CP2406, AUBURN AVE THEATER DEMOLITION THIS AMENDMENT TO THE AGREEMENT is made and entered into by and between the CITY OF AUBURN, a municipal corporation of the State of Washington (hereinafter referred to as the “CITY”), and Bluestone Environmental NW (hereinafter referred to as the “PROVIDER”). The City and Provider agree to amend the Agreement AG-C-580 executed on the 29th day of October 2024. The changes to the Agreement are described as follows: 1. CONTRACT TERM: The term of the Agreement for Professional Services is extended to December 31, 2025. 2. SCOPE OF SERVICES: The scope of work is amended to include the following tasks that will be performed in a good and professional manner: See Exhibit A, which is attached hereto and by this reference made part of this Amendment 3. COMPENSATION: The amount of this amendment is $2,700.00. As total compensation for the Provider’s performance of the services provided based on this Amended Agreement, the City shall pay the Provider fees and costs not-to-exceed $22,700.00. See Exhibit B, which is attached hereto and by this reference made part of this Agreement. REMAINING TERMS UNCHANGED: All other provisions of the Agreement between the parties for AG-C-580 executed on the 29th day of October 2024, shall remain unchanged, and in full force and effect. Per your request, we are sending this proposal to authorize our services. Bluestone is committed to providing a level of service that suits our client’s requirements. If the proposed efforts are not in alignment with your needs, please contact us to discuss how we can better assist you. For this authorization, the understood efforts you have requested include:  Observation and documentation of UST removal.  Collect assessment soil samples.  Prepare decommissioning and assessment documentation for the removed UST. These tasks are further described below. EXHIBIT ADocusign Envelope ID: 6828F1CD-77C2-44EB-8A9F-7451A5D8510C BE-0207-A UST Assess Page 2 of 3 SOIL ASSESSMENT – UST REMOVAL Bluestone understands that the underground storage tank (UST) will be made accessible to observe the removal of the tank. To complete the assessment efforts, three soil samples will be collected. Specifically, one sample will be collected 6-12- inches below the bottom of the UST basin and two samples will be collected from the bottom 1/3 of the UST basin sidewalls (one side wall and one end wall). Soil samples will be submitted for laboratory analysis by Method NWTPH-Dx. DECOMMISSIONING DOCUMENTATION The UST decommissioning will be documented by a certified UST decommissioning assessor. A letter report providing a certificate of removal will be provided. The certificate of removal will be issued upon receipt of payment. A UST decommissioning report will be prepared to document the assessment efforts. The report will include text, summary analytical tables, and figures to show the sampled locations and the approximate location of the UST, and a discussion of our findings. Analytical results will be compared to appropriate cleanup levels (Method “A” ) set by Ecology under the MTCA Cleanup Regulation (dated November 2007, revised in August 2023). Project Parameters The parameters for the proposed costs regarding the efforts discussed above are based on the following.  Site access will be available to Bluestone personnel.  The UST area and surrounding area will be cleared of obstructions that would prevent access to the UST / UST excavation.  The UST is 500-gallon size or less.  Observation efforts will be completed within one 8-hour day. Weekend and/or night work will not be required. . Our total fee for this project will not exceed our proposed costs without a change in the presented scope of services and only with your authorization. Invoices are payable within 30 days of the invoice date as outlined in the attached our terms of services agreement. Limitations The proposed services and costs have been designed and prepared based on our understanding of site conditions based on our conversations with the client. Discovered conditions beyond those addressed in our proposed services may warrant additional charges if activities and/or tasks outside of our proposed scope are performed. Authorization These efforts will be performed after receipt of authorization to proceed from the City of Auburn. Closing We appreciate the opportunity to provide our services.
