AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING FREIGHT MOBILITY STRATEGIC
INVESTMENT BOARD GRANT FUNDS AND FEDERAL TEA-21 (SECTION
1118) GRANT FUNDS (WITH LOCAL MATCHING FUNDS) AS PROVIDED IN
THE LOCAL AGENCY AGREEMENT SUPPLEMENT BETWEEN THE CITY
AND THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION TO
PREPARE AND IMPLEMENT THE SR 18 / C STREET SW RAMP
MODIFICATIONS / 3RD STREET SW GRADE SEPARATION PROJECT.
WHEREAS, the City Council of the City of Auburn must adopt and
approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and
WHEREAS, the Washington State Department of Transportation
(WSDOT) has requested that the existing Local Agency Agreement (LA 4018)
be supplemented to obligate additional project funding administered by
WSDOT; and
WHEREAS, the amount of $300,000.00 referenced in Section 1 of
Ordinance No. 5266 is included as a portion of the amount of $4,010,297.00
indicated in Exhibit "A" (column '4', row 'u') and the remaining portion is
accounted for in other local agency grants; and
WHEREAS, the amount of $621,000.00 referenced in Section 2 of
Ordinance No. 5266 is included as a portion of the amount of $3,556,603.00
indicated in Exhibit "A" (column '5', row 'u') and the remaining portion is

accounted for under the previous Local Agency Agreement (LA 4018)
Supplemental 2 as authorized under Ordinance No. 5118.
NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Pursuant to Chapter 35A.33 RCW, the City Council hereby
approves the expenditure and appropriation of Freight Mobility Strategic
Investment Board (FMSIB) funds in the amount of $10,000,000.00 (not to
exceed 36% of the total project cost) to prepare and implement the SR 18 / C
Street SW Ramp Modifications / 3rd Street SW Grade Separation Project and
authorizes the Mayor and City Clerk to execute a Local Agency Agreement
Supplement in the amount of $300,000.00 included as a portion of Estimated
Agency Funds, a copy of which is attached hereto as Exhibit "A" and is
incorporated herein by reference. The Mayor and City Clerk are also
authorized to approve and execute any future supplemental agreements thereto
required for obligation of the remainder of the $10,000,000.00 and completion
of phases of the project including but not limited to design, right-of-way, and
construction.

Section 2. Pursuant to Chapter 35A.33 RCW, the City Council hereby
approves the expenditure and appropriation of federal TEA-21 (Section 1118)
funds in the amount of $5,800,000.00 with local matching funds of $905,202.31
(from a combination of the existing WSDOT Funding Agreement, FMSIB
funding and future Port of Tacoma / Burlington Northern Sante Fe Railroad
Interlocal Agreements) to prepare and implement the SR 18 / C Street SW
Ramp Modifications / 3rd Street SW Grade Separation Project and authorizes
the Mayor and City Clerk to execute a Local Agency Agreement Supplement in
the amount of $621,000.00 (included as a portion of Estimated Federal Funds)
a copy of which is attached hereto as Exhibit "A" and is incorporated herein by
reference. The Mayor and City Clerk are also authorized to approve and
execute any future supplemental agreements thereto required for obligation of
the remainder of the $5,800,000.00 and completion of phases of the project
including but not limited to design, right-of-way, and construction.
Section 3. If any section, subsection, clause or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional, such invalidity
or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this Ordinance, as it being hereby expressly declared that
this Ordinance and each section, subsection, sentence, clause and phrase

hereof would have been prepared, proposed, adopted and approved and
ratified irrespective of the fact that any one or more section, subsection,
sentence, clause or phrase be declared invalid or unconstitutional.
Section 4. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of
this legislation.
Section 5. This Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.

Realignment of the westbound ramp from SR18 to intersect with the existing 3`° St./"C" St. SW intersection. Widening and
channelization improvements to accommodate additional tum lanes. Grade Separation of 3rd St. SW from the BNSF rail line.
Reason for Supplement
Adjustment of funds to better utilize all the funds available to the City and to begin Right-of-Way appraisals and acquisition on the full
parcel acquisitions and appraisals on the partial acquisitions upon approval of the environmental documentation and Phase 2
approval of the Right-of-Way Plans.
