Lewis called the meeting to order at 7:30 PM and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Trish Borden, Fred Poe, Gene Cerino, Stacey Brothers, and Nancy Backus. Councilmember Sue Singer was excused. Staff members present included: Police Chief Jim Kelly, Planning and Community Development Director Paul Krauss, Fire Chief Bob Johnson, Employee Relations and Compensation Manager John Fletcher, Public Works Director Dennis Dowdy, Finance Director Shelley Coleman, Sewer Utility Engineer Jeff Roscoe, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments Announcements There were no announcements. 2. Appointments a) Human Services Committee City Council to confirm the appointment of Jay Ostos to an unexpired term on the Human Services Committee through December 31, 2004. Councilmember Wagner moved and Councilmember Brothers seconded to confirm the appointment of Jay Ostos to the Human Services Committee. A,qenda Modifications Agenda modifications included a correction to Item V.C.2 of these minutes related to the award of Public Works Project Number C203B to Elite Commercial Contracting. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearinqs Local Law Enforcement Block Grant F5.4.1 The City of Auburn's application for funding under the Department of Justice Local Law Enforcement Block Grant Program has been approved in the amount of $35,416.00 for the purpose of reducing crime and improving public safety. The City of Auburn proposes to utilize the grant to pay overtime costs for police officers engaged in community policing activities. Special conditions of the grant award require the City to encourage participation regarding the proposed use of the payment under the Local Law Enforcement Block Grant. Mayor Lewis opened the public hearing. No one in the audience requested to speak. Mayor Lewis closed the public hearing. Audience Participation This is the place on the agenda where the pubfic is invited to speak to the City Council on any issue. Vir,qinia Hau,qen, 2503 "R" Street SE, Auburn, WA Ms. Haugen inquired regarding the proposed improvements to the Auburn Transit Station. commercial Planning and Community Development Director Paul Krauss explained that this is a construction project to undertake the tenant improvements in the retail space at the Auburn Transit Station. Page 2 City of Auburn Council Meetinq Minutes October 207 2003 III. Correspondence No correspondence was received. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Vice Chair Wagner reported the Municipal Services Committee met this evening at 5:00. The Committee discussed contract administration items and Resolution Nos. 3631, 3645, and 3647. Vice Chair Wagner noted that a brief staff report on Resolution No. 3645 will be forthcoming. The next regular meeting of the Municipal Services Committee is scheduled for November 3, 2003 at 5:00 PM. Planninq & Community Development Chair Borden reported that the Planning and Community Development Committee met October 13, 2003 at 5:00 PM. The Committee discussed and recommends approval of contract administration items and Resolution No. 3653. The Committee also discussed Ordinance Nos. 5794 and 5795 and received a report on a proposed increase to school impact fees from Auburn School District representative Mike Newman and Master Builders Association representative Garrett Huffman. The next regular meeting of the Planning and Community Development Committee is scheduled for October 27, 2003 at 5:00 PM. Public Works Chair Wagner reported that the Public Works Committee met October 13, 2003 at 5:30 PM. The Committee reviewed Resolution Nos. 3645 and 3644. Chair Wagner commended the Public Works Department for their work on the many agreements related to Resolution No. 3644. The Committee discussed the findings of needs assessment for the Transportation Comprehensive Plan and the related upcoming open house. Chair Wagner extended an invitation to Councilmembers to attend the open house which will be held on October 23, 2003 from 6:00 to 9:00 PM at Washington Elementary School. The Committee also discussed the proposed Lyden Traffic Impact Fee Credit Agreement on the "A" Street NW corridor, the IA2 Partnership related to water, and utility service to the Kent watershed. The next regular meeting of the Public Works Committee is scheduled for October 27, 2003 at 5:30 PM. Page 3 City of Auburn Council Meetinq Minutes October 207 2003 IV. Finance Chair Poe reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers and Ordinance No. 5788. The Committee received a 2003 third quarter financial report and discussed a proposed increase on school impact fees. Auburn School District representatives were present. Members requested recommendations from the Planning and Community Development and Municipal Services Committees related to increasing school impact fees. The next regular meeting of the Finance Committee is scheduled for November 3, 2003 at 6:30 PM. COUNClLMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. (Councilmembers and Mayor Lewis reported prior to Item I/LA of these minutes.) Councilmember Cerino reported that, on behalf of Mayor Lewis, he presented a Proclamation to the Aamerican College of Karate which was attempting to break the national record for the number of kicks executed in an hour. Councilmember Cerino reported that he attended a recent Puget Sound Regional Council meeting regarding issues related to buildable lands in Pierce County and the Growth Management Act, specifically related to large developments. Councilmember Backus reported that she attended a recent International Association of Machinists and Aerospace Workers rally at which Attorney General Christine Gregoire, other dignitaries, and over 1,000 union representatives were present. The rally was to encourage Boeing production of the 7E7 airplane in the State of Washington. Mayor Lewis reported that he recently attended a conference in Vancouver, British Columbia, on Economic Development for the Puget Sound Region. It was determined that one hundred seventy-one separate taxing districts exist within Kitsap, Pierce, King and Snohomish counties. Regional efforts will be made over the next few years to reduce the number of taxing districts. King County Executive Ron Sims spoke regarding the urgent need to move forward with transportation projects. Executive Sims also spoke at the Greater Auburn Area Chamber of Page 4 City of Auburn Council Meetinq Minutes October 207 2003 Commerce luncheon today regarding the Regional Transportation District and suggested transferring $300 million from funds slated for State Route 167 improvements to Sound Transit. Any changes would have to be approved by the Legislature. C. Contract Administration Parks & Recreation Department Project O5.1.2 City Council accept Equipment Bid from Northwest Playground Equipment, Inc. in the amount of $50,960.00, including Washington State sales tax, for Terminal Park improvements. Public Works Proiect Number C203B O3.3.11 PR C203B City Council award Contract 03-12, Project Number C203B, Auburn Station Commercial Improvements, Phase II, Elite Commercial Contracting on their Iow bid of $157,537.00 plus Washington State sales tax of $13,863.26 for a total contract price of $171,400.26. Planninq & Community Development Department Project Number C220A O4.4.1 PR C220A City Council approve Final Pay Estimate No. 8 to Contract 02-20 with Elite Commercial Contracting and accept construction of Project No. C220A, City Hall Remodel and Remodel of Vacant Senior Center. D. Call for Public Hearinq 2004 Budqet A3.18 City Council to call for a public hearing to be held on November 3, 2003 to receive public comment on the 2004 Budget. Councilmember Wagner moved and Councilmember Cerino seconded to approve the consent agenda. MOTION CARRIED UNANIMOUSLY. 6-0. (Item V.C. 1 Agenda Bill contains a scrivener's error as follows: The budget impact indicates a cost of $59,950.00. The administrative recommendation states a cost of $50,960.00. The supporting documentation reflects a cost of $59,950.00 and was approved by the Planning and Community Development Committee on October 13, 2003. Page 7 City of Auburn Council Meetinq Minutes October 207 2003 Ordinance No. 5794 cuP03-0006 An Ordinance of the City of Auburn, King County, Washington, providing for a Conditional Use Permit to allow church activities in the R-2, Single Family Residential Zoning District located at 1202 28th Street SE, within the City of Auburn, Washington Councilmember Borden moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5794. MOTION CARRIED UNANIMOUSLY. 6-0. Ordinance No. 5795 o3.4.1.7 An Ordinance of the City of Auburn, Washington, to appropriate a total amount of Four Hundred Seventy-eight Thousand Dollars ($478,000) for the 2004 program year; and to authorize the Mayor to implement the approved programs and projects Councilmember Borden moved and Councilmember Brothers seconded to introduce and adopt Ordinance No. 5795. MOTION CARRIED UNANIMOUSLY. 6-0. Resolutions Resolution No. 3631 A3.16.5, O4.4.10 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Agreement between the City of Auburn and American Funeral and Cemetery Trust Services for the purpose of administering and managing client funds paid to the City pursuant to pre-arrangement sales contracts for collective investment in a master trust Councilmember Wagner moved and Councilmember Brothers seconded to adopt Resolution No. 3631. Resolution No. 3644 o3.1 ANX03-0001 A Resolution of the City Council of the City of Auburn, Washington, relating to the annexation of a portion of property to the City of Auburn simultaneously to its deannexation from the City of Pacific, pursuant to RCW 35.10.217(2) Councilmember Wagner moved and Councilmember Poe seconded to adopt Resolution No. 3644. Councilmember Wagner commended Assistant City Engineer/Utilities Duane Huskey for his work related to Resolution No. 3644. MOTION CARRIED UNANIMOUSLY. 6-0. Resolution No. 3645 o4.9.1 PR 562, A1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to execute an Interagency Agreement between the City and King County and appropriate documents relating to the South 277th Street Reconstruction Project, Phase III Councilmember Wagner moved and Councilmember Brothers seconded to adopt Resolution No. 3645. Sewer Utility Engineer Jeff Roscoe distributed copies of secondary agreements and a site map related to Resolution No. 3645. Mr. Roscoe explained that the Interagency Agreement attached to Resolution No. 3645 is in relationship to the City of Auburn construction of a project in conjunction th with King County on the reconstruction of South 277 Street. The secondary agreements relate to acquisition from the City of Auburn by King County of property known as Goedecke North for wetland mitigation and dedicated open space requirements of the Interagency Agreement. F5.4.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Auburn City Council to accept a Local Law Enforcement Block Grant on behalf of the City of Auburn, Washington Councilmember Wagner moved and Councilmember Brothers seconded to adopt Resolution No. 3647. MOTION CARRIED UNANIMOUSLY. 6-0. Resolution No. 3653 A1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute Interlocal Agreement King County and the City of Auburn regarding administering funds generated as a result of State of Washington SHB 2060 Councilmember Borden moved and Councilmember Brothers seconded to adopt Resolution No. 3653. MOTION CARRIED UNANIMOUSLY. 6-0. MAYOR'S REPORT Executive Session Mayor Lewis recessed the meeting to executive session at 7:53 PM for approximately fifteen minutes to discuss real estate acquisition. Mayor Lewis reconvened the regular meeting at 8:12 PM. ADJOURNMENT There being no further business to come before the Council, the meeting adjourned at 8:12 PM.
