HomeMy WebLinkAboutNotice of Termination of Temporary Use Agreement of City Property Docusign Envelope ID:79AADOC1-6ED9-40C9-95CB-F4FD565D9B71 Notice of Termination of Temporary Use Agreement of City Property This notice of termination of Temporary Use Agreement of City Property is issued by the City of Auburn, ("Licensor"), to Phillip Ritto, ("Licensee"), on November 7, 2024, with an effective date of December 15, 2024 (the "Termination Date"). I. RECITALS A. On or about February 16, 2016, Licensor and Licensee entered into a Temporary Use Agreement of City Property ("Agreement"),which allowed Licensee, owner of property located at 30125 112th Ave SE,Auburn, WA 98092, tax parcel#0521059052, ("Licensee's Property")to temporarily use portions of City-owned parcels #0521059038 and 0521059152, ("City's Property"). B. In Paragraph 2 of the Agreement, the Licensee (aka, "User") acknowledged that "...the City may terminate this agreement[,] and Licensee's use,presence, and occupancy of the [City's] Property must cease. C. Paragraph 12 of the Agreement, "Termination"reads in relevant part that"[t]he City shall have the right to terminate this agreement upon 30 days written notice to User." and"Upon termination of this agreement, the User shall remove any improvements, structures, or belongings from the Property at the User's sole expense and restore the surface of the property to the level that existed at the effective date of this agreement." II. NOTICE OF TERMINATION Pursuant to the above referenced Agreement and sections thereof, the City hereby gives Licensee 30 days'notice that the Temporary Use Agreement of City Property will be terminated, effective on the Termination Date.Any use by Licensee of City's Property after the Termination Date, will be considered a trespass onto City's Property. Any and all debris, including but not limited to, tree houses, rooster housing, and piles of random debris must be removed from City property. Should Licensee fail to remove his items from City property by the Termination Date, City will consider any remaining items as abandoned and will remove any and all items on City property at the expense of Licensee. The City plans to enter City's Property and clean any abandoned debris on or after the Termination Date. Following its work, the City plans to erect a fence to surround City's Property.
