The Property Owner acknowledges that the removal of tree roots may cause severe tree damage, and that the Property Owner is responsible for monitoring tree health and for removing trees should it become necessary. The Property Owner also acknowledges that they remain responsible for any future damage caused byretained trees. The Property Owner hereby convey(s) and grant(s) unto the City of Auburn, its contractors, employees, agents, successors and assigns, the right to enter upon their Property as needed to complete the work identified in this Agreement, including the removal and replacement of sidewalks, and the restoration of the property's yard and/or frontage to like or better condition as existing prior to the City's construction The Property Owner acknowledges and agrees that this Agreement shall run with the land and shall bind all subsequent transferees of the Property unless and until rescinded by the City. Prior hotransferring ownership of the Property, Property Owner agrees to provide written notice of this Agreement to the transferee. The city shall also record this Agreement with the applicable County Auditor orRecorder.
