CALL TO ORDER
CITY OF AUBURN
COUNCIL MEETING MINUTES
JUNE 16, 2003 7:30 PM
A. Flag Salute
Mayor Peter B. Lewis called the meeting to order at 7:30 PM and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, and Gene
Cerino. Councilmembers Sue Singer and Stacey Brothers were
excused.
Staff members present included: Parks and Recreation Director
Daryl Faber, Public Works Director Dennis Dowdy, City Attorney
Daniel B. Heid, Assistant Police Chief Bob Lee, Human Resources
Director Brenda Heineman, Finance Director Shelley Coleman,
Fire Chief Bob Johnson, Recreation Program Support Coordinator
Sharon LaVigne, Community Development Administrator David
Osaki, Police Commander Will Lathrop, Judge Patrick Burns,
Planner Shirley Aird, and Deputy City Clerk Cathy Richardson.
C. Announcements and Appointments
1. Announcements
a) Hometown Hero Award
Mayor Lewis presented Auburn's Hometown Hero
Award to Jeanne Barber.
Mayor Lewis commended Councilmember Barber for
her many years of service on the Auburn City Council
and for her dedication and commitment to the Auburn
community.

Councilmember Wagner presented Councilmember
Barber with photographs of former City
Councilmembers and a list of major improvements
accomplished in the City of Auburn during her terms
on the Auburn City Council.
Councilmember Barber was accompanied by her
children John Terry, Greg, and Kim, numerous
grandchildren and family members, and many friends
and well-wishers.
b) Proclamation — KidsDay
Mayor Lewis declared June 20, 2003 as "KidsDay" in
the city of Auburn.
Mayor Lewis introduced "KidsDay" Mayor -for -the -Day
Katrina Chevrier, and the following "KidsDay"

(Councilmember Barber was excused at this time.)
Mayor Lewis presented Councilmembers with imprinted
coffee cups and commended Councilmembers for their
outstanding work.
2. Appointments
a)
Sister Cities Committee
City Council to consider the appointment of Katharine
Collins to serve a term to expire April, 2006.
Councilmember Wagner moved and Councilmember
Cerino seconded to approve the appointment to the
Sister Cities Committee.

D. Agenda Modifications
Agenda modifications included a correction to the appointment
term under Item No. I.C.2.a of these minutes, and the addition of a
contract administration item under Item No. V.C.1 of these minutes.
II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
1. Application Number V-02-02

City Council to conduct a public hearing on a petition for
vacation of two portions of right-of-way located south of
Auburn Way South and south of Poplar Street SE.
2. Application Number V-01-03

City Council to conduct a public hearing on a petition for
vacation of a portion of 691h Street SE located west of
Evergreen Way SE.
3. Application Number V-02-03

City Council to conduct a public hearing on a petition for
vacation of a portion of "D" Street NW laying north of 3rd
Street NW.

City Council to conduct a public hearing on a petition for
vacation of a portion of alleyway located north of 803 and
815 East Main.
Director Dowdy displayed aerial photographs of the sites on
the petitions for vacation and gave a brief presentation on
each vacation application.

Mayor Lewis opened the public hearings on Application
Nos. V-02-02, V-01-03, V-02-03, and V-03-03.
Gil Hulsmann, 923 Shaw Road, Puyallup
Mr. Hulsmann distributed aerial photographs and a site plan
for Calvary Temple Church, Application No. V-02-02, and
stated that he represents the Abby Road Group. Mr.
Hulsmann indicated that the Calvary Temple Church agrees
to comply with conditions recommended by City staff. Mr.
Hulsmann spoke in favor of Application No. V-02-02.
Bob West. 332 1s' Street NE. Auburn
Mr. West indicated that he owns property located at the
northeast corner of 3rd and "D" Streets and spoke in favor of
Application No. V-02-03.
Mayor Lewis closed the public hearings.
B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue.
Kate Collins, 414 "B" Place SE, Auburn
Ms. Collins requested clarification with regard to the term of her
appointment to the Sister Cities Committee.
Mayor Lewis clarified that her term expires April, 2006.
Gary Nomensen, 3130 South 38th Street, Tacoma
Mr. Nomensen stated that he represents Puget Sound Energy
(PSE) and introduced PSE representative Mary Ausburn. Mr.
Nomensen related past services provided by PSE and spoke in
favor of the PSE franchise.
Jerry Butts, 32211 104th Avenue SE, Auburn
Mr. Butts expressed his deep appreciation to Mayor Lewis,
Councilmembers, and all City staff members for their support of
himself and his deceased wife, Patty McDonald Butts. Mr. Butts
congratulated Councilmember Barber on her retirement and wished
her well.

Virginia Haugen, 2503 R Street SE
Ms. Haugen congratulated Councilmember Barber on her
retirement and wished her well.
III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Vice Chair Wagner reported that the Municipal Services Committee
met this evening at 5:00. The Committee discussed Ordinance
Nos. 5768 and 5769, and Resolution Nos. 3620 and 3621. The
Committee also received reports on the proposed Public Safety
facility, Puget Sound Access facility, and Comcast cable rates.
The next regular meeting of the Municipal Services Committee is
scheduled for July 7, 2003 at 5:00 PM.
B. Planning & Community Development
Chair Borden reported that the Planning and Community
Development Committee met June 9, 2003 at 5:00. The
Committee discussed annexation issues, code amendments
related to parking in front yards, Comprehensive Plan and Zoning
maps, and the low income Parks and Recreation fee policy. The
next regular meeting of the Planning and Community Development
Committee is scheduled for July 14, 2003 at 5:00 PM.
C. Public Works
Chair Wagner reported that the Public Works Committee met on
June 9, 2003 at 5:30 PM. The Committee discussed right-of-way
use permits, contract administration items, and Ordinance Nos.
5763 and 5766. The Committee also received reports on the Lake
Tapps SEPA appeal, the Multicare Agreement, and 2003 budget
amendments. The next regular meeting of the Public Works
Committee is scheduled for June 23, 2003 at 5:00 PM.
D. Finance
Chair Poe reported that the Finance Committee met this evening at
5:45. The Committee discussed and recommends approval of
claims and payroll vouchers, and Ordinance Nos. 5762 and 5767.
The Committee also discussed funding sources for the proposed
Public Safety facility. The next regular meeting of the Finance
Committee is scheduled for July 7, 2003 at 6:30 PM.

IV. COUNCILMEMBER REPORTS
At this time Councilmembers may report on items not specifically
described on the agenda, which are of interest to the community.
There were no Councilmember reports.

All matters listed on the Consent Agenda are considered by the City
Council to be routine and will be enacted by one motion in the form listed.

Claims check numbers 321450 through 321981 in the
amount of $1,291,929.01 and a wire transfer in the amount
of $522,585.61 and dated June 16, 2003.

Payroll check numbers 504467 to 504689 in the amount of
$622,101.85 and electronic deposit transmissions in the
amount of $871,660.24 for a grand total of $1,493,762.09 for
the pay period covering May 29, 2003 to June 11, 2003.

An Ordinance of the City Council of the City of Auburn,
Washington, amending Ordinance No. 5702, the 2003
Budget Ordinance, as amended by Ordinance 5738 and
authorizing the Mayor to accept Schedule "A" which relates
to the City of Auburn 2003 Budget for additional
appropriations in various funds pursuant to RCW
35A.33.120, and setting forth findings.
Councilmember Poe moved and Councilmember Cerino
seconded to introduce and adopt Ordinance No. 5762.

An Ordinance of the City Council of the City of Auburn,
Washington, amending Auburn City Code Chapter 19.04,
titled "Transportation Impact Fees" authorizing City policy
clarifying several issues related to the transportation impact
fee program, and providing that the transportation impact
fee schedule be added to the City of Auburn Fee Schedule.
Councilmember Wagner moved and Councilmember Poe
seconded to introduce and adopt Ordinance No. 5763.

An Ordinance of the City of Auburn, Washington, amending
Section 3.68.040(H) of the Auburn City Code, regarding the
City's low income fee policy for parks and recreation
programs.

An Ordinance granting Puget Sound Energy, Inc., a
Washington corporation, its successors and assigns, the
right, privilege, authority and franchise to set, erect, lay,
construct, extend, support, attach, connect, maintain, repair,
replace, enlarge, operate and use facilities in, upon, over,
under, along, across and through the franchise area to
provide for the transmission, distribution and sale of electric
energy for power, heat and light, and any other purposes for
which electric energy may be used.
Councilmember Wagner moved and Councilmember Poe
seconded to introduce and adopt Ordinance No. 5766.

Washington, declaring public use and necessity regarding

Washington, initiating the annexation of an unincorporated
island within the corporate limits of the City, which area is
referred to as the "Neer Annexation".
Councilmember Borden moved and Councilmember Cerino
seconded to adopt Resolution No. 3618.

A Resolution of the City Council of the City of Auburn,
Washington, notifying the Washington State Boundary
Review Board for King County of Auburn's intent to concur
in the annexation of a portion of property to the City of
Pacific simultaneously to its deannexation from the City of
Auburn, pursuant to RCW 35.10.217(2).
Councilmember Borden moved and Councilmember Barber
seconded to introduce and adopt Resolution No. 3619.

3. Resolution No. 3620

A Resolution of the City Council of the City of Auburn,
Washington, authorizing the Mayor and City Clerk to
execute a contract between H&W Apparatus Repair, Inc.,
and the City of Auburn for two (2) Road Rescue Type III
Aid/Medic units.
Councilmember Wagner moved and Councilmember Cerino
seconded to adopt Resolution No. 3620.
MOTION CARRIED UNANIMOUSLY. 5-0.
4. Resolution No. 3621

A Resolution of the City Council of the City of Auburn,
Washington, authorizing the Mayor and City Clerk to
execute a contract with King County for basic life support
services for the contract period of January 1, 2003 to
December 31, 2003 and specifying funding totals.
Councilmember Wagner moved and Councilmember Barber
seconded to adopt Resolution No. 3621.
