HomeMy WebLinkAboutNotice of Intent to Request Release of Funds (HUD - CDBG)CITY OF * + AUBURN Nancy Backus, Mayor WAS H I NGTON 25 West Main Street * Auburn WA 98001-4998 * www.auburnwa.gov * 253-931-3000 PUBLIC NOTICE NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS December 18, 2024 On or about December 30, 2024, the City of Auburn Human Services Division will submit a request to HUD for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974, to undertake the following project: Auburn Home Repair Program. The purpose of these funds is to provide health and safety related repairs to low moderate -income households residing in owner -occupied single-family homes, manufactured homes (constructed after 1976) and individual condominiums that are part of the City's permanent housing stock. Individual project locations are not yet determined but each will occur within the incorporated city limits of Auburn. The City of Auburn, as the Responsible Entity (RE) is utilizing a tiered Environmental Review format to examine and ensure compliance for activities in the above -mentioned program that are categorically excluded and subject to review (CEST) under HUD regulations 24 CFR Part 58 and the National Environmental Policy Act (NEPA). This review will cover CEST level projects occurring between 2025 and 2030. The first tier (Tier 1) of the Environmental Review examines a broad, area wide statutory evaluation of the laws and authorities proposed under HUD Regulations and NEPA at 24 CFR Part 58.15. These include Airport Hazards, Coastal Barrier Resources Act, Air Quality, Coastal Zone Management Act, Endangered Species Act, Explosive and Flammable Hazards, Farmlands Protection, Noise Abatement and Control, Sole Source, Aquifers, Wetlands Protection, Wild and Scenic Rivers Act and Environmental Justice. The second tier (Tier 2) examines remaining laws and authorities not addressed in the Tier 1 review and will be conducted for each site as projects are identified. The laws and authorities examined in this level of review are Flood Insurance, Contamination and Toxic Substances, Floodplain Management and Historic Preservation. AUBURN *MORE THAN YOU IMAGINED CITY OF 'T T RL �l �l4 AUB V Nancy Backus, Mayor WASHINGTON 25 West Main Street * Auburn WA98001-4998 * www.auburnwa.gov * 253-931-3000 ENVIRONMENTAL CERTIFICATION The City of Auburn certifies to HUD that Kent Hay in his capacity as Human Services Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Auburn to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Auburn's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Auburn; (b) the City of Auburn has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the HUD Seattle Field Office Community Planning and Development located at 909 1st Avenue Suite 300, Seattle, WA 98104 Potential objectors should contact HUD directly to verify the actual last day of the objection period.
