HomeMy WebLinkAboutLandlord Affidavit Auburn Airport Hangar 401LANDLORD AFFIDAVIT The Unit Owners Association of Auburn Airport Hangar Condominium, a Washington miscellaneous or mutual corporation ("Tenant"), is the successor tenant and assignee to Aviation Properties Inc., a Washington corporation, the original tenant under that certain Airport Hangar Land Lease Agreement, as amended (collectively, the "Lease"), originally dated June 8, 2001, by and between the City of Auburn, a Washington municipal corporation, as landlord ("Landlord"), and Tenant, covering the Premises legally described therein. Landlord hereby certifies the following to Pop N Son LLC, a Washington limited liability company, which entity is under contract to purchase Hangar 401 of the Auburn Airport Hangar, a leasehold condominium, and Chicago Title Insurance Company, which company is handling the title and escrow for said transaction. Landlord hereby acknowledges that said parties may rely upon the information provided herein to remove requirement 8 in the Commitment No. 252728-SC and proceed with closing. 1. The Lease, which is further described in that certain Memorandum of Ground Lease recorded under King County Recording No. 20020627002407, is in full force and effect. 2. Neither Landlord nor Tenant is in default in any respect under any terms of the Lease, and to Landlord's knowledge, no event has occurred or condition exists that could become a default by Tenant or Landlord under the Lease with the passage of time or giving of notice. ;. The term of the Lease commenced on June 8, 2001 and expires on June 7, 2051. Tenant does not have any right or option to extend the term of the Lease. This Landlord Affidavit shall not be deemed to alter or modify any of the terms and conditions of the Lease. EXECUTED this LVt day of August, 2025.
