hearing. As the attached descriptive memo from Ed Davis indicates, he will be at your
scheduled public hearing on October 6'' to represent the City of Pacific. We have a regular
scheduled city council workshop that evening that will prevent our city council from
attending the hearing. We would appreciate receiving a copy of the October 6t' agenda for
the city council meeting.
We appreciate the willingness of the City of Auburn to carry the ball on the needed final
steps for the de -annexation / annexation process and wish to express our appreciation to
you, the city council and your staff for their extensive efforts in the de-annex/annexation
process.

Subject: THE DE -ANNEXATIONS AND ANNEXATIONS BETWEEN THE CITIES OF
AUBURN AND PACIFIC.
As reflected in the attached letter from the City of Auburn's Mayor Lewis, the state statute is vague in
requirements for de -annexations and annexations (see the second paragraph). Mayor Lewis is
proposing that the City of Auburn take the lead and incur the costs of holding the one required public
hearing (public notice posting, costs of mailing to properly owners, etc.).
When the City of Pacific adopted Resolution Number 527 in May, (copy attached), we were under the
impression that both cities had to conduct a public hearing with notices mailed, site posted, etc. Since
May clarification has been slow in defining the required steps to complete the process.
Section 2 of the adopted Pacific resolution (see page 3), gives the mayor the authority to take the steps
needed to "carry out the directives of this legislation". We will communicate to the City of Auburn that
the City of Pacific agrees with the proposals in Mayor Lewis' letter to complete the de-
annex/annexation process. This will relieve the City of Pacific from having to hold the joint city
council meeting with Auburn at the Ilalko Elementary School.
Since I have been the prime staff contact with the City of Auburn, my attendance at the Auburn public
hearing on October 6u` will be to read into the record the City of Pacific's position on the de -
annexation and annexation as stated in Pacific's Resolution No. 527 and to respond to any questions
that may arise from participants at their public hearing that may directly deal with the City of Pacific.
Will keep you posted on the progress of the final steps to complete the de-annex/annexation.

Dear Mayor Erickson:
I am writing regarding the final adoption and public hearing for the annexation and
deannexation of land between the cities of Auburn and Pacific. The City of Auburn
received a Closing Letter from the Washington State Boundary Review Board for King
County (BRB) in early August, as did the City of Pacific.
According to RCW35.10.217(2), once the BRB has either declined jurisdiction over or
approved an annexation under this statute, one city must hold a hearing on the action
and pass a final resolution (since both cities have already passed resolutions agreeing to
the annexations and deannexation). The statute does not specify whether the city
holding the hearing is the "giver" or the "taker" of the territory in question.
Therefore, if you concur, it is the intent of the City of Auburn to distribute the required
public notice, hold the appropriate public hearing, and pass the final resolution, which
resolution would provide for both the "A" Street SE property (annexing into Auburn) and
the property adjacent to Cool's Cafe (deannexing from Auburn). We will be conducting a
Public Hearing and approve the Resolution at the next City Council meeting scheduled
on October 6, 2003.

RESOLUTION NO. 527
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PACIFIC, WASHINGTON, FOR THE ANNEXATION OF A
PORTION PROPERTY TO THE CITY OF PACIFIC
SIMULTANEOUSLY TO ITS DEANNEXATION FROM THE
CITY OF AUBURN, PURSUANT TO RCW 35.10.217(2)
WHEREAS, RCW 35.10.217(2) authorizes the legislative body of a city or town on
its own initiative by resolution to indicate its desire to be annexed to a city or town in whole
or in part, which annexation shall become effective upon the adoption of a resolution by the
other city or town concurring in the annexation; and
WHEREAS, after consultations between representatives of the cities of Pacific and
Auburn, it was determined that it would be advantageous to both cities for certain territory
currently located within the corporate limits of the City of Auburn and adjacent to the City of
Pacific to be annexed to the City of Pacific; and
WHEREAS, in connection with such annexation/de-annexation, the cities of Pacific
and Auburn have committed to coordinate and cooperate with respect to any planning,
transportation or development issues that affect the cities; and
WHEREAS, contemporaneous with the consideration of this Resolution, the City of
Auburn is considering this annexation/de-annexation action because of the mutual benefits
to both cities and their common infrastructure needs; and
WHEREAS, the annexation shall be effective following adoption of Resolutions by
both cities of Pacific and Auburn in support of the annexation; and
WHEREAS, the requirements of the State Environmental Policy Act and applicable
Environmental Procedures have been complied with.

WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The City Council of the City of Pacific indicates, pursuant to the

WHEREAS, the City Council of the City of Auburn passed its Resolution No. 3617
on May 19, 2003, and Resolution No. 3619 on June 16, 2003, notifying the King County
Boundary Review Board of the City's intent to annex property to the City of Auburn
simultaneously to its de -annexation from the City of Pacific.
WHEREAS, the King County Boundary Review Board has consented to and
approved the annexation and deannexation; and
WHEREAS, a Public Hearing was held on the 6t" day of October, 2003, for which
notice was provided pursuant to the .requirements of RCW 35.10.217(2) and at which
hearing all persons wishing to speak to the annexation and deannexation were heard; and
WHEREAS, the City Council finds that good cause exists for the annexation and
deannexation.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:

this Resolution to the appropriate representative of King County, Washington, and such
other actions as are consistent with the purposes hereof and in accordance with Chapter
35.43 RCW and Section 35.10.217(2) RCW.
