HomeMy WebLinkAboutTodd Beals Camphost Volunteer 2021 FinalPage 1 of 4 AGREEMENT FOR VOLUNTEER SERVICES Human Resources and Risk Management Department The Agreement is made, by and between the City of Auburn, a political subdivision of the State of Washington hereinafter referred to as the “City” and Todd Beals hereinafter referred to as the “Volunteer.” PURPOSE: The purpose of this Agreement is to outline the responsibilities of the City in providing volunteer opportunities, and to create an understanding between the City and the Volunteer. This Agreement applies to persons voluntarily performing non-compensated camp ground host services for the City. VOLUNTEER AGREEMENT: The Volunteer agrees to abide by the information contained in the Volunteer Handbook and all relevant City policies and procedures. The Volunteer agrees to perform the volunteer services in a safe, responsible manner in accordance with the description of work. It is further understood that this Agreement shall not in any way constitute nor create an employer/employee relationship between the City and the Volunteer. The City shall not be responsible for, nor liable for, nor shall the applicant be eligible to receive, any wages. The Volunteer shall be eligible for a three hundred dollar ($300.00) monthly stipend as a result of this Agreement to offset expenses arising from the Volunteer’s services. The Volunteer will remit each month to the City of Auburn Parks and Recreation Department an invoice for the nominal stipend along with an hourly report listing the time spent volunteering for the City. The hours worked will be utilized by the City for tracking and providing the Volunteer with workers’ compensation medical aid coverage. The Volunteer acknowledges that they are performing the volunteer services for civic reasons and are receiving a stipend for the purpose of defraying expenses incidental to the work performed. In consideration of the City giving the Volunteer permission to perform these services with the benefits described above, the Volunteer understands that: (Please initial the following) _____ I am not to appear for volunteer service under the influence of any illegal drug or alcohol. I agree to inform my supervisor at the beginning of the shift if taking any over-the-counter or prescription medications which may impair my ability to perform volunteer duties. _____ I will abide by all City policies regarding personal conduct and all park rules while performing volunteer services. _____ I am not to have child(ren) with me during my volunteering activities without receiving prior written permission from the City. I understand that I will be solely liable, and assume all risk of liability for my child(ren) and their actions and agree to hold the City harmless from any and all such related claims against the City arising from my child(ren)’s actions, unless caused by the sole negligence of the City. _____ I agree not to go beyond the scope of volunteer work agreed to without authorization. _____ I am to be trained on any activity that I am unfamiliar with, learn the corresponding policies, and it is my responsibility to understand them completely or ask questions until I feel confident to perform them. _____ I understand that I am not driving on behalf of the City and any driving activity I perform is conducted on my own personal time. Page 2 of 4 _____ I understand that I am to report any on-the-job injury or illness, no matter how minor, to my supervisor. _____ I give permission to have my photo taken and used for publicity purposes by the City. _____ Volunteer will be held solely liable, and assumes all risk of liability, for any volunteer actions or omissions and agrees to hold the City harmless from any and all claims against the City arising from volunteers acts or omissions related to this agreement; except for any injuries and damages caused by the sole negligence of the City. DUTIES: The Campground Host volunteer shall oversee activities at the campground, which includes all camping sites; interior roadway and grass common area. The Host volunteer’s duties at the campground shall include a minimum of the following: 1.Greet campers in assigning available camp sites. 2.Check to see that drop in campers have registered. 3.Communicate with Parks staff regarding reserved camp sites. 4.Mediate any conflicts with campers and camp sites. Contact staff or the Auburn police 5.Place “Campsite Reserved” signs in advance of campers. 6.Close double campground gate at assigned times (open gate at assigned times if directed). 7.Provide oversight and supervisory assignments of those entering and exiting the campground. 8.Provide minor maintenance, minor grass trimming, and repair work as needed. 9.Report to parks staff any maintenance and repair issues as they arise. 10.Be knowledgeable and enforce all park rules and be observant of activities within the campground. 11.Be on-site during host hours; 10am-close; arrange for volunteer back-up as needed. Back-up volunteer must be an approved City of Auburn volunteer. 12.Complete walk thru of campground for trash collection and fire pit checks. 13.Call 911 to report any suspected or actual criminal situations or emergencies as needed. The Campground Host volunteer shall monitor the Day Camp site, which is the group site and shelter building located to the east of the campground site. The Host volunteer’s duties at the day camp site shall include the following: 1.Coordinate and communicate with users of Day Camp site as needed based on communication with Parks staff. 2.Call 911 to report any suspected or actual criminal situations or emergencies as needed. 3.Report to Parks staff any liter or damage left by the day camp users. 4.Complete ad hoc, minor tasks (e.g. opening/closing gate, checking fire pit, checking shelter for a recent camper’s lost item) at the request of Parks staff. Additionally, the volunteer will be required to perform some or all of the following: speak appropriately and respectfully to individuals of different ages and backgrounds, physically able to walk or hike on uneven outdoor surfaces, carry up to 50 pounds for short distances, bend and twist at the waist, use hands to perform and complete the above tasks in a timely manner’ meet the time commitments required to successfully complete all tasks, and show initiative in job responsibilities. The Volunteer will not conduct any type of vehicle maintenance repairs on site, use any City equipment for their personal benefit, consume any type of alcohol, tobacco, or drug use while on duty, or engage in any offensive conduct or use of profanity, will not display any signs, decals, bumper stickers, posters, or any expression of speech toward any political or religious view point while volunteering for the City and will maintain the assigned RV site in neat and orderly condition at all times. The Host will not store hazardous equipment outside, including gas, but may store propane for cooking. Page 3 of 4 COVID-19: The Host Volunteer will fully comply with all federal, state, county and City ordinances, codes, rules, regulations, and executive or emergency orders regarding the coronavirus (Covid-19) pandemic, and will strictly follow the protocols as directed by the Centers for Disease Control and Prevention, the United States Department of Labor Division of Occupational Safety and/or the Washington State Department of Health Services, arising from or addressing COVID-19. Specifically, while volunteering the Host volunteer will practice the physical distancing and mask rules adopted by King County and/or the City of Auburn. FIREWOOD: Due to demand and interest by registered campers, there is a need for the selling of firewood. The selling of firewood is not part of the volunteer’s duties under this Agreement, however; with approval from the Parks, Arts & Recreation Director or their designee, the Volunteer may sell firewood to registered campers at a competitively priced rate. The Volunteer will incur all expenses and derive all profits from the sale of firewood. Firewood may be stored, prepared and bundled on the site immediately adjacent to the Campground Host site. The area is to be kept clean and orderly. During the time that the Volunteer is preparing and/or selling firewood, they will not be acting as a Volunteer for the City, and therefore will not be covered for any medial only workers’ compensation coverage or WCIA liability coverage. USE OF CITY FACILITIES: The City will provide, for Volunteer’s use, the following: 1. Recreational Vehicle (RV) pad site located at the entrance to Game Farm Wilderness Campground. 2. Utilities to include electrical, septic, water, and garbage services of the campground. The Volunteer is responsible for any and all other utilities and services not specifically provided for by the City such as, but not limited to, internet, phone and cable services. The Parties agree that occupancy of the RV site is specifically conditioned on the Volunteer’s performance of duties under this Agreement. As provided for in RCW 59.18.040(8), the City is not defined as a “landlord” and Volunteer is not defined as a “tenant” under the residential Landlord-Tenant Act (Chapter 59.18 RCW) TERMINATION: I understand that this agreement may be terminated by either party upon written or verbal notice by either party, and that I am volunteering my services at will and may be asked to discontinue such without prior notice or reason. Such termination shall be effective immediately unless otherwise stipulated by the parties. Upon notice of termination all benefits described above including the monthly stipend and workers’ compensation medical only coverage shall cease. Upon termination of this volunteer agreement, the volunteer will remove all personal property from the campground and vacate the site within two days. In the event the volunteer does not vacate the site within that time period, the City may charge the volunteer the camping fee for the time beyond two days that the volunteer’s belongings are on the site, in addition to any other rights and remedies under the law. RELEASE AND HOLD HARMLESS: I am fully aware that the camp ground hosting duties associated with being a City Volunteer involves certain risks of physical injury or even death. Being fully informed as to these risks and in consideration of my being allowed to participate in the City’s Volunteer Program, I hereby assume all risk of injury, damage and harm to myself arising from such activities or use of City facilities. I also hereby individually and on behalf of my heirs, executors and assignees, indemnify and hold harmless the City, its officials, employees and agents and release and waive any right of recovery that I might have to bring a claim or a lawsuit against them for any personal injury, death, or other consequences occurring to me arising out of my volunteer activities. Page 4 of 4 LIABILITY COVERAGE: I understand that the City is self-insured for liability coverage through the Washington Cities Insurance Authority (WCIA). Volunteers performing within the scope of their assigned duties as authorized by the City are afforded the same coverage as City employees under the City’s liability coverage with WCIA. I am fully aware that a volunteer’s intentional misconduct is not protected or covered by the City or WCIA. The City does not provide any personal property or fire insurance coverage for the Volunteer’s personal property. This agreement will be in effect for the duration of my volunteer services beginning this date until terminated by either party: Dated this ______ day of ______________________, 20_____.
