The Payback Agreement concerns, among other matters, future development along the north side of 10 ' Street NE, from D Street NE to (future) A Street NE, as legally described in the Payback Agreement ("North Side Development"), and the obligation of the parties performing the North Side Development to pay to Roundup certain sums if the North Side Development is performed within a specified time period (the"Payback Obligation").
