The City and Provider agree to amend the Agreement AG-C-556 executed on the 28th day of March 2022. The Changes to the Agreement are described as follows: 1. SCOPE OF SERVCIES: See Exhibit A, which is attached hereto and by this reference made part of this agreement 2. COMPENSATION: This amendment increases the total amount of this agreement by $12,500. As total compensation for the Provider's performance of the services provided based on this Amended Agreement, the City shall pay the Provider fees and costs not-to-exceed $145,111.00. See Exhibit A, which is attached hereto and by this reference made part of this Agreement. 3. REFERENCED DOCUMENT: The contract and Amendment 1 and 2 are attached as exhibits to this Agreement as reference. THE REMAINING TERMS UNCHANGED: All other provisions of the Agreement between the parties for AG-C-556 executed on the 28th day of March 2022, shall remain unchanged, and in full force and affect. The total proposal for the Auburn Consolidated Resource Center,which includes architectural and consultant professional services in support of the"restart"for Bid and Construction Administration phases fortenant improvements to the building located at 2826 Auburn Way N.is$12,500,inclusive of reimbursable expense. Fee Summary Design fees for the first phases were originally completed in 2021 on an estimated and approved budget using a MACC of$1,400,000. As we completed the design phases,we updated the original cost assumption,and the MACC was increased to approximately$2.1M. While that was a significant increase in the estimate of construction costs for 2023,none of the design team ever requested additional fees.Since then,the project went on"hold"and now that it is re-starting,ARC,along with our consultants are asking for a minimal up-tick in fee.The rationale is as follows: • Hourly rates have increased for all • Referencing the"updated"MACC as well as the WA State Fee Schedule(2025 updated,schedule B): o Last official cost estimate was$2.1 M x 10.08%=$211,680(total design allowable fee) • CA suggested fee percentage(including bid phase)is 29%which equals$61,387 (allowable phase fee) o NOTE:We show the fee schedule for reference only to see we are not requesting full amount • Total team current request is$48,450,including expenses o Subtract the remaining(under current contract budget)balance fee of$35,950 o The difference is$12,500 • Note,Exhibit A detail shows zero dollars for another cost estimate. We will tap into the remaining fee that exists for that consultant to cover the cost of the new estimate. See further detail in the fee proposal dated 5/30/25 for"Architectural and Engineering Services"attachment to this letter. Should the construction cost estimate,when undated aoain under this proposalexceed 20%of last cost update,we reserve the right to amend our fee accordingly. While the city is not revising the design,it is our understanding that you would like to receive a new project cost estimate to reflect a fall of 2025 bid date. For ourestimating use,you have shared with us some current facility cost expectations generated from a facility conditions report. They are a)roof-top mechanical units**b)building plumbing(below slab clean-out)work,c)parking lot asphaltic cement overlay.
