Background Summary: This year, the City of Auburn is estimating an award of $478,000 in CDBG funds from the Department of Housing and Urban Development (HUD) for capital and public service projects. The application process for CDBG was run during the summer, with the 2004 Action Plan released for public review on September 3, 2003. The City Council must hold a public hearing on the Action Plan during or following the required 30 day public comment period, which ends October 20, 2003. No comments have been received to date. Following the closure of the public comment period, the City Council may act upon the Action Plan, authorize its submission to HUD, and consider an implementing budget ordinance for the CDBG funds. Following approval by the City Council, the Action Plan and listing of proposed projects will be forwarded to HUD for their review and initiation of contracting procedures. Funds will be released to the City sometime during the first quarter of 2004, at which point agencies may begin requesting reimbursement for qualified expenses as of January 1, 2004. Not all of the strategies listed in Auburn's Housing and Community Development Strategy can be accomplished within one year. These strategies are not included in the Annual Plan, nor are other strategies that are strictly policy statements. Policy statements are included in other reports and advocated by City officials as opportunities arise. The remaining strategies are addressed as opportunities present themselves. These strategies are listed in this Annual Plan along with the activities to accomplish or advance them. As developments occur and new or dormant strategies begin, they will be added to the Annual Plan. Since some strategies are long-term or on-going processes, existent activities may be revised or new activities added to the Annual Plan. At the end of the chapter is a description of projects recommended for funding in 2004 by the Auburn Human Services Committee. Housing Provision Priority: Preserve, maintain and improve the existing stock of affordable housing. Strategy 1-1: Housing Repair: The City will seek available assistance for housing rehabilitation. Assistance will include the development of residential infrastructure and the rehabilitation of individual properties. (HO -27) Proposed Annual Accomplishments: provide loansandgrants for mnjer—life/safety housing repair to approximately 50 low income homeowners per year. Strategy 1-3: Education and Referral: Information and resources that educate and guide low- income persons toward affordable housing opportunities will continue to be prepared and made available through the City and through referral by City staff. (HO -22) Proposed Accomplishment: update existing materials about housing and social services resources on a continuing basis, ensure the materials are available at public buildings throughout the City. Participate in intedurisdictional work/planning for affordable housing at the regional and subregional levels. 2. Housing Affordability Priority: Respond to the housing needs of individuals and families that cannot afford or do not choose to live in detached single-family housing. Strategy 2-1: Mixed Commercial/Residential Development: Encourage residential development in Downtown Auburn, particularly housing that is integrated with commercial development. (HO -24) Activity: City will work with private sector to develop mixed-use project downtown, and will assist in funding, where appropriate, the construction of transit -oriented housing within the downtown. 3. Anti -Poverty Strategies Priority: Provide services and facilities that serve low income families and prevent individuals and families from becoming homeless. Strategy 3-1: Special Needs: Encourage and support social and health service organizations that offer programs and facilities for people with special needs, particularly programs that address homelessness and help people to remain within the community. (HO -1) Activity: Provide capital facilities funding to assist the creation of a community center and educational facility at Bumdale Homes. Activity: Provide planning funding for regional coordination effort for domestic violence services, to expand and streamline services including case management, legal advocacy, and emergency shelter for victims of domestic violence. In addition, provide start-up funding for a Victim Response Team in Auburn, which will be available on-call to work with domestic violence cases. * Numbers within the parentheses indicate the Comprehensive Plan policy number. PUBLIC HEARING DRAFT 2004 Action Plan, Page 6 - 2 4 Strategy 3-2: Declining Areas: Special attention will be given to maintaining and improving the quality of public services in declining areas of the city. (HO -2) Proposed Accomplishments: Continue to pursue a neighborhood -based planning program concentrating on lower-income neighborhoods. Continue implementation of Terminal Park Neighborhood Plan. Strategy 3-3: Child Care: The City will encourage the availability and provision of quality childcare by nonprofit agencies to low and moderate income residents. Proposed Annual Accomplishments: Continue to provide general funds to support childcare for at least 100 low and moderate -income children per year. Strategy 3-4: Shelters/Transitional Housing: The City will seek and provide assistance to nonprofit agencies operating emergency shelters and transitional housing for homeless people and other groups with special needs. (HO -3) Proposed Annual Accomplishments: Continue to provide operating and capital funds to leverage other funds and support emergency and transitional shelter for at least 300 individuals per year. Strategy 3-5: Health Care: The City will seek and provide assistance to nonprofit agencies providing health care to Auburn residents with low and moderate incomes. Proposed Annual Accomplishments: Continue to provide operating funds for primary health and dental care for at least 3000 individuals per year. Suitable Living Environment Priority Develop economically integrated, walkable neighborhoods which generate a secure atmosphere for both residents and visitors. Strategy 4-1: Safe Neighborhood Program: Organize, educate and assist property managers in the creation and preservation of safe neighborhoods. (HO -35) Proposed Accomplishments: Increase attendance and usage of Neighborhood Program and expand to at least one additional site in the City. Increase coordination among agencies and secure additional ongoing funding source for maintenance of the program. Use CDBG administrative and financial resources when possible to support program. Also supported through City's neighborhood matching grant program. Strategy 4-2: Neighborhood Planning: The City will work with neighborhood groups to develop neighborhood plans for select areas within the city. These plans will address issues and concerns which include, but are not limited to, land use, projected growth/decline, neighborhood identity, safety, education, youth and recreational activities (HO -31) Proposed Accomplishments: Continue implementation of Terminal Park Neighborhood Plan. Strategy 4-4: Recreational Facility Improvements: Support the creation and programming of a multi -use facility that would serve all age and income groups in the city of Auburn for recreational and social service activities. To the extent that such a facility is PUBLIC HEARING DRAFT 2004 Action Plan, Page 6 - 3 eligible and serves low-income residents, provide CDBG policy and financial support. Proposed Accomplishments: Remove and replace the dilapidated wading pool at Les Gove Park with a spray -water play facility, thus increasing the safety and the water efficiency of the facility. Les Gove Park is located adjacent to a King County Housing Authority site, a daycare with programs for special -needs children, and within a low-income neighborhood. 6. Economic Development Priority: Develop effective land use policies and economic development strategies that provide log -term and stable employment, increase per capita income and reduce the tax burden of Auburn residents. Strategy 6-1: Public/Private Partnerships: The City will support efforts to maintain and expand programs that prepare skilled workers for higher paying jobs. (ED -10) Activity: Continue to provide general fund support for job training. Provide CDBG funding eligible under micro -enterprise assistance to provide education and technical support to small businesses in Auburn which are owned and operated by low-income clients. Housing and Community Development Resources General Funds In addition to general fund appropriations for law enforcement, youth and senior programs; general funds are typically appropriated to the City's Department of Planning and Community Development (DPCD) for housing and community development activities. The City contracts with a number of agencies that provide specific services directly to Auburn residents. The 2004 general fund budget appropriated approximately $362,000 for social services. CDBG Funds The City is entitled to an annual appropriation of Federal CDBG funds. It distributes these funds through a contractual process to local service agencies. The City of Auburn's CDBG budget is currently divided into four program areas: Social Service Procrams includes programs and activities to reduce poverty, alleviate risk factors, prevent homelessness and address the needs of special population groups such as those with developmental disabilities and/or mental illness. Neighborhood Revitalization includes programs and activities to maintain, preserve, and/or increase affordable housing opportunities for low-income households, remove enviromnental factors that deteriorate the quality of life, and alleviate pedestrian hazards along the city's sidewalks and streets. Public Facilities represents capital improvements primarily to maintain and/or expand existing social services to Auburn residents. Public facility improvements are typically appropriations for deferred maintenance, handicap accessibility and various other improvements to buildings owned by local social service agencies. Program Planning and Administration represents the administrative support and management PUBLIC HEARING DRAFT 2004 Action Plan, Page 6 - 4 oversight provided by the City to implement its CDBG program. City of Auburn's Funding Policies In addition to the Consolidated Plan, disbursement of CDBG funds is also guided by the City's 1990 Social Services Plan. This plan established internal operating policies regarding the disbursement of City funds for social service activities. Policy Number #6 states the City of Auburn ought to recognize the following priorities when it considers funding regional and local social services: a. Priority #1: Services and programs related to basic survival. The Plan defines basic survival services and programs as those that address housing, food and medical care. b. Priority #2: Services and programs that promote economic self-sufficiency. The Plan defines self-sufficiency services and programs as those that address employability, family violence, and day care. c. Priority #3: Other critical service needs. The Plan states that other critical service needs include mental health, counseling, drug and alcohol abuse, teen pregnancy, and AIDS. Historically the City's budget appropriations have followed the above policies. Programs and services that address basic survival needs received the largest percentage of total funding. Approximately 50% of past CDBG appropriations funded basic survival needs, approximately 23% of CDBG appropriations funded self-sufficiency programs and 15% funded other services. When the City's general fund is added to the CDBG appropriations, approximately 45% of combined funding went to basic survival needs, 29% for self-sufficiency programs and 21% for other services. Generally, all general fund appropriations are dedicated to operational support. Recommended CDBG Projects for 2004: The following table represents CDBG requests for the 2004 program year. Funding recommendations by the Human Services Committee are based on the assumption that the City will receive $478,000 through the CDBG program for 2004. Once HUD confirms the City's actual CDBG entitlement, the attached budget will be revised. { To Update: The City Council passed a final CDBG budget Ordinance 5698 in October, 2003. In addition, $8,182 of funding from the Administration Budget for 2002 went unused and was reallocated through that ordinance for use in 2004. } Contingency Plan(s) Because the Request for Proposals and application review takes place early in the year, and because many applicants rely on multiple fund sources to complete their projects, it is possible that one or more of the recommended projects will not be able to use CDBG funding during the 2004 program year. It is also possible that the final funding amount from the Department of Housing and Urban Development will differ substantially from the assumed $478,000. In order to avoid delays in spending entitlement funds, the Human Services Committee has set forth the following priorities for funding should one or more projects fail to come to fruition. These contingencies are included in Budget Ordinance {5698). This is in recognition that most agencies in the region will --have experienced funding cuts in--2004but continue to serve increasing, numbers of clients. However, additional funding fer 2004shouldnot be construed to guarantee a base level of funding for subsequent years. Additional or reallocated capital funds up to $25,000 will be allocated to the Housing Repair Program; remaining funding will be made available to Capital projects in 2005. Consolidated Planning The current Consolidated Plan for Housing and Community Development is in effect through December 31, 2004. Throughout 2004 the City will undertake an update of the Consolidated Plan through updating demographic information based on the 2000 Census. This work will also include substantial community involvement to assess community needs and goals. Monitoring Throughout the program year, the City monitors its CDBG program. Monitoring tools to ensure compliance with CDBG regulations and development strategies include the following. Fair Housing Auburn Municipal Code 9.64 prohibits specific instances of discriminatory action in offering or providing housing. It prohibits discriminatory actions by homeowners, real estate agents, and financial organizations. All complaints or allegations of violations of this Code are referred to Auburn's planning director. Violation of this Code is a criminal offense subject to potential fines and imprisonment. The cities of Bellevue and Auburn joined King County to perform an analysis of fair housing impediments within the King County Consortium. The City will continue to monitor compliance to fair housing and respond appropriately to any alleged violations reported in writing to the Planning Director. In 2004, the City will undertake an update of its Fair Housing assessment and analysis, and formulate appropriate responses, within the City's resources, to Fair Housing violations. Policies and Certifications Agencies requesting CDBG funds are asked to respond to general and program specific policies in their application. All projects requesting CDBG funds are evaluated to determine if they are (1) eligible relative to federal guidelines, (2) consistent with the program objectives and strategies, (3) consistent with local, state and federal regulations, and (4) feasible within contract and timeline guidelines. These policies include, among others: • consistency with local codes and policies; • restrictions on the change of use of property and buildings which were acquired or improved through CDBG funds; • minimization of displacement and the provision of relocation assistance; • adherence to federal wage rates; • compliance with federal, state, and local environmental laws and procedures; • compliance with federal audit requirements; and PUBLIC HEARING DRAFT 2004 Action Plan, Page 6 - 7 • adherence and enforcement of the lead-based paint abatement regulations, fair housing laws and affirmative action. Documentation and On-site Monitoring Detailed records are kept and periodically reviewed to determine and assure the agency's compliance with its contract and applicable regulations. Deficiencies in record keeping are pointed out and assistance is offered. Violations of contract requirements and/or applicable rules and regulations are documented and the agency is informed of their noncompliance. Progressive steps are taken, and assistance is offered, to correct the violation or deficiency. Failure to comply must result in the termination of the contract and remedial actions authorized by applicable rules and regulations. Each agency funded through the CDBG program is monitored during January through either an on-site visit or an "at -desk" review of program files, in proaration for the City's submission of the Consolidated Annual Performance and Evaluation Roort. Monitoring letters summarizing any concerns or corrective actions are sent to agencies during the public review period for the CAPER. Fiscal Audits The City conducts an internal audit to make sure that its records are complete and agencies are complying with applicable rules and regulations. In addition, each year the City's records are subject to an independent audit. The auditor tests the City's compliance with the following requirements applicable to the CDBG program: • political activity, • Davis -Bacon and related Acts, • civil rights, • cash management, • federal financial reports, • allowable costs/cost principles, • Drug -Free Workplace Act, and • various administrative requirements.
