement must also formally notify the WSP
ACCESS Section within the thirty(30) days.
