REPAYMENT AGREEMENT FOR FEE IN LIEU OF IMPROVEMENTS
THIS REPAYMENT AGREEMENT FOR FEE IN LIEU OF IMPROVEMENTS
("Agreement") is by and between the City of Auburn (the "City"), a municipal corporation
in the State of Washington and Thomas Ellez and Kiersten Ellez, property owner (the
"Applicant" or "Property Owner") (each a "Party" and together the "Parties")..
•
WHEREAS, the Applicant is responsible for the replacement of City sidewalk panel(s)
damaged by vegetation on their property, as shown in the notice sent to the Applicant
(Exhibit 1); and
WHEREAS, the Applicant seeks to participate in the City's sidewalk repair program.
Under this program, the Applicant will pay the City a fee in lieu of undertaking the
required sidewalk panel replacement improvements ("Improvements"). In return, the
City will include the Applicant's required Improvements in its construction project
schedule. The total assessed fee in lieu for Applicant's required sidewalk
Improvements is $1,970, and •
WHEREAS, the Applicant has expressed to the City the need to make monthly
payments of$164.17 each month toward the assessed fee; and •
WHEREAS, the City agrees to permit the Applicants to pay the fee in lieu through a 12-
month repayment plan (which is attached as Exhibit 2), and to include the Applicant's
required sidewalk Improvements in the City's construction project schedule once
Applicant has paid the full fee in lieu amount due; and
NOW THEREFORE, in consideration of the mutual promises and other good and
valuable consideration, the sufficiency of which is acknowledged, the Parties agree as
follows:
1. Required Improvements: The replacement of sidewalk panels damaged by
vegetation at Applicant's property.
2. Fee in Lieu. In lieu of undertaking and completing the required sidewalk
Improvements, the Applicants agree to pay the City one hundred percent (100%)
of the City's estimated costs to complete the required Improvements. The
Parties have determined that the cost of Improvements is $1,970, which is the
amount to be paid by the Applicant to the City ("Fee in Lieu"). •
3. Payment. The Applicant will pay this fee in lieu to the City in monthly payments
of$164.17 according to an agreed payment schedule (attached as Exhibit 2). •
Applicant shall make the first payment on or before July 31, 2024, and the last
payment on or before June 30, 2025. Payments are due on the last day of the
month.

Forms of acceptable payment include personal check, money order, cash, or
credit card. Payments are accepted:
i. In person at the Customer Service Center, 1 East Main Street, 2nd
floor, Auburn, WA
ii. Via mail addressed to City of Auburn, Finance Department, etc. — •
include the invoice with your payment.
4. No Prepayment Penalty. Applicant shall face no penalty for paying all or any part
of the fee in lieu earlier than the schedule in Exhibit 2.
5. Applicant Late Payments or breach of Agreement. Applicant payments under
this Agreement are due on or before the payment date reflected in Exhibit 2 to
this Agreement. If Applicant fails to pay any installment of the Fee In Lieu when
due, or breaches any other portion of this Agreement, the City at its option and •
without notice may declare that the entire unpaid Fee In Lieu amount is due
immediately. Applicant further acknowledges that the City may enforce a default
or breach of this Agreement through lawful means, which may include
cancellation of this Agreement. If the City elects to cancel this Agreement due to
• Applicant's default or breach, Applicant will be required to undertake and
complete the Improvements described in this Agreement as required by State
Law and City Code.
6. Lien for Failure to Pay. The applicant acknowledges that the City reserves the
right to enforce a default or breach of this Agreement through a lien on the
property as provided by RCW 35A.60.010 or other applicable law.
7. Sale or transfer of Property: If Applicant transfers ownership of the Property at
any time during the term of this Agreement, or prior to paying the full amount of
the fee in lieu, the unpaid remaining balance will be due in full to the City prior to •
the change of ownership.
8. Use of the Fee In Lieu. The City will use the fee in lieu collected under this
Agreement to fund planned public improvements along the Property's frontage,
and to complete the required Improvements.
9. Right of Entry. Applicants agree to allow the City (including its contractors,
employees, and others as authorized by the City) to enter the Property for the
purposes of designing and constructing the Improvements, and/or to perform
any actions reasonably related to the design and construction of the •
Improvements. This City right of entry into and upon the Property shall include,
but not be limited to, the City's right to perform the following actions at or upon
the Property during its design and/or construction of the Improvements:
reconnaissance, surveying, grading, restoration, and installing the sidewalk. This
City right of entry shall automatically terminate when construction of the
Improvements is complete. For purposes of this paragraph, construction of th'e
Improvements shall be deemed "complete"when the work is physically complete
and the warranty period, if any, has expired.

10.Waiver of Objections. The Applicants for themselves and their successors and
assigns waive any objection that they may have arising from the payment of a
Fee in Lieu as set forth in this Agreement or from any action under Chapter
12.12 of the Auburn City Code and/or RCW 35.68 or RCW 35.69. '
11.Entire Agreement. This Agreement is the entire Agreement between the Parties
regarding its subject matter. If the terms of this Agreement and any Deferral
Agreement between the Parties related to payment of the fee in lieu conflict, the
terms of this Agreement will control.
12.Binding Effect, Recording. This Agreement will be binding upon the City and •
Applicants and their respective heirs, agents, successors, assigns, owners,
officers, directors, shareholders, employees, representatives, attorney, insurers,
divisions, subsidiaries, affiliates, predecessors, and all persons acting by,
though, under or in concert with any of them. This Agreement will be filed with
the King County Recorder's Office and recorded against the property.
13.Amendment. This Agreement may be amended only in writing executed by both
Parties to the Agreement or their successors or assigns.
14.Enforcement. The Agreement may be enforced only by the Parties or their
successors or assigns and no third party has standing to enforce the terms of
this Agreement.

INITIAL NOTICE
Dear Thomas and Kiersten Ellez:
A tree on your property at 1610 61st St SE grew to a point where it damaged the adjacent
sidewalk along 62nd St SE. City staff provided a temporary repair to the sidewalk, but the
damaged sidewalk must still be replaced. See the enclosed pictures for details. Per Auburn
City Code (ACC) 12.12.234 "Damage caused to the sidewalk by vegetation located on private
property, lack of regular maintenance by the abutting property owner, or damage that is in any
way caused by the abutting property owner shall be the responsibility of the private property
owner to repair..." Because the tree that caused the damage is located on your property, you
are responsible for the damage caused by this tree to the public right-of-way.
The City requires that you:
• Remove the tree root(s) lifting the sidewalk; and
• Replace the damaged sidewalk.
Sidewalk Replacement
To replace the damaged sidewalk, you have two (2) options:
1. Hire a licensed contractor who will need to obtain a construction permit from the City; or
2. Prepare and submit an application and pay a fee to have the sidewalk repaired by the
City as part of its Sidewalk Repair Program.
City's Sidewalk Program information:
The 2024 fee for this program is $34 per square foot (SF) of sidewalk to be replaced with a
$100 administrative fee, which would come to a total of $1,970 for the sidewalk area 55 SF
you are required to replace as a result of the damage from your tree. See the enclosed picture
for the dimensions of the sidewalk panel that must be replaced.
To apply for inclusion into this program, please complete and submit the enclosed application,
including payment (if paying by check) and the "Indemnification, Hold Harmless, and Right of
Entry"form completed and signed. If you prefer to pay by card, please let us know and we will
contact you after your application was received to process your payment over the phone.
Tree Root Removal
Should you decide to retain the tree and only have the roots removed (by the City or your
contractor), you are encouraged to work with an arborist to evaluate and monitor the health of
the tree to ensure it will not create additional risks, for which you are responsible.
Should you decide to remove the tree, replacement is not required.

Should you decide to replace the tree within ten (10) feet of the right-of-way, please refer to
the enclosed Standard Detail T-06.4 for required root control barrier specifications. Tree
replacement is your responsibility regardless of whether you participate in the City Sidewalk
Repair Program or hire a licensed contractor to repair the sidewalk.
Timeline
If you choose to hire a contractor, work must be completed within 180 days of this letter, by
August 12, 2024.
If you choose to participate in the City's Sidewalk Program,within 90 days of this letter, by May
14, 2024, please return the application and the "Indemnification, Hold Harmless, and Right of
Entry"form completed and signed, and complete your payment.
Non-compliance will result in code enforcement action.

This Agreement applies to the property located at 1610 61st St SE and identified by Pierce County Parcel#
7001090180 (Property).
THOMAS ELLEZ and KIERSTEN ELLEZ("Property Owner") shall defend, indemnify, and hold the City of
Auburn, and its officers, officials, employees, agents, contractors, and volunteers harmless from any and all
claims, injuries, damages, losses, or suits, including attorney fees, arising out of or in connection with the
sidewalk removal and replacement, removal of tree roots and the retention of the tree(s) associated with
Sidewalk Repair Application No. except for injuries and damages caused by the sole
negligence of the City of Auburn.
The Property Owner acknowledges that the removal of tree roots may cause severe tree damage, and that
the Property Owner is responsible for monitoring tree health and for removing trees should it become
necessary. The Property Owner also acknowledges that they remain responsible for any future damage
caused by retained trees.
The Property Owner hereby convey(s) and grant(s) unto the City of Auburn, its contractors, employees,
agents, successors and assigns,the right to enter upon their Property as needed to complete the work
identified in this Agreement, including the removal and replacement of sidewalks, and the restoration of the
property's yard and/or frontage to like or better condition as existing prior to the City's construction
activities.
The Property Owner acknowledges and agrees that this Agreement shall run with the land and shall bind all
subsequent transferees of the Property unless and until rescinded by the City. Prior to transferring
ownership of the Property, Property Owner agrees to provide written notice of this Agreement to the
transferee. The city shall also record this Agreement with the applicable County Auditor or Recorder.

12.12.234 Repair and replacement responsibility.
The repair and/or replacement of sidewalk including the repair and/or replacement of artificial turf,as defined by
this chapter,shall be the responsibility of the abutting property owner unless determined otherwise by the city
engineer. If a property owner believes the damaged sidewalk and/or sidewalk needing replacement is/are the
city's or someone else's responsibility,the property owner must notify the city engineer in writing with sufficient
documentation of the cause of the damage and justification of why the repair and/or replacement should not be
considered the responsibility of the abutting property owner.
Damage caused to the sidewalk by vegetation located on private property,lack of regular maintenance by the
abutting property owner,or damage that is in any way caused by the abutting property owner shall be the
responsibility of the private property owner to repair subject to Chapter 12.66 ACC.
Unless an emergency situation exists as determined by the city,the city or other permitted entity will seek to
provide notice to the abutting property owner prior to conducting work that may impact the artificial turf a
minimum of three business days in advance of the work and request that the property owner remove,at their
own expense,the artificial turf prior to the commencement of the work. If the property owner does not remove
the artificial turf within the time frame requested,the city or other permitted entity may remove the artificial turf
and place it on the abutting property.The city or other permitted entity conducting the work is not responsible for
damage to the artificial turf and is not responsible for resetting the turf.The abutting property owner shall reset
the removed artificial turf or restore the impacted sidewalk area per city engineering design standards within
three business days of receiving notice of the completion of any work performed in the landscape strip.(Ord.6904
