Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Stacey Brothers, and Gene Cerino. Councilmember Rich Wagner was excused. Staff members present included: Parks and Recreation Director Daryl Faber, Fire Chief Bob Johnson, Human Resources Director Brenda Heineman, IS Administrator Lorrie Rempher, City Attorney Daniel B. Heid, Planning and Community Development Director Paul Krauss, Police Chief Jim Kelly, Public Works Director Dennis Dowdy, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements There were no announcements. 2. Appointments a) Human Services Committee City Council to consider the appointment of Suzanne Limric to fill an unexpired term which will expire December 31, 2004. MOTION CARRIED UNANIMOUSLY. 6-0. D. Agenda Modifications Agenda modifications included the addition of Resolution No. 3616 under Item No. VIII.B.9 of these minutes and Resolution No. 3617 under Item No. VIII.B.10 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearings were scheduled. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Mike Morrisette, 4702 Millpond Drive SE Auburn Mr. Morrisette reviewed the Chamber of Commerce involvement in drafting an ordinance amending the Auburn Municipal Code with regard to business licensing. Mr. Morrisette spoke in favor of and urged Council to adopt Ordinance No. 5754. Virginia Haugen 2503 "R" Street SE Auburn Ms. Haugen spoke regarding Ordinance No. 5758 related to restricted parking. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00. The Committee reviewed Ordinance No. 5754 and Resolution No. 3613, and discussed a potential lease of land to King County for wetland mitigation. The Committee also received a work -load analysis from the Auburn Police Department related to the impacts of increasing population on the Police Department. The next regular meeting of the Municipal Services Committee is scheduled for June 2, 2003 at 5:00 PM. Page 2 City of Auburn Council Meeting Minutes Mav 19 2003 B. Planning & Community Development Chair Borden reported that the Planning and Community Development Committee met May 12, 2003 at 5:00 PM. The Committee discussed Resolution No. 3617 and the Neighborhood Leadership Grant Program. The Committee also discussed the Capital Facilities Plan, the 2004 Community Development Block Grant (CDBG) applications, and Comprehensive Plan amendments. The next regular meeting of the Planning and Community Development Committee is scheduled for May 27, 2003 at 5:00 PM. C. Public Works Vice Chair Poe reported that the Public Works Committee met May 12, 2003 at 5:30 PM. The Committee discussed contract administration items, surplus property, Ordinance No. 5760 and Resolution Nos. 3605, 3607, 3608, 3609, 3610, and 3612. The Committee also discussed the fee structure related to facility extension agreements and traffic impact fee revisions. The next regular meeting of the Public Works Committee is scheduled for May 27, 2003 at 5:30 PM. D. Finance Chair Poe reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers, surplus property, Ordinance No. 5757, and Ordinance No. 5761. The next regular meeting of the Finance Committee is scheduled for June 2, 2003 at 6:30 PM. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. Mayor Lewis commended the many volunteers in the Auburn community and thanked the Chamber of Commerce for their work related to business licensing and their efforts with the Auburn Downtown Association related to retention of current businesses in Auburn and recruitment of new businesses to Auburn. Councilmember Barber moved and Councilmember Cerino seconded to approve the consent items. MOTION CARRIED UNANIMOUSLY. 6-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS A. Application No. ANX03-0001 03.1 ANXO-0001 City Council to approve the annexation/deannexation for municipal purposes and authorize the filing of the Notice of Intent with King County. Councilmember Borden moved and Councilmember Singer seconded to direct staff to file a Notice of Intent to Annex with King County. MOTION CARRIED UNANIMOUSLY. 6-0. (See Item VIII.B.10 for further action on this item.) VIII. ORDINANCES AND RESOLUTIONS A. Ordinances Page 5 City of Auburn Council Meeting Minutes May 19, 2003 Ordinance No. 5754 07.1 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 5.10 of the Auburn City Code, and creating a new Chapter 5.15 of the Auburn City Code, relating to General Business Licensing. Councilmember Singer moved and Councilmember Brothers seconded to adopt Ordinance No. 5754. MOTION CARRIED UNANIMOUSLY. 6-0. (Action on this item occurred after Item III.D.4 of these minutes.) 2. Ordinance No. 5757 A3.11.1.5 An Ordinance of the City of Auburn, Washington, amending Chapter 2.90 of the Auburn City Code relating to indemnification for city officials, city employees and city volunteers. Councilmember Poe moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5757. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5758 01.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Section 10.36.370 entitled "Fifteen Minute Parking Zones" and ACC Section 10.36.270 entitled "Prohibited Parking Areas — Northeast Auburn" for the purpose of designating "Police Vehicles Only" parking on North Division Street, west side, beginning at a point 21 feet south of the south curbline of 1st Street Northwest, thence southerly 67 feet. Councilmember Singer moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5758. MOTION CARRIED UNANIMOUSLY. 6-0. Ordinance No. 5759 03.8 REZ03-0002 An Ordinance of the City Council of the City of Auburn, Washington, providing for the rezoning of 509 M Street SE (A) and 1123 6th Street SE (B), within the City of Auburn, Washington, changing the zoning classification from R-2 (Single Family Residential) to R-3 (Two Family (Duplex) Residential). Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5759. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Ordinance No. 5760 04.9.1, F5.2.15 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to sign a Local Agency Agreement between the City and the Washington State Department of Transportation, approving Surface Transportation Program grant funds to design road improvements between A Street SW and South Division Street, near the Regional Transit Center. Councilmember Poe moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5760. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Ordinance No. 5761 A4.5.1 An Ordinance of the City Council of the City of Auburn, Washington, creating a new Section 2.03.100 of the Auburn City Code, relating to Duties of the Mayor. Councilmember Poe moved and Councilmember Barber seconded to introduce and adopt Ordinance No. 5761. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions Page 7 City of Auburn Council Meeting Minutes May 19, 2003 Resolution No. 3599 03.4.1.5 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute an agreement between the City of Auburn and W&H Pacific, Inc. for engineering services at the Auburn Municipal Airport. Councilmember Singer moved and Councilmember Brothers seconded to adopt Resolution No. 3599. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 3605 A3.13.9 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and the City Clerk to execute a Payback Agreement Developer's Extension between the City of Auburn and Gaines Construction. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3605. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 3607 03.9 V-03-03 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of an alleyway located north of 803 and 815 East Main Street, within the City of Auburn, Washington. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3607.. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 3608 03.9 V-02-03 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of a portion of D Street NW laying north of 3rd Street NW, within the City of Auburn, Washington. Resolution No. 3609 03.9 V-01-03 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of a portion of 69 public SE located west of Evergreen Way SE, within the City of Auburn, Washington. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3609. MOTION CARRIED UNANIMOUSLY. 6-0. 6. Resolution No. 3610 03.9 V-02-02 A Resolution of the City Council of the City of Auburn, Washington, fixing a time for a public hearing on the petition for vacation of two portions of right-of-way located south of Auburn Way South and south of Poplar Street, within the City of Auburn, Washington. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3610. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Resolution No. 3612 A3.14, 04.2.1 A Resolution of the City Council of the City of Auburn, Washington, fixing 7:30 p.m. on June 2, 2003, as the time and date for a public hearing before the City Council on an Electrical Franchise Agreement with Puget Sound Energy. Councilmember Poe moved and Councilmember Cerino seconded to adopt Resolution No. 3612. MOTION CARRIED UNANIMOUSLY. 6-0. Page 9 City of Auburn Council Meeting Minutes May 19, 2003 8. Resolution No. 3613 01.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement with King County, Washington, and with the cities of King County for mutual aid mobilization. Councilmember Singer moved and Councilmember Brothers seconded to adopt Resolution No. 3613. MOTION CARRIED UNANIMOUSLY. 6-0. 9. Resolution No. 3616 A3.17; 04.4.9.1.3 A Resolution of the City Council of the City of Auburn, Washington, canceling the leases approved by Resolution Numbers 1253 and 1504, for property at the Auburn Airport with Chart -Air, Inc. Councilmember Singer moved and Councilmember Brothers seconded to adopt Resolution No. 3616. MOTION CARRIED UNANIMOUSLY. 6-0. 10. Resolution No. 3617 03.1 ANX03-0001 A Resolution of the City Council of the City of Auburn, Washington, for the annexation of a portion of property to the City of Auburn simultaneously to its deannexation from the City of Pacific, pursuant to RCW 35.10.217(2), and authorizing City staff to file a Notice of Intent to Annex with the Washington State Boundary Review Board for King County. Councilmember Borden moved and Councilmember Singer seconded to adopt Resolution No. 3617. MOTION CARRIED UNANIMOUSLY. 6-0. (Action on this item occurred after Item No. VILA of these minutes.) IX. MAYOR'S REPORT Page 10 City of Auburn Council Meeting Minutes May 19, 2003 Councilmember Barber announced her resignation from the Auburn City Council as of midnight, June 16, 2003. Councilmember Barber expressed her pride in Auburn and her appreciation for the help and friendship of Mayor Lewis, Councilmembers, and staff during her years of service. A. Executive Session Mayor Lewis recessed the meeting to executive session at 8:11 PM for approximately thirty minutes to discuss pending litigation. At 8:32 PM, Mayor Lewis announced that executive session would continue for approximately fifteen more minutes. At 8:40 PM, Mayor Lewis reconvened the regular meeting. Mayor Lewis and Councilmembers discussed various procedures with regard to filling unexpired terms of City Council positions. X.
