ORDINANCE NO. 2287 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 208 WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWER AND APPURTENANCES AS PROVIDED BY ORDINANCE NO. 2146 OF THE CITY OF AUBURN, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL. WHEREAS, the assessment rol I levying the special assessments against the properties located in the Local Improvement District No. 208 in the City of Auburn, Washington, created under Ordinance No. 2146, has been fi led with the City Clerk of the City of Auburn as provided bylaw; and; -- WHEREAS, notice of the time and place of hearing thereof and of making objections and protests to said roll was duly published at and for the time and in the manner pro- vided by law, fixing the time and place of hearing thereon for the 4th day of November, 196B, at the hour of 8:00 p.m. in the Counci I Chambers in the City Hall of Auburn, Wash- ington, and further notice thereof was duly mai led by the City Clerk to each property owner shown on said roll; and, WHEREAS, at the time and place fixed and designated in said Notice the hearing was duly held and no protests were fi led at said hearing; and, WHEREAS, after the hearing was held the assessment rol I was accepted as presented and ordered confirmed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLa.VS: Section I. That there is hereby in all respects approved and confirmed the assess- ment and assessment rol I in Local Improvement District No. 208 for the construction and installation of sanitary sewer & appurtenances on Auburn Ave. btwn 26th St. N.E. and N City limits; 28th St. N.E. btwn Auburn Ave. & "I" St. N.E.; 30th St. N.E. btwn Auburn Ave. & "C" St. N.E., 37th St. N.E. btwn Auburn ave. & "B" St. N.W.; "C" St. N.E. btwn 30th & 37th Sts. That each of the lots and other property upon said assessment rol I is hereby declared to be especially benefited by said improvements in at least the amount charged against the same, and that the assessment appearing against each of the same is in proportion to the several assessments appearing on the said roll. That all of the property shal I be assessed according to the lineal frontage of the property abutting said property to be improved, and shal I be assessed according to their proportionate share of the several assessments appearing upon the said assessment rol I and there is hereby levied and assessed against such lots and other property appearing upon said rol I, the amount finally charged therein against the same. Said amount, or any portion thereof, may be paid at any time within 30 days from the date of the first publication of the Notice of Collection of said assessments without penalty, interest or cost; thereafter the sum re- maining unpaid, if any, may be paid in ten 1101 equal annual installments, with interest on the whole unpaid sum at the rate of 6% per annum. Commencing with the first year after the last day, such assessments, or any portion thereof, may be paid without penalty, in- terest or cost (30 days from the date of the first publication of the Treasurer's Notice of Collection of Assessmentsl and each year thereafter, one of said installments, together with the interest due, shal I be collected as provided by law and the ordinances of the Page Two ~. City of Auburn; assessments or installments of assessments not paid when due shal I be de- linquent and there shal I be added to the same a penalty of 5% of the amount of the over- due installment and interest, and such penalty shall become a part of the lien upon the property assessed, Section 3. AI I monies collected bV the City Treasurer upon any of the assessments levied, as authorized herein, shal I be paid into "Local Improvement District No. 208 Fund" created by Ordinance No. 2146, and shal I be used only for the purpose of redeeming warrants and/or bonds drawn~,~on ~ issued against said fund. Section 4. That this Ordinance shal I take effect five (5) days from and after its passage, approval and publication as provided by law.
