Applicant:
West Law Offices (representing: Millennium Investment Group LLC, D Street Investments LLC and
Danner Family Holdings LLC).
Property Location:
Portion of D Street NW (portion laying north of 3~d Street NW)
Proposal:
Purpose of Street Vacation
To vacate a portion of D Street NW, laying north of 3rd Street NW.
The goal of the petitioners is to improve the current access to the affected properties by way of the
development of a new private driveway contemporaneous with the construction of a new building soon
to commence. This street vacation allows the adjacent property owners to proceed with the creation
and build-out of a fully improved private roadway to serve all of the parcels presently having access
rights over the portion to be vacated.
Implication of Denial
The west one-half of D Street will be improved in conjunction with the new building under construction
on Lots 3 and 4, but the east one-half will remain unimproved.
Advertising/Posting:
The legal advertising and posting requirements for the proposed vacation have been met.
Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79.
· MUTCD standards - not affected by this proposal.
· City Code or Ordinances - meets requirements of ACC 12.48.
· Comprehensive Plan Policy- not affected.
· City Zoning Code - not affected (the westside of the street is zoned "C3 - Heavy Commercial"
and the eastside of the street is zoned "M1 - Light Industrial").

Benefit:
This street vacation decreases the unopened Right-of-way maintenance obligation of the City.
The vacated area will be subject to property taxes.
This street vacation would create a completely reconstructed roadway, instead of a half-street
public roadway, which is the functional requirement for access to this development.

Discussion:
The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West
Communications. The following comments were received:
Puget Sound Energy has existing gas and electrical facilities in this right-of-way.
Comcast has an existing overhead cable facility, approximately 270 feet in length,
involving two utility poles along the southeast side of D Street NW.
The vacation application was circulated to City staff. The following comments were received:
· The City has an existing 2" Water line on D Street NW and across a strip along the south
end of Lot 4 to loop through Lot 2 in the future to prevent a possible dead end from
occurring.
· The City has an existing 15" and 18" Sanitary Sewer line on D Street NW.
· The City has an existing 8" and 15" Storm line on D Street NW.
· Maintain access to abutting property owners, including Parcel Number 446340-0136 (Lot
#2).
Assessed Value:
RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised
value of the area vacated or, in the event the property or portions thereof were acquired at
public expense, compensation may be required in an amount equal to the full appraised value of
the area vacated.
The right-of-way was acquired by plat dedication. It is the staff's recommendation to not charge
the proponent for the right-of-way.
Recommendation:
Staff recommends that if the street vacation is granted it needs to be subject to the following
conditions:
1. Retain a joint access easement for all of the abutting property owners along D Street
NW, including Parcel Number 446340-0136 (Lot #2).
2. Retain a private utility easement for Puget Sound Energy's gas and electrical utilities.
3. Retain a private utility easement for Comcast's overhead cable facilities.
4. Retain a public utility easement for the City's water, storm and sewer utilities.
