District for a Sanitary Sewer Franchise, as November 3, 2025, at 7:00pm.
Section 20.02.040 of the Auburn City Code requires a franchise for any utility or telecommunications
carrier or operator to use public ways of the City and to provide service to persons or areas inside or
outside of the City.
Soos Creek Water and Sewer District has applied for a new franchise agreement to continue to
operate their existing sanitary sewer facilities in the public ways within the Auburn City Limits. The
facilities currently provide wastewater collection and conveyance for treatment and disposal within the
portion of Soos Creek's sewer service boundary area that is within the Auburn City Limits. The
proposed agreement is consistent with the City's standard franchise agreement language.

Background for Motion:
The moratorium will impose a six (6) month extension to the moratorium on all permitting applications
and activity related to energy storage systems, to allow staff additional time to develop appropriate
siting, construction, and operational requirements.
Background Summary:
Ordinance No. 6995 is a six (6) month extension to the moratorium enacted by Ordinance No. 6978
pertaining to the halting of acceptance, processing, and/or approval of applications for building and
land use development for energy storage system facilities (ESS) including battery energy storage
systems (BESS) proposed to be located in any zone within the City of Auburn.
In support of the development of the proposed development regulations, staff conducted a roundtable
discussion with industry experts on October 2, 2025, to provide necessary context and industry trends
in developing our regulatory code.
Staff requests additional time to consider the guidance of the industry experts and prepare for
additional coordination with City of Auburn Staff, City of Auburn residents, City of Auburn Planning
Commission, and City of Auburn Council in accordance with the Revised Code of Washington (RCW)
section 35A.63.220, RCW 36.70A.390, and Section 5 of Ordinance No. 6995.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, CONTINUING THE
MORATORIUM ENACTED ON MAY 10, 2025, PURSUANT
TO ORDINANCE NO. 6978 AND AS AMENDED BY
ORDINANCE NO. 6995 ON THE ACCEPTANCE,
PROCESSING, AND/OR APPROVAL OF APPLICATIONS
FOR BUILDING AND LAND USE DEVELOPMENT FOR
ENERGY STORAGE SYSTEM FACILITIES (ESS)
PROPOSED TO BE LOCATED IN ANY ZONE WITHIN THE
CITY OF AUBURN
WHEREAS, Energy Storage Systems (ESS) including Battery Energy Storage
Systems (BESS) are defined as installations designed to store critical electrical energy
for later use, typically consisting of batteries, power conversion systems, and control
equipment, a primary function of Energy Storage Systems is to store excess electricity
generated by the grid during periods of low demand or high renewable energy production,
such as from solar or wind sources, the stored energy can then be discharged when
demand is high or when renewable energy generation is low, stabilizing the electrical grid
and improving overall efficiency and reliability;
WHEREAS, the City's development regulations, specifically the land use category
of "Utility facilities and substations" in ACC 18.07.030 and "Utility transmission or
distribution line or substation" in ACC 18.23.030, are not currently defined to include the
recent technological changes and business models in Energy Storage Systems or
supporting infrastructure, but are understood to include public regional utility (PSE)
agencies that provide public services such as transformers, substations, pumpstations
and smaller scale grid infrastructure;
WHEREAS, applying the current regulations in Title 18 ACC to new technologies
and business models could lead to approval of ESS projects that are undesirable, unsafe,

and/or inconsistent with long-term planning goals and objectives of the City;
WHEREAS, the Auburn City Council makes the following findings of fact in support
of a moratorium under RCW 36. 70A.390, and identified the following unknown risks and
economic factors, that may be relevant in assessing the desirability of, and siting
concerns associated with, ESS in the City:
A. The City currently does not have specific zoning or development standards
applicable to ESS;
B. Thermal runaway at a BESS presents a significant burden to emergency
personnel as fires may burn for an inordinate amount of time, requiring
increased lengths for monitoring and containment, leaving other areas of
the city vulnerable to high response times;
C. Exceptional amounts of water is required in the event of a thermal runaway
to protect other cells from reaching a critical temperature and to suppress
the compromised cell, water used to control the emergency may contain
hazardous chemicals and materials such as cyanide and hydrofluoric acid
that may leach into the City's protected critical areas identified in Chapter
16.10 ACC;
D. Due to the exceptional amounts of water required to suppress a thermal
event, it is not known if the City, or the surrounding water districts have the
capacity to provide a constant flow of high-volume water;
E. BESS may create potentially hazardous air quality concerns in the event of
an emergency;
F. In the event of an emergency, it is unknown what the impacts to regional

transportation routes, businesses, and residents if an evacuation zone is
established;
G. ESS may produce impacts to wildlife that are not currently well understood
by the City;
H. ESS facilities located within the L-F Airport Landing Field District may pose
a significant risk to public health, safety, and welfare if an aircraft collision
occurs;
I. ESS facilities and their supporting infrastructure may be more appropriate
for the industrial (M-1 and M-2) zones in the City due to their scale, land
use, and potential impacts to life and safety of the general public;
J. It is unknown what fiscal or economic development benefits would flow to
the City if ESS facilities were permitted within the City;
WHEREAS, the City Council held a public hearing on 7:00 PM on May 5, 2025, to
adopt findings following the conclusion of a public hearing of Ordinance No. 6978,
WHEREAS, further discussions with industry leaders are needed to better
understand the potential impacts of ESS facilities and to vet proposed code amendments
language requested to be performed by staff on behalf of the City,
WHEREAS, the potential adverse impacts on public health, property, safety, and
welfare of the City and community of the moratorium authorized under Ordinance No.
6978 expires before staff can complete necessary research, further justifies a moratorium
under RCW 35A.63.220 and the designation of this ordinance as necessary for the
protection of public health, public property, or the public peace by the Council, the
moratorium imposed herein promotes the public good and is necessary for the protection

of public health, property, safety, and welfare;
WHEREAS, to promote public health, safety, and welfare, the City Council deemed
it necessary and proper to extend the moratorium on land use and development permit
applications related to BESS for an additional period of six (6) months by holding a public
hearing on October 20th, 2025 at 7:00 PM to adopt findings following the conclusion of a
public hearing for Ordinance Number 6995;
WHEREAS, it would be an efficient use of resources and an appropriate exercise
of its planning authority under the Growth Management Act, Chapter 36.70A RCW, and
Chapter 35A.63 RCW for the City to integrate and analyze whether, and under what
regulatory parameters, ESS be allowed uses within the City;
WHEREAS, the City possesses land use jurisdiction and regulatory authority over
the City's incorporated lands; and
WHEREAS, the adoption of this moratorium is exempt from the threshold
determination requirements under the State Environmental Policy Act;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN as follows:
Section 1. Findings of Fact. The recitals set forth above are hereby adopted
as the City Council's findings of fact in support of the moratorium established by this
ordinance, The City Council may, in its discussion, adopt additional findings after the
public hearing referenced in Section 4 below.
Section 2. Moratorium Imposed. Pursuant to RCW 35A.63.220, and RCW
36.70A.390, a temporary moratorium is hereby extended upon Tier II and Tier III ESS
facilities in any zone within the City of Auburn. This moratorium also applies to the City's

acceptance, processing, or approval of any applications, building permits, and land use
permits for ESS facilities including without limitation;
A. Administrative Use permits;
B. Conditional Use permits;
C. Building permits;
D. Grading permits;
E. Short plats;
F. Subdivisions;
G. Binding site plans;
H. Reasonable use exceptions;
I. Variances from Title 18 ACC regulations;
J. Deviations from any City of Auburn engineering design and
construction standards or other technical codes for ESS facility within
the City or any other type of development permit, approval, or code
interpretation in connection with the same; and
K. Any other development permits related to ESS facilities.
The moratorium codified herein shall not apply to Tier I residential Battery Energy Storage
Systems that serve as a back-up source of energy, load shedding, and storage of solar
energy. Fires and other emergencies typically seen from Tier I BESS are limited in their
impacts to the safety, welling, and health of the community.
Section 3. Term of Moratorium. The moratorium imposed by this Ordinance
shall become effective date described in Section 8, and shall continue in effect for an
additional period of six (6) months, provided that the moratorium shall automatically expire

upon the effective date of zoning and land use regulations adopted by City Council to
address siting, construction, and operation of ESS located within the City of Auburn.
Section 4. Public Hearing., Pursuant to RCW 35A.63.220 and RCW 36.70A.390,
the City Council has held a public hearing at the City Council's regular meeting at 7:00
PM on October 20th, 2025, in order to take public testimony on this moratorium.
Section 5. Referral to Staff; Work Plan. City Staff and the Auburn Planning
Commission are hereby authorized and requested, as part of their ongoing work related
to ESS facilities to study the issues identified in this ordinance and to develop
recommendations for whether ESS facilities should be allowed uses within the City and,
if so, what zoning regulations and public processes are needed to protect the health,
safety, and welfare of the community and ensure that such facilities are developed in a
manner that is compatible with the overall plan and vision of the City. These
recommendations shall be reviewed and considered by the Auburn City Council for
inclusion as a Chapter in Title 18 of Auburn City Code and/or other official controls of the
City.
A. The City of Auburn Planning Commission shall be authorized and
directed to hold public hearings and public meetings to fully receive and consider
statements, testimony, positions and other documentation or evidence related to the issue
of the ESS, including, but not limited to, regulations related to the siting, construction, and
operation.
B. The Planning Commission and City staff are authorized and directed to
review the experiences of other jurisdictions, the status of legal cases, and statistical data,
information, studies and other evidence compiled by other municipalities, of adverse

impacts of such ESS, and to review State and Federal law and regulations and the
regulations, ordinances and codes adopted by other municipalities to address ESS, and
any information that is pertinent to consideration of ESS, including but not limited to siting,
construction, and operation.
C. The City of Auburn Planning Commission shall work with City Staff and
the community of the City to develop proposals for regulation of ESS land use and zoning
considerations, to be forwarded in their recommendations to the City Council for inclusion
in ordinances and ultimate adoption as a apart of the City Cide of the City of Auburn,
including regulations related to siting, construction, and operation of ESS.
D. The Mayor, in consultation with the City Attorney, Community
Development Director, Public Works Director, Police Chief, Emergency Management,
Fire Marshal, and other staff, shall periodically advise and report to the City Council as to
the status of hearings, meetings, and information development regarding actives of the
Planning Commission and City Staff relative to the evaluation, consideration, and
development of regulations concerning ESS, including, but not limited to, siting,
construction, and operation, until adoption of a comprehensive ordinance as developed,
relating to ESS becoming effective in the conjunction with the termination of the
moratorium referred to in this ordinance.
Section 6. Implementation. The Mayor is authorized to implement those
administrative procedures necessary to carry out the directives of this legislation.
Section 7. Severability. The provisions of this ordinance are declared to be
separate and severable. The invalidity of any clause, sentence, paragraph, subdivision,
section, or portion of this ordinance, or the invalidity of the application of it to any person

or circumstance, will not affect the validity of the remainder of this ordinance, or the validity
of its application to other persons or circumstances.
Section 8. Effective date. This Ordinance will take effect and be in force five
days from and after its passage, approval, and publication as provided by law.

City Council to adopt Resolution No. 5860.
Background for Motion:
The City Council passed Ordinance No. 5833, which provided for the adoption of a Fee Schedule.
Every year, City staff reviews the fees charged by their respective departments and recommends
adjustments based on current costs or inflation where appropriate. This Resolution would approve
the proposed adjustments and amend the City of Auburn Fee Schedule for fees to be charged in
2026.
Background Summary:
Resolution No. 5860 proposes modifications to the City's Fee Schedule as part of its annual review
process. Each department reviews its fees, rates and charges to ensure they are reflective of current
costs and are adjusted for inflation where appropriate.
In accordance with previous City Council direction on fees for development achieving a full cost
recovery, general fees have been increased by 3% and hourly rate fees have been increased based
on budgeted values for 2026 to address inflation and the typical annual increase in wages and
benefits that have occurred since the last fee schedule update. In addition, a 1% increase to the
technology fee was included to address the specific costs for software upgrade that are required to
continue use of mybuildingpermit.com which allows for efficient management of permits and
payments between the City and applicants.
Traffic Impact Fees (TIF) have been modified based on the discussion and code adoption that was
completed on August 4, 2025. These changes include more transparency in the factors that are used
to calculate TIF, addresses the update of the Transportation Comprehensive Plan polices to
incorporate multi-modal projects into the fee system, implements a district approach towards the TIF
rate development for downtown verses non-downtown development, and incorporates a TIF reduction

factor for development within close proximity to frequent transit services. Overall, these changes
generally result in a lower per trip fee than the 2025 fee. However, various factors may increase or
decrease the final assessed fee based on the project's specific trip generation characteristics and
whether or not credits apply. The revised schedule also includes revisions intended to improve the
TIF program flexibility: criteria for TIF payment installation programs and fee determination
approaches if the proposed land use is not listed in the fee schedule. Aside from the proposed 2026
fee schedule, the City is developing a TIF webpage and supporting tools that will improve the TIF
program's transparency and predictability.
System Development Charges (SDC) have not been increased at this time as the City is completing a
Utility Rate Study and an analysis of the SDC's is being done as part of that study. This may result in
an additional Fee Schedule update later in 2025.
The updates on hangar lease rates and for tie-down rates in Section D - Airport Fees were
recommended for approval by the Airport Advisory Board on September 17, 2025
The Valley Regional Fire Authority (VRFA) Fee Schedule has been updated to reflect a general 3.5%
increase. Fire Impact Fees have been updated by VRFA based on an impact fee study performed by
FCS Group. The study was completed to provide an updated fee methodology that was consistent
with WA State requirements for fees to be assessed for residential unit proportionality. As a result of
the study, residential Fire Impact Fees will now be assessed based on unit area (per Sq. Ft.) in lieu of
per dwelling unit. Both fee changes were approved by the VRFA Board of Governance on July 8,
2025.
SEPA checklist review fees have been updated to provide a distinction between commercial and
residential to provide a more proportionate fee for single-family and middle housing projects. The
SEPA checklist review fees were also generally updated to no longer include a separate base fee and
additional unit cost per report or study. Depending on the number of reports/studies associated with
an application, as a result, residential fees have decreased while commercial projects may see either
a decrease or increase over the 2025 fee schedule, depending on the number of studies/reports
associated with the project.
Fees for Critical Areas Determination Exemptions and Shoreline Exemptions have been updated to
be consistent with the proposed increased Floodplain Development Exemption fee. Although this
results in a greater relative increase for the critical areas and shoreline fee, the scope of work and
determination letters associated with each of these processes are analogous and are recommended
to be assessed consistently.
Temporary Certificate of Occupancy fees have been revised to be assessed based on the size of the
building or tenant space area (per Sq. Ft.). This will result in a reduced fee over 2025 fees for
buildings 5,000-Sq. Ft. or less. For larger buildings or spaces, the fee will increase to a maximum fee
of$3,000 which would apply to buildings or spaces 10,000-Sq. Ft. or larger.

WHEREAS, the City of Auburn provides various services, a number of which entail
charging a fee; and
WHEREAS, the City Council provided for the adoption of a Fee Schedule with the
passage of Ordinance 5833; and
WHEREAS, it is appropriate to review and amend the schedule for City fees to be
charged in 2026.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

a. Building Permit Fees: Building permit fees for new structures and additions are based
upon a project's construction valuation as set forth by the International Code Council
(ICC). ICC's construction valuation table is hereby incorporated into the City of
Auburn's fees schedule. Construction valuations will be updated on January 1st of each
year. Project valuation for alterations to existing buildings and for other structures not
identified in the ICC construction valuation table are based on the fair market value of

Change of Use: The permit fee shall be equivalent to the adopted additional plan review
and reinspection fee based on a minimum of four hours.
Certificate of Occupancy: For issuance of a new or replaced Certificate of Occupancy not
associated with any other building permit, a fee of$246-256.00 will be required per
certificate.
Commercial Re-roof Permit Fee: The permit fee shall be equivalent to the adopted
additional plan review and reinspection fee based on a minimum of three hours.
Conditional Approval: When authorized by the City, permits that are issued with
conditions due to project phasing, out of sequence issuance, pending associated
approvals, or other advanced permitting requests made by the applicant, a conditional
approval fee equivalent to the additional plan review fee based on a minimum of four hours
will be required prior to issuance.
Demolition Permit Fees: Demolition permits shall be charged a base fee of$17/1181.00.
Fire Permit Fee: For each fire permit fee a City of Auburn administration fee of
$1-28.143.00 will be applied in addition to the fee collected for the Valley Regional Fire
Authority (VRFA) as identified in the VRFA Fee Schedule.
Manufactured Home: The permit fee shall be equivalent to the adopted additional plan
review and reinspection fee based on a minimum of four hours.
Permit Extensions: For permits that are granted an extension beyond the expiration date
or date of abandonment, whether issued or not, a permit extension fee is required to be
paid prior to extension. The fee shall be the lesser of $1-28-143.00 or 50% of the original
application and permit fees.
Plan Review Fees: When submitted documents are required by Section 106.3 of the
Construction Administrative Code, a plan review fee shall be paid at the time of submitting
the submittal documents for plan review. Said plan review fee shall be 65 percent of the
building permit fee as shown in Table 1-A. The plan review fees specified in this section
are separate fees from the permit fees and in addition to permit fees.
Rack Permit Fee: The permit fee shall be equivalent to the adopted additional plan review
and reinspection fee based on a minimum of three hours.
Solar Permits — Over the Counter: The permit fee for solar installations that qualify for
the over-the-counter permitting shall be equivalent to the inspection fee based on a
minimum of two hours. Over the counter application and permit fees are not eligible for
refunds for applications made in error.
Stock Plan Site Plan Review Fee: The plan review fee for individual lot site plan that have
an approved building stock plan shall be $249259.00.
Temporary Certificate of Occupancy Fees: There shall be a fee of $0.30 per square
foot with a minimum charge of $600 and a maximum of $3,000cqual to $1,500.00 for
issuance of a temporary certificate of occupancy and a fee of$500.0030% of the original
temporary certificate of occupancy fee for each subsequent 30-day extension requested.

Work Without a Permit: Building construction and grading activities requiring permits per
ACC 15.74 that are determined to be in violation for work occurring without an approved
permit result in additional documentation, administration, research, and inspection and
require more processing time. For these cases, an additional 100% fee will be applied to
the standard application and permit fees identified in sections 3 and 4 above.
It is possible a violation existed prior to property purchase by a new owner, was
constructed by an individual who mislead the owner, or was constructed by an individual
who was unaware of code requirements. The fact that violations may not have been
created by the current owner does not relieve Code Enforcement staff from their
responsibility to seek compliance from the property owner. When assessing permit fees,
consideration may be given based on the circumstances, severity of the violation, and
timeliness of the property owner to resolve and obtain required permits and compliance
with City code.
Building Permit Fee Reductions. The Director is authorized to waive building,
mechanical or plumbing permit fees for homeowners that are already enrolled in another
City program that is intended to benefit low-income residents (e.g. housing home repair
program, utility discount program). This fee reduction may also be extended to contractors
that are applying for permits on behalf of these homeowners provided that it can be
documented that the discount is benefiting the homeowner and not supplementing a
contractor's profit.

Facility Extension Fees will be paid as follows:

second review is needed, before the City signs the facility extension agreement.

Additional Review:
Each additional plan review beyond a 3rd review, prior to plan approval, will require an

the Auburn Municipal Airport (approved by Ordinance No. 5500 on January 16, 2001). For
the purposes hereof, each tie-down consists of the structures/facilities necessary to
accommodate one (1) regular--sized light aircraft. Furthermore, the hangar doors to which
the security surcharge applies includes all hangars located at the Auburn Municipal Airport,
including those hangars built on land owned by the City but leased to private parties and
those hangars owned in a condominium type ownership.
The above lease and security surcharge amounts are subject to applicable leasehold taxes,
which shall be paid by the tenant. The total charges, including the above lease rates plus
leasehold tax and surcharge, shall be reflected in monthly billing rates. Tenants shall be
given notice as required by ordinance or lease agreements. The Airport lease rates shall be
effective January 1, 20265.
Payments. Payments are due on the first of each month, past due as of the 5th and late as of
the 16th. Payments not received by the 15th incur a $25.00 late fee. Payments not received
after 30 days from the due date incur an additional $25.00 delinquency fee each month
payment is delinquent. Any instance where a check is tendered for payment and non-
sufficient funds exist to settle the transaction, a fee shall apply as set forth in the City of
Auburn Fee Schedule.
Automatic gate electronic cards. One automatic gate electronic card will be issued to
each City rental tenant free of charge. Any additional electronic cards requested by a tenant
are subject to a $25.00 fee. An additional $25.00 replacement fee will be assessed against
the tenant for all lost or damaged electronic cards. All electronic cards must be returned to the
airport at the time of lease expiration.
Each lease shall include an initial payment of first and last months' rent plus a damage
deposit in the amount of two times the monthly base rate, with the exception of an outside tie-

down lease which shall include an initial payment of first month's rent only. Each lease
agreement shall also include terms that authorize the City to apply the damage deposit to
outstanding charges on termination.

agreement must be completed and appropriate fees paid. The storage of vehicles is for the
convenience of the users of the Auburn Airport and is month-to-month.

N. WAIVER OF FEES (Per Resolution No. 5181).
1. The Mayor is authorized to waive any fees for permits, licenses, publications and
actions as authorized by Sections 2.03.030, 5.10.030 and 12.60.020 of the City Code.
2. The Mayor is also authorized to reduce, and is vested with to discretion to reduce
in compelling cases, by up to 50% any fees for permits, publications and actions where the
applicant — the party responsible for payment of such fees — is an organization exempt from
taxation under 26 US 501(c)(3), and where the permit(s), publication(s) and/or action(s) relate
directly to the provision of charitable services to residents of the City of Auburn. Charitable
services are defined as events or services provided to the residents of Auburn free of charge and
where the City is a sponsor of the specific event or service. For the purposes hereof, "compelling
cases" mean instances where there is an extraordinary need (greatly beyond current and ordinary
need)for the charitable services that would be able to be provided. The intent of this authorization
is to empower the Mayor with sole discretion to waive some fees in unique situations where there
is a greatly increased need for new charitable services to be provided, and where the reduction
of fees to the City will not detrimentally impact the City's ability to provide municipal services. This
waiver does not include Impact Fees, System Development Charges, any fees related to
Franchise or Public Way Agreements, Right-of-way Vacations, Right-of-Way Use Permits, Facility
Extensions, Police Department Fees, Animal Licensing Fees and Penalties, Banner Permit Fees,
or Cemetery or Parks fees.

Background for Motion:
This Resolution would replace the current VRFA fees with the revised 2026 Fee Schedule, effective
January 1, 2026. The 2026 Fee Schedule was adopted by the VRFA Governance Board on July 8,
2025.
Background Summary:
The Valley Regional Fire Authority (VRFA) was established in 2007 under RCW 52.26 as a Fire
Authority that serves the cities of Auburn, Algona, and Pacific. As a Fire Authority VRFA operates as
a separate municipal corporation, with independent taxing authority, and within an independent taxing
district.
While VRFA is a separate Fire Authority and is organizationally independent from the City of Auburn,
VRFA continues to have a role in reviewing development proposals and conducting inspections
during the construction process. Within VRFA, it is the Fire Marshal's Office that performs these
functions.
While VRFA has taxing authority within its jurisdictional boundary, tax payers do not fund all services
offered by VRFA. In some instances there are fees charged to customers who are seeking direct
service, e.g. a permit to construct a commercial building. In other words, permit customers pay a
substantial portion of the direct service they are seeking, as opposed to the service being subsidized
across the taxing district. Stated in yet another way, a residential tax payer who pays a portion of
their property taxes to VRFA is generally not providing a significant level of financial contribution to a
commercial real estate proposal or a new residential subdivision.
Since the Fire Authority was established in 2007, VRFA has collected fees for reviewing development

plans and conducting construction inspections. In Auburn, VRFA fees are collected by the City and
distributed to VRFA. This practice was put in place in order to ensure that Auburn could achieve a
one-stop permitting shop. Instead of sending customers to a VRFA office to pay fees and apply for
separate fire permits, customers can submit, pay and pick up permits at the City's Permit Center.
More times than not, the customer never knows that they are interacting with, and paying, separate
governmental entities.
The 2026 VRFA fee schedule includes a general increase of fees by 3.5%, consistent with City of
Auburn development fee increases.
While VRFA is a separate agency, with a separate Governance Board that has authority to establish
its own service fees, the Auburn City Council has a role in endorsing fees that are collected by the
City and distributed to other agencies (similar to Council's role in reviewing school district fees and
taking action to authorize the collection of these external agency fees). Typically, City Council would
provide this endorsement through action of a Resolution which then enables procedural efforts to
occur that facilitate collection of the relevant fees and fee types.

AUBURN, WASHINGTON, RELATING TO THE
ENDORSEMENT OF THE 2026 VALLEY REGIONAL FIRE
AUTHORITY FEE SCHEDULE AS ADOPTED BY THE VRFA
BOARD OF GOVERNANCE
WHEREAS, the Valley Regional Fire Authority (VRFA) was established in 2007
under the authority of RCW 52.26 and operates as a separate municipal corporation, with
independent taxing authority, and within an independent taxing district; and
WHEREAS, VRFA serves the cities of Algona, Auburn, and Pacific and is guided
by a Governance Board comprised of elected officials representing each city; and
WHEREAS, the VRFA Governance Board has adopted an updated fee schedule
for 2026 that covers a portion of the direct cost of permit review, plan review, and
inspection services performed out of the Fire Marshal's office; and
WHEREAS, the City of Auburn collects direct service fees on behalf of VRFA in
order to support the concept of a one-stop-shop for development and permitting services;
and
WHEREAS, in order to collect direct service fees on behalf of VRFA, the City of
Auburn must incorporate VRFA fees into city procedures, city permitting software
systems, and city financial systems.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, RESOLVES as follows:
Section 1. The Valley Regional Fire Authority Fee Schedule is hereby adopted
as set forth in the attached "Exhibit A".

10 OPERATIONAL PERMITS
All Operational Permits listed in the International Fire Code Section 105.6 are included with the Fire Benefit
Explanatory Notes
1.The VRFA establishes its review and inspection fees on a percentage of the permit fee assessed by the
authority having jurisdiction. Using a percentage of the jurisdictional fee as the basis of VRFA eliminates the
need to adjust the VRFA fee schedule every time a jurisdictional fee changes.
2.The fee only applies to single family occupancies that require fire protection systems.
3. Hourly rebate is based on the direct costs of VRFA staff time,salary, benefits,overhead,administrative
costs, and resources.

5. Preventable nuisance and malfunction false alarms exist to reduce unwarranted calls that remove
emergency apparatus from service.Though there is no penalty for 1st and 2nd violations, it provides an
opportunity for the VRFA to educate owners about any mechanical problems for repair technicians to
correct any deficiencies that may exist. Subsequent false alarms incur a penalty in an attempt to encourage
needed repairs of the associated systems.
6.The VRFA Fire Marshal is authorized to reduce any fees for permits. In compelling cases where the
applicant-the party responsible for payment of such fees-is an organization exempt from taxation under
26 USC 501C3, and where the permit relates directly to the provision of charitable services to residences of
the VRFA service area,the VRFA Fire Marshal is vested with discrection to reduce any fees for permits,
publications, and actions by up to 50%.
7. Permits that are not completed and no project improvement are made can, in writing,ask for inspection
fees to be refunded.
8.The VRFA will attemp to accommodate a client's requests for inspection outside of normal working hours.
If there is not an inspector available,the request may be denied. If a client requests such inspection and the
inspection cannot be completed for any of the reasons outline above,the department shall retain the
minimum inspection fee and is authorized to deny any future requests.A 24-hour notic for cancellations is
required for refund of fees.
9. After hours inspecton fees are charged when an inspection is performed outside of normal work hours as
the client's request.

11. If an inspection for a fireworks display/fireworks sales permit is scheduled outside of normal VRFA hours
for the Fire Marshal's Office, it will be billed at a two hour minimum in accordance with line 5.5. in this fee
schedule.
