Site-Specific Environmental Review
(Tier 2 Review) |Program: Auburn Housing Repair
Items named in the project description in SECTION A are considered “rehabilitation activities” per Federal
Regulations: 24 CFR Part 58.35 (a)(3) and are subject to further environmental determination. In contrast,
“routine maintenance” items are categorically excluded from environmental assessment under the National
Environmental Policy Act (NEPA) and not subject to compliance requirements of the related federal
environmental laws in 24 CFR 50.4 and 24 CFR 58.5, including the National Historic Preservation Act of 1966
(also see the “Environmental Determination” section of the Home Repair Work Order). Update this document
as site-specific reviews are completed. Complete each site-specific review according to the written
strategies outlined in the broad-level review, which is maintained in the Tier 1 environmental review file.

SECTION B: HISTORIC PRESERVATION
Does the project involve a structure that is less than 45 years old with no “new” ground
disturbing activities?
Actions such as digging up a broken sewer pipe in order to repair or replace it does not require
additional review unless new ground is disturbed. “New” ground disturbing activities involve
digging that is done deeper or wider than original installation or placement. If deeper, wider or
new digging is required, a “No” response would be given and an EZ-1 form described below will
be required.

This process usually takes two weeks but may take longer than 45 days if the home is
determined historic. If the project does not involve ground disturbance, complete form

No adverse effect on historic property: STOP here. The Section 106 Historic Preservation review is
complete. Categorically Excluded projects (24 CFR Part 58.35(a)) CANNOT convert to exempt with
this determination.
Adverse effect on historic property: Resolve adverse effects per 800.6 in consultation with SHPO/
THPO, the ACHP if participating, and any consulting parties. The loan or grant may not be
approved until adverse effects are resolved. Categorically Excluded projects (24 CFR Part
58.35(a)) CANNOT convert to exempt with this determination.

ADDITIONAL CONSIDERATIONS:
City of Auburn Policy and CDBG Regulations require the completion of environmental review
before bids are sought or rehabilitation work starts. City of Auburn Housing Repair Program
staff certifies that no work on this project will begin until Housing & Human Services/CDBG
Program staff sign off on the Tiered Environmental Review for Activity/Project that is
Categorically Excluded Subject to Section 58.5 Pursuant to 24 CFR Part 58.35(a) form or a
release letter from HUD if the project cannot convert to exempt. If a private contractor is used
on this project, a Notice to Proceed shall be issued to the contractor after the ER is
completed. If City staff does the work, the start date shall be noted on the Work Order.

RECOMMENDED COURSE OF ACTION:
24 CFR 58.35(b) states no further approval from HUD or the State is needed to carry out exempt
activities and projects. Therefore, the City will proceed to implement the above described project
without any further notification or approval from HUD. If an activity or project cannot convert to
exempt, the City will publish NOI/RROF (with a 7 day comment period) and obtain Authority to Use
Grant Funds (HUD 7015.16) per Section 58.70 and 58.71 before initiating the project. If the City
determines that a project or activity will result in a significant environmental impact, the City will
prepare an Environmental Assessment (EA) according to 24 CFR Part 58 Subpart E.
