This street vacation would allow the Calvary Temple church to build a new sanctuary building on Calvary Temple's property that is presently encroached by proposed City roads/rights-of-way. The Calvary Temple Church will also be able to expand the parking area without encroachments due to set backs and roads. Implication of Denial The Calvary Temple Church will not be able to expand to meet its requirements at its present location. They would then have to look outside of the City limits for a parcel that would meet their expansion needs and requirements. Advertising/Posting: The legal advertising and posting requirements for the proposed vacation have been met. Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79. · MUTCD standards - not affected by this proposal. · City Code or Ordinances - meets requirements of ACC 12.48. · Comprehensive Plan Policy- not affected. · City Zoning Code - not affected (zoned "RR" - "Rural Residential"). Public Benefit: This street vacation decreases the unopened Right-of-way maintenance obligation of the City. The vacated area will be subject to property taxes, except for the portion Calvary Temple Church will be assuming, since they are an exempt non-profit organization. Page 1 of 2 Discussion: The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West Communications. Puget Sound Energy has existing overhead and underground electrical facilities within the proposed vacated area south of Auburn Way South. The vacation application was circulated to City staff. The following comments were received: The City has an existing 6-inch water main in the small piece of triangular right-of-way. The City has concerns with the access to parcels 212105-9037, 212150-9105, 212105-9106 and 212105-9107. These parcels would be land-locked with out a lot line adjustment. Assessed Value: RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised value of the area vacated or, in the event the property or portions thereof were acquired at public expense, compensation may be required in an amount equal to the full appraised value of the area vacated. The City has no record of purchasing this right-of-way. It is the staff's recommendation to not charge the proponent for the right-of-way. Recommendation: Staff recommends that if the street vacation is granted it needs to be subject to the following conditions: 1. Retain a private utility easement for Puget Sound Energy's underground and overhead electrical facilities located in the right-of-way that is south of Auburn Way South. 2. Retain a public utility easement for the Water line located in the right-of-way that is south of Poplar Street SE. 3. Submit a Lot Line Adjustment for parcels number 212105-9037, 212150-9105, 212105-9106 and 212105-9107.
