Portion of an alley located north of 803 and 815 East Main.
Proposal:
Purpose of Street Vacation
To vacate the alley located north of 803 East Main - see "Discussion" item for staff's recommendation
of extending this alley vacation across the north of 815 East Main.
Guarantees the maintenance of the appearance of the property. The applicant has owned and
operated his business at this location for over 14 years. When he first purchased the property it was
overgrown with blackberry bushes and weeds. The applicant cleared and landscaped the proposed
street vacation area and has continued to maintain it professionally.
Implication of Denial
Prevents the disruption of the alley for other use, which may affect the aesthetic appeal of the area.
Advertising/Posting:
The legal advertising and posting requirements for the proposed vacation have been met.
Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79.
· MUTCD standards - not affected by this proposal.
· City Code or Ordinances - meets requirements of ACC 12.48.
· Comprehensive Plan Policy- not affected.
· City Zoning Code - not affected (zoned "RO - Residential Office").
Public Benefit: · This street vacation decreases the unopened Right-of-way maintenance obligation of the City.
· The vacated area will be subject to property taxes.

Discussion:
The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West
Communications.
· Puget Sound Energy has existing electrical overhead and underground facilities in this right-of-
way.
The vacation application was circulated to City staff. The following comments were received:
The City has an existing 8" Sewer line.
Staff recommends expanding the street vacation to include the alleyway located to the north of
815 East Main. The balance of the right-of-way located to the north of 815 East Main provides
more of a private benefit than a public benefit. Subsequently, the street vacation request was
expanded to include the alleyway to the north of 815 East Main.
Assessed Value:
RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised value of
the area vacated or, in the event the property or portions thereof were acquired at public expense,
compensation may be required in an amount equal to the full appraised value of the area vacated.
The right-of-way was acquired by plat dedication. It is the staff's recommendation to not charge the
proponent for the right-of-way.
Recommendation:
Staff recommends that if the street vacation is granted it needs to be subject to the following condition: 1. Retain a private utility easement for Puget Sound Energy's underground and overhead electrical
facilities.
2. Retain a public utility easement for the City's sewer utility.
