The Grantor, Scott D. Pleake,as a separate estate, for and in consideration of TEN AND
NO/100($10.00) DOLLARS,and other valuable consideration,convey(s)and grant(s) unto the City
of Auburn,a Washington municipal corporation,and its assigns,Grantee, under the imminent threat of
the Grantee's exercise of its rights of Eminent Domain,an easement over, under, upon and across the
hereinafter described lands for the purpose of constructing and maintaining cuts and/or fills for slopes
occasioned by the original grading and reestablishment of grades for road and associated stormwater
management purposes,together with the right of Grantee, its agents and assigns,to enter upon said
premises at any time with all necessary staff, material, and equipment for the purposes of constructing,
inspecting, repairing, and maintaining the same. Grantor shall not perform any grading or planting
within the easement that, in the opinion the City Engineer, would undermine or weaken the slope.
Grantee shall have the right to use the Easement Area for the purpose of constructing, repairing and
maintaining a wall and appurtenances thereto subject to applicable city permits.
Said lands being situated in King County, State of Washington, and described as follows:

It is understood and agreed that delivery of this easement is hereby tendered and that the terms
and obligations hereof shall not become binding upon the City of Auburn unless and until accepted
and approved hereon in writing for the City of Auburn, by its authorized agent.
