City Council adopt Resolution No. 3595.
Background Summary:
Resolution No. 3595 authorizes the transfer of ownership of Emerald Downs Drive that is not currently
public right-of-way from the Muckleshoot Indian Tribe to the City of Auburn as public right-of-way.
In connection with the development of the Emerald Downs Racetrack, the City of Auburn entered into a
Contingent Dedication Agreement and as an exhibit to the Contingent Dedication Agreement, a
Contingent Deed of Dedication, between the City of Auburn and La Terra Limited Partnership (binding on
heirs, assigns and successors) providing for the dedication of a portion of Emerald Downs Drive. The
Contingent Dedication Agreement and the Contingent Deed of Dedication authorize the City of Auburn to
accept the dedicated portion of Emerald Downs Drive for road purposes upon the occurrence of certain
conditions (see attached Resolution):
Condition 5a. - Staff performed a traffic analysis and determined that at least two of the required arterial
corridors have reached LOS "D" or below:
· 15th St NE/NW (AWN to WVH) pm peak, eastbound = LOS "F"
· 15th St. NE/NW (AWN to WVH) pm peak, westbound = LOS "F"
· Auburn Way North (15th NE to S. 277th) pm peak, southbound = "E"
