PRIVATE ROAD EASEMENT AND MAINTENANCE AGREEMENT
KNOW ALL MEN BY THESE PRESENT that I/We, the undersigned.owners and/or assigns in
fee simple and/or contract purchasers of the real property herein described as a short subdivision,King
County No.07617, (Lots 1-4,inclusive)do hereby declare. grant.accept and establish this Private Road
Easement and Appurtenance Fasements for Water. Sewer, Drainage, Electrical,Gas,CATV, and
Telephone which easements lie within this short subdivision,and are represented graphically-on the record
of survey recorded under auditor's file number: 970221900 1
THE FOLLOWING COVENANTS AND CONDITIONS SHALL BE AN INTEGRAL PART OF THIS
EASEMENT'
1. That the purpose of said easements is for ingress,egress.utilities.drainage.public utilities and the
construction, use and maintenance thereof.
2. That the maintenance costs of the road, roadway area,and road easement shall be equally allocated
and apportioned by and between each lot represented by each lot's respective lot owner of the short
subdivision. Each owner, contract purchaser, heir.assign and/or successor shall be responsible for
said costs, unless and until such time that said road is improved to King County standards. and
dedicated to and accepted by King County and their governing municipality. However,until such
dedication and acceptance.each owner, contract purchaser. assign,and/or successor shall remain
responsible to pay their pro-rata share of all costs and expenses related to maintenance, upkeep and
;uo improvement of the roadway, including any and all other improvements that may be required within
the described easement area,but not limited to any asphaltic surfaces,concrete surfaces,drainage ways.

5_ These covenants are for the mutual benefit of each lot, lot owner and/or his/her heirs, successors and
assigns, and are for further purpose of compliance with the resolutions and regulations of King County
and the State of Washington, and such persons as are specifically given the right to enforce these
restrictions and reservations by injunction or other lawful procedure and to recover any damage
resulting from such violation.
Each lot owner hereby reserves therefrom a non-exclusive easement for pedestrian and%ehicular ingress
and egress over,along, and across those portions of the roadway. and according to the record of survey filed
in the office of the County Recorder of King County, State of Washington. as file number 9702219001 of
official Records,and as attached hereto.
