Before the FEDERAL CONINIUNIC'ATIONS CONINIISSION Washington, U.C. 20554 In the Matter of Comcast Cable Communications, LLC on behalf of its Subsidiaries and affiliates For Determination of Effective Competition in: 9 Algona, Washington-Area Franchise Areas CSR No. To: Chief, Media Bureau PETITION FOR SPECIAL RELIEF Comcast Cable Communications, LLC, on behalf of its subsidiaries and affiliates (together "Comcast" or the "Company"), by its attorneys, and pursuant to Sections 76.7 and 76.907 of the Commission's rules,' hereby requests that the Commission find that Comcast faces "effective competition" in 9 Algona, Washington-area franchise areas (the "Franchise Areas") .`' The Communications Act of 1934, as amended (the "Act"), and the Commission's rules provide that cable television rates may be regulated only in the absence of effective competition.3 Cable operators are entitled to demonstrate that effective competition exists on a franchise-by- franchise basis.4 When a cable operator rebuts the presumption that cable systems are not subject to effective competition with evidence that effective competition is present within a franchise area, cable rates in the affected area are no longer subject to regulation.' 1 47 C.F.R. §§ 76.7 and 76.907 z See Exhibit I 3 47 U.S.C. § 543(x)(2); 47 C.F.R. § 76.905(a). 4 47 C.F.R. § 76.907. s See Implementation of Sections of the Cable Television Consumer Protection and Competition Act of 1992, Rate Regulation, 8 FCC Red. 5631, 5664-5665 (1993) ("Rate Order"). Under the "competing provider" test set forth in Section 623(1)(1)(B) of the Act and Section 76.905(b)(2) of the Commission's rules (the "Competing Provider Test"), a cable system will be deemed subject to effective competition if the franchise area is: (i) served by at least two unaffiliated multichannel video programming distributors, each of which offers comparable programming to at least 50 percent of the households in the franchise area; and (ii) the number of households subscribing to multichannel video programming other than the largest multichannel video programming distributor exceeds 15 percent of the households in the franchise area. As demonstrated below, the Competing Provider Test is satisfied in each of the nine Franchise Areas - Algona, Auburn, Black Diamond, Covington, Des Moines, Enumclaw, Maple Valley, Pacific, and Tukwila. The reported penetration rate for competing providers exceeds 15% in these Franchise Areas. Accordingly, Comcast requests that the Commission issue an order finding that the Company is subject to effective competition in the Franchise Areas under the Competing Provider Test. 1. COMCAST SATISFIES THE COMPETING PROVIDER TEST IN THE FRANCHISE AREAS A. More Than Two Unaffiliated MVPDs Offer Comparable Programming to Over 50 Percent of the Households in the Franchise Areas. The Competing Provider Test requires that the Franchise Areas must be served by "at least two unaffiliated multichannel video programming distributors... "7 This requirement is easily satisfied, because the two major direct broadcast satellite providers (DirecTV, Inc. and EchoStar Communications Corporation) ("DBS Providers") are unaffiliated with Comcast and offer service to more than 50 percent of the households in Comcast's Franchise Areas. 6 47. Section 602 of the Communications Act of 1934, as amended, defines "multichannel video programming distributors" to include cable operators, as well as DBS and MMDS providers. See 47 U.S.C. § 522(13). WDC 7118421 0107080-000049 The Commission has determined that DBS service is presumed to be "technically available" throughout the country due to its nationwide satellite footprint.8 DBS service is presumed to be "actually available" if households in a franchise area are made "reasonably aware" that the service is available.9 Comcast's Franchise Areas are well within the satellite footprint of DirecTV and EchoStar. Both DirecTV and EchoStar are clearly "technically available" in the Franchise Areas. The Commission has recently stated that consumers can be presumed to be "reasonably aware" of the availability of DirecTV and EchoStar as a result of their substantial growth, and the fact that DBS penetration in the respective franchise areas exceeds 15 percent. 10 DirecTV and EchoStar are among the largest MVPDs in the nation.'' The Commission's rules define comparable programming as "at least 12 channels of video programming, including at least one channel of nonbroadcast service programming."16 The Commission has repeatedly recognized that the DBS Providers offer comparable programming under the Commission's Competing Provider Test. 17 The DBS Providers offer well over 100 video channels, most of which are non-broadcast services. 18 And, as shown in the attached channel line-up, Comcast's programming service offerings in the Franchise Areas are substantially similar to the DBS Providers' programming services.19 Accordingly, Comcast has satisfied the first prong of the Competing Provider Test. B. The Competing Providers Serve Greater Than 15 Percent of the Households In Comcast's Franchise Areas. To satisfy the second prong of the Competing Provider Test, the petition must show that the subscriber base of competing MVPDs, other than the largest MVPD, exceeds 15 percent of 14 See footnote 10, supra. Comcast obtained DBS penetration figures from the Satellite Broadcasting and Communication Association ("SBCA") to confirm the Company's assumption that it remains the largest MVPD in each of the Franchise Areas. SBCA is the national trade association representing the two DBS Providers, as well as other satellite service providers, and it has assumed the responsibility for compiling subscribership data and responding to data requests from cable operators and franchising authorities engaged in effective competition proceedings. When the SBCA-provided data was adjusted to reflect local franchise boundaries,20 Comcast was able to confirm that its own subscribership exceeded DBS subscribership in all of the Franchise Areas subject to the Competing Provider Test.21 In these communities, Comcast is clearly the largest MVPD. The process of determining the precise number of DBS subscribers within a franchise area is not an exact science because the DBS Providers track their subscribers according to the zip codes where each subscriber resides, rather than by political jurisdiction. A standard five- digit zip code in certain cases may not coincide precisely with the boundaries of a cable operator's franchise area. To account for this anomaly, Comcast employed an allocation methodology similar to that previously accepted by the Commission in other effective competition proceedings.22 This allocation methodology enabled Comcast to adjust the zip- 20 This adjustment process is discussed infra pp. 5-7. 21 See Declaration of Warren O. WDC 711842v1 0107080-000049 code-based DBS subscriber data provided by SBCA to ascertain the number of DBS subscribers in each actual Franchise Area. To obtain the proper allocation figures, Comcast contacted Media Business Corp. ("MBC," previously known as "SkyTrends").23 MBC has developed a process to accurately segment populations within each zip code to correspond to political boundaries. 24 MBC utilizes enhanced mapping software to overlay franchise boundaries and the Census Department's "block group" level households. The "block group" measurement is the most precise Census tool available to measure households within a very small geographical area. Once the overlay is performed, MBC can determine whether a particular block group lies inside or outside a particular franchise area. By comparing the block group households that are located within a particular franchise area with the total number of block group households included in the zip code as a whole, MBC is able to derive a meaningful allocation factor. This allocation factor reflects the portion of a five-digit postal zip code that lies within the boundaries of a specific Franchise Area. 25 Comcast next applies the allocation factor provided by MBC to the zip code-based subscriber figures provided by SBCA.26 The resulting product represents the actual DBS subscribership within each designated Franchise Area. 27 23 MBC's data and allocation methodology have been relied upon by the Commission countless times in granting effective competition petitions. WUC 711842v1 0107080-000049 To determine whether this subscribership exceeds the statutorily mandated 15 percent threshold in each of the Franchise Areas, Comcast compared the reported DBS subscribership to the U.S. Census household figures for each community.28 This comparison yields the penetration rate for the DBS Providers in each of the Franchise Areas. As detailed in Exhibit 6, the subscriber base for the DBS Providers in the Franchise Areas exceeds the 15 percent threshold required under Section 623(1)(1)(B) of the Act. Accordingly, Comcast clearly faces effective competition under the Competing Provider Test in each of the nine Franchise Areas. CONCLUSION Comcast's cable systems are subject to effective competition in the nine Franchise Areas under the Competing Provider Test. Thus, effective competition existed in all of the Franchise Areas at least as of the filing date of this Petition. Based on the evidence presented herein, 28 See Exhibit 7. The allocation figure identifies the percentage of a ZIP code population located within a particular franchise area. MBC developed this methodology to address the potential shortcomings in utilizing 5-digit ZIP code data for "effective competition" petition. This basic methodology has been in place for several years and has been used successfully in many effective competition cases at the FCC. Because ZIP codes and municipal boundaries are created and managed by different government authorities, the boundaries sometime do not align. ZIP codes often span between and beyond municipal boundaries. MBC's ZIP code mapping enables our clients to obtain proper allocation figures to "split" ZIP codes into their respective franchise areas. Once MBC correctly identifies each franchise area, we map all potentially overlapping ZIP codes to each franchise area. MBC uses ZIP code boundaries from Geographic Data Technology ("GDT"). GDT's data are based on a combination of the company's DYNAMAP/2000 data, the USPS ZIP+4 Data File, the USPS National 5-Digit ZIP Code and Pose Office Directory, USPS ZIP+4 State Directories, and the USPS City State File. At that point, MBC can identify those portions of a ZIP code area within a particular franchise area. Because a geographic area does not necessarily correspond to population enters, it is necessary to look at household data to accurately reflect the actual population distribution within each "split" ZIP code locations. Using the ZIP code mapping files created in the previous step, MBC then populates the "split" ZIP code data with "block-group" level household (HHS) data provided by the 2000 Census. The process produces, for each ZIP code: (1) the total block group level HHS in the entire 5-digit ZIP code; (2) the block group level HHS in the portion of the ZIP code that overlaps the franchise area; and (3) a percentage figure, corresponding to the portion of the Zip code HHS within the franchise area.
