Back,qround Summary The proposed Ordinance (Ordinance Number 5806) amends Section 2.51.020 of the City Code which provides for compensation for Councilmembers. The specific changes, however, address the compensation level for the Mayor Pro Tern, a position selected biennially to coincide with the commencement of the new City Council (January 1 of the year following Municipal Elections). The change in compensation for the Mayor Pro Tern reflects an increase from $850.00 per month to $1200.00 per month. This corresponds to the increased duties and utilization imposed upon this position, in addressing City meeting needs and representative responsibilities. The Ordinance also makes some slight language changes to the Code Section so as to clarify its terms (identifying more precisely when a Councilmember or the Mayor Pro Tem would be "eligible" to receive the increased compensation - those elected after certain dates). [] Other Reviewed by Departments & Divisions: [] Building [] M&O [] Cemetery [] Mayor [] Finance [] Parks [] Fire [] Planning [] Legal [] Police [] PublicWorks [] Human Resources Action: Committee Approval: []Yes []No Council Approvah i'-~Yes E]No Call for Public Hearing Referred to Until / / Tabled Until / / / / Councilmember: Poe Staff: Held Meeting Date: December 15, 2003 Item Number: VIII.A.1 AUBURN · MORE THAN YOU IMAGINED ORDINANCE NO. 5 8 0 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 2.51.020 OF THE AUBURN CITY CODE ENTITLED "COUNCILMEMBER'S COMPENSATION" RELATING TO THE COMPENSATION OF THE MAYOR PRO TEM WHEREAS, the current provisions of the Auburn City Code include a section that identifies the compensation level for members of the City Council and the Mayor Pro Tem (ACC 2.51.020); and, WHEREAS, State law (statutes and the State Constitution) restrict how and when compensation for elected public officials may be increased, whereby councilmembers may not receive increases in their compensation approved during the same term that the increase is provided; and, WHEREAS, although the term of city councilmembers is a four-year term, in the case of the Mayor Pro Tem for the City of Auburn, the term is a two-year term, with the Mayor Pro Tem being selected among the current city councilmembers at the first meeting in January of the year following municipal elections (the new City Council); and, WHEREAS, it is therefore appropriate, should the City Council wish to do so, to increase the compensation for the Mayor Pro Tem before that two-year term commences (before January 1,2004) to be effective on January 1, 2004. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section '1. Section 2.51.020, entitled "Councilmember's compensation," is amended to read as follows: 2.51.020 Council-member's compensation. A. The compensation provided for in this section shall be paid on the eighth and twenty-third day of each month succeedihg the month in which services are performed, by proper warrants drawn upon the finance director of the city. Should the pay day fall on the weekend or holiday, paychecks will be issued on the previous workday. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section3. SEVERABILITY. If any provision of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected. Section 4. EFFECTIVE DATE. This ordinance shall take effect and be in force five (5) days from and after its passage and publication as required by law, and on January 1,2004.
