NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION ONE. AMENDMENT TO CITY CODE. Aubum City Code is amended to read as follows: That Section 19.02.120 of the 19.02.120 Impact fee calculation and schedule for the Auburn School District. The impact fee calculation and schedule is based upon the impact fee calculation for single-family residences and for multifamily residences set forth in the Auburn School District's Capital Facilities Plan, dated Jaly-l-ggSMay 2003. The calculation is the determination of the appropriate proportionate share of the costs of public school capital facilities needed to serve new growth and development to be funded by school impact fees based on the factors defined in ACC 19.02.020. A. Ordinance No. 5793 Page 1 of 3 November 7, 2003 followinq: i. or Effective January 1, 2005, the school impact fee shall be the lesser of the Per Sin,qle Family Dwelling Unit $ ,ooo.oo Per Multifamily Dwelling Unit $1,200.00 ii. Should the net fee obligation identified in the most recent Capital Facilitie,~ Plan adopted by the Auburn School District be less than amounts listed in Section B. i. above, then the fee obligation shall be in accordance with the net fee obligation identified in said plan and adopted by reference as part of the capital facilities element of the City of Auburn's Comprehensive Plan. C. Beginning, January 1, 2006, and for every January 1 thereafter the school impact fee shall be in accordance with the net fee obligation identified in the most recent Capital Facilities Plan adopted by the Auburn School District and adopted by reference as part of the capital facilities element of City of Auburn's comprehensive plan. (Ord. 5232 § 1, 1999.) SECTION TWO. GENERAL SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid, the remainder of such code, ordinance or regulation or the application thereof to other person or circumstances shall not be affected. SECTION THREE. IMPLEMENTATION. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION FOUR. EFFECTIVE DATE. This Ordinance shall be in full force and effect five (5) days after publication of the Ordinance Summary, and on January 1, 2004, except as otherwise stated.
