This agreement entered into on the date hereinafter set forth by and between C&M
Development Partners, LLC,heirs,successors, and assigns hereinafter referred to as the "Owner"
and the City of Auburn,Washington,hereinafter referred to as the"City".
WITNESSETH
WHEREAS, the Owner is in the process of developing property known as the Plat of
White Mountain Trails at 11825 SE 288th legally described as follows:
BEGINNING AT THE NORTHWEST CORNER OF SEC. 4,TOWNSHIP 21 N.,
RANGE 5, E,W.N.C.;THE TRUE POINT OF BEGINNING;THENCE S 88° 58' 05"E,
1315.67 FT. THENCE SO1°41' 53"W, 1031.19 FT. THENCE N 87°48'42"W,
1316.48 FT. . THENCE N 01°44'46"E, 1004.63 FT TO THE TRUE POINT OF
BEGINNING.
WHEREAS, the City, as required by King County, has required the Owner to remove an
existing asbestos concrete water main located on 112th Avenue SE from SE 298th to SE 294th
Street which has been abandoned in place as part of the required off-site improvements for the
White Mountain Trails development.
WHEREAS, Owner has asserted it has no duty to remove the existing asbestos concrete
water main,but is willing to enter this Evilr era1 'aa tg,avoid a dispute with the City.
