Portion of 69th Street SE.
Proposal:
Purpose of Street Vacation
To vacate a portion of 69th Street SE laying west of Evergreen Way SE.
The purpose of this street vacation is to allow the installation of a gated community entrance in
conjunction with Polygon's Preliminary Plat application no. PLT02-0001 that was approved at the March
17, 2003 Public Hearing.
Pursuant to Auburn Code section 18.48.140, "The street(s) within a residential subdivision may be
allowed to be gated pursuant to the following: "C. The gated streets are to be privately owned and
maintained...". Therefore, Polygon needs to have this section of street vacated to comply with City
Code and be able to provide a properly designed gated entrance.
This current road is a stub extension of 69th Street SE and will only provide access to the proposed lots
within Polygon's Preliminary Plat. Therefore, this street vacation will not be adversely affecting the flow
of traffic to other parcels or public right-of-way.
Implication of Denial
The ability to provide a gated community would not be possible due to lack of right-of-way near the
gated entrance into the community.
Advertising/Posting:
The legal advertising and posting requirements for the proposed vacation have been met.
Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79.
· MUTCD standards - not affected by this proposal.
· City Code or Ordinances - meets requirements of ACC 12.48.
· Comprehensive Plan Policy- not affected.
· City Zoning Code - not affected (zoned "PUD - Planned Unit Development").
Public Benefit:
· This street vacation decreases the unopened Right-of-way maintenance obligation of the City.
· The vacated area will be subject to property taxes.

Discussion:
The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West
Communications. The following comments were received:
· Comcast has an existing 4" conduit on the shoulder of the right-of-way for future development.
· Puget Sound Energy has an existing 4' gas main and electric facilities within the proposed
vacated area.
The vacation application was circulated to City staff. No comments were received.
Assessed Value:
RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised value of
the area vacated or, in the event the property or portions thereof were acquired at public expense,
compensation may be required in an amount equal to the full appraised value of the area vacated.
The right-of-way was acquired by plat dedication. It is the staff's recommendation to not charge the
proponent for the right-of-way.
Recommendation:
Staff recommends that if the street vacation is granted it needs to be subject to the following conditions: 1. Retain a private utility easement for Puget Sound Energy's gas and electrical facilities.
2. Retain a private utility easement for Comcast's cable facilities.
