Re: Refund Portion Annual Site Lease Payment, Voicestream/T-Mobile
Reason for refund:
Pursuant to the Site Lease Agreement dated December 4, 2003 (Resolution
NO. 3649), Voicestream/T-Mobile USA ("T-Mobile") leased space at the City
of Auburn's Reservoir No. 5 site (SE04646) for operation of a
telecommunications antenna. On April 7, 2015, the City notified T-Mobile that
the lease would be terminated on October 7, 2015. The City granted an
extension of the lease to January 15, 2016 to provide T-Mobile sufficient time
to remove the antenna. T-Mobile removed the antenna and restored the site
by the January 15, 2016 deadline (59 days into the 2016 lease period).
On 11/19/2015, T-Mobile paid to the City the annual lease payment of
$18,132.83 for the period 11/17/2015-11/16/2016. The City is refunding the
balance of the 2016 lease payment for the (365 days — 59 days = 306 days)
remaining in the lease period.
