CLEAR ZONE EASEMENT
Auburn Way S. (SR 164) Hemlock to Poplar
The Grantor(s), Clearwater Ridge, Inc., a Washington corporation, for and in
consideration of TEN AND N4/100 ($10,00) Dollars, convey(s) and grant(s) unto the City of
Auburn, a municipal corporation of the State of Washington and its assigns, Grantee, under
the imminent threat of the Grantee's exercise of its rights of Eminent Domain, an easement
over, under, upon and across the hereinafter described lands for the purpose of providing a clear
zone and access to maintain the function of a Grantor -provided vehicular guardrail in the
adjacent Auburn Way S. public right-of-way. No fixed objects will be allowed in the easement
area except as approved in writing by the City Engineer of the City of Auburn. Grantee shall
have the right to access the easement area to construct, operate, maintain, repair, replace,
improve, or remove the guardrails system in the adjacent public right-of-way and the right to
construct, maintain, repair, replace, improve, or remove, excavation and/or embankment slopes
within the easement area as required for the function of the guardrail system.

It is understood and agreed that delivery of this easement is hereby tendered and that
the terms and obligations hereof shall not become binding upon the City of Auburn unless and
until accepted and approved hereon in writing for the City of Auburn, by its authorized agent.
