Background Summary: Ordinance No. 5764 amends Ordinance No. 5436 by authorizing the Mayor to sign a Local Agency Supplemental Agreement between the City and the Washington State Department of Transportation, approving Federal TEA -21 funds to complete Project No. PR529, SR18 / C Street SW Ramp Modifications / 3`d Street SW Grade Separation. In the 2003 Fiscal Authorization of the Federal Demonstration Funds, an additional $50,156 was given to the 3`d Street Project making the total Demonstration Funding available $3,079,003 which brings the total federal participation in this project to $18,879,003. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. Auburn City Ordinance No. 5436, passed October 2, 2000, is hereby amended to reflect acceptance of $50,156 in federal Demonstration TEA -21 funds and hereby authorizes the Mayor and City Clerk to execute the Local Agency Supplemental Agreement between the City and the Washington State Department of Transportation, a copy of said Supplemental Agreement is attached hereto as Exhibit "A" and is incorporated herein by reference. The Mayor and City Clerk are hereby authorized to approve and execute any future supplemental agreements thereto required for completion of phases of the project, including but not limited to design, right-of- way, and construction and limited to the total amount of $18,879,003. Section 2. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. Effective date.
