PURCHASE AND SALE AGREEMENT
In the matter of the M Street NE/ Harvey Road and 8th Street NE Improvements Project,
CP0611, Parcel No. 1821059004, located on M Street NE.
THIS AGREEMENT is made and entered into by and between the City of Auburn, a
municipal corporation of the State of Washington, hereinafter referred to as the "City", and
the undersigned owner(s) hereinafter referred to as the "Owner(s)":
WITNESSETH
WHEREAS, the City affirms and the Owner(s) agree(s) that a right-of-way over the
Owner's real property described herein is required by the City for construction of a
roadway improvements and widening associated with the project described above.
AND WHEREAS, the City has made a firm and continuing offer to pay the amount of ONE
HUNDRED AND SIXTY FIVE THOUSAND DOLLARS AND NO CENTS ($165,000), for
the purchase of the following described real property in Auburn, King County, Washington:
See "Exhibit A" and "Exhibit B"
NOW THEREFORE, in consideration of the mutual covenants set forth herein, it is
understood and agreed that:
1. The Owner(s) shall convey the real property described above by sufficient Dedication
Deed, free from all liens and encumbrances of every nature.
2. The City will issue a check in the amount of $165,000 as stated above, which will be
deposited with Pacific Northwest Title Company of Washington.
3. The City will pay normal costs of closing, such as escrow services, title reports and
recording fees. Any outstanding liens, assessments, taxation encumbrances that may
have to be removed to provide clear title to the City are to be satisfied in escrow by the
Owner(s) out of the proceeds of the sale.
4. Ctosing shall occur not later than 45 calendar days after the date on which the last
signature is affixed herein.
5. The City shall be entitled to possession immediately upon closing.
