Background Summary: The City entered into an agreement with Central Puget Sound Regional Transit Authority (Sound Transit) on June 27, 2003 to lease 180 parking stalls and have exclusive use of those stalls over a period of 99 years or, if applicable, such earlier time as the end of the useful life of the Parking Garage. The intent of the City, when entering into the agreement with Sound Transit, was to promote development around the station that would otherwise be limited due to lack of available parking in the area. The additional parking was going to be made available to developers through LID agreements that would support the parking need of the project. The formation of Local Improvement District 250 is for parking improvements at the Sound Transit parking garage that would benefit certain properties. The proposed district encompasses two parcels of property owned by one individual. The benefit to the property is the exclusive use of 85 of the 180 parking stalls in the parking improvement and a portion of the cost of the improvement should be borne by the proposed district. [] Other [] Legal [] Police [] Public Works Action: Committee Approval: []Yes []No Council Approval: []Yes []No Call for Public Hearing / / Referred to Until / /__ Tabled Until __/ / Councilmember: Backus Staff: Coleman Meeting Date: January 5, 2004 Item Number: II.A.1 AUBURN, MORE THAN YOU IMAGINED RESOLUTION NO. 3672 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF PUBLIC PARKING FACILITIES AND TO CREATE LOCAL IMPROVEMENT DISTRICT NO. 250 TO ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BE HELD ON JANUARY 5, 2004 BE IT RESOLVED BY THE CITY COUNCIL OF WASHINGTON, as follows: Section 1. It is the intention of the City Council THE CITY OF AUBURN, of the City of AUBURN, Washington, to order the improvement of the properties within the area described in Exhibit A, attached hereto and by this reference made a part hereof, by the development of certain public parking improvements ("improvements") in downtown Auburn. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City and may be modified by the City as long as that modification does not affect the purpose of the improvements. Section 2. The total estimated cost and expense of the improvements is declared to be $1,477,080 and approximately $702,525 of that cost and expense shall be borne by and assessed against the property specially benefited by the improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvements. Actual Resolution No. 3672 December 11, 2003 Page 1 of 4 assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the improvements add to the property. Section 3. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land or other property within the proposed local improvement district by mailing such notice at least fifteen days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the rolls of the King County Assessor at the address shown thereon, as required by law. This resolution also shall be published in its entirety in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least 15 days prior to the date fixed for the public hearing. Section 4. All persons who may desire to object to the improvements are notified to appear and present those objections at a hearing before the City Council to be held in the Council Chambers in the City Hall in Auburn, Washington, at 7:30 p.m. on January 5, 2004, which time and place are fixed for hearing all matters relating to the improvements and all objections thereto and for determining the method of payment for the improvements. All persons who may desire to object thereto should appear and present their objections at that hearing. Any person who may desire to file a written protest with the City Council may do so within 30 days after the date of passage of the ordinance ordering the improvements in the event the local improvement district is formed. The written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and that protest should be delivered to the City Clerk. The Finance Director is directed to submit to the City Council on or prior to December 31, 2003, all data and information required by law to be submitted. The City entered into an agreement with Central Puget Sound Regional Transit Authority (Sound Transit) on June 27, 2002 to lease 180 parking stalls and have exclusive use of those stalls over a period of 99 years or, if applicable, such earlier time as the end of the useful life of the Parking Garage. The total estimated cost and expense of the improvement for the 180 stalls in the parking garage is $1,477,080 (see Exhibit "A"). The City is paying Sound Transit for the improvements with annual installments over a three-year period. The first two installment payments have been made and the third and final payment is budgeted and will be paid in July 2004. The City has called for a public hearing on January 5, 2004, via Resolution 3672 to form LID 250, where parking improvements at the Sound Transit parking garage benefit certain properties. The proposed district encompasses two parcels of property (see Exhibit "B") owned by one individual. The benefit to the property is the exclusive use of 85 of the 180 parking stalls in the parking improvement and a portion of the cost of the improvement should be borne by the proposed district.
