City Council introduce and adopt Ordinance No. 5819.
Backqround Summary:
In 2002, the City Council adopted Ordinance No. 5707, providing for the City's fee schedule and
authorizing amendments to it through Resolution. At the time, the City had in its city code w~rious
sections identifying different fees and charges for certain actions within its municipal function. The
replacement of code sections with a specific and identifiable City of Auburn Fee Schedule provides an
easier user-friendly resoume, but also saves the expense and inconvenience by those using the fee
schedule.
In the course of reviewing fees, and in keeping with the philosophy of setting fees in amounts reflective of
actual costs, it is appropriate to revise and amend the fees and charges for City permits, actions and
facility extensions. Additionally, in keeping with the approach initiated with the implementation of the Fee
Schedule, Ordinance No. 5819 amends various sections of the City Code, deleting fees that are then
inserted in the fee schedule.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON, AMENDING SECTIONS
13.06.511, 13.20.440, 13.40.050, 13.41.030, 13.48.330,
13.48.340, 13.48.420, 15.56.020 AND 15.56.030 OF THE
CITY CODE RELATING TO FEES AND CHARGES, AND
AMENDING THE CITY OF AUBURN FEE SCHEDULE
WHEREAS, the City of Auburn is engaged in various municipal flJnctions, and
the City provides various public services, a number of which entail fees; an,.d
WHEREAS, in order to provide for such fees, the City Council adopted its
Ordinance No. 5707, providing for the initial fee schedule and authorizing amendments
to it through Resolution; and
WHEREAS, the City of Auburn Fee Schedule was thereafter amended by
Ordinance Numbers 5715, 5763 an 5791; and
WHEREAS, in the course of reviewing City fees, and in keeping with the
philosophy of setting fees in amounts reflective of actual costs, it is appropriate to revise
and amend the fees and charges for City permits and actions and facility extensions.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. AMENDMENT TO CITY CODE.
That Section 13.06.511 of the Auburn City Code, relating to Water Utility Service
Charges and Fees, is amended to read as follows:

C. Damage to City Appurtenances. Damage to city appurtenances will be billed
to the account at actual cost to repair or replace, including labor, material,
administrative, overhead and other associated cost.
The finance director is authorized to waive enforcement of the above fees, fines,

Section 2 AMENDMENT TO CITY CODE.
That Section 13.20.440 of the Auburn City Code, relating to Sewer Utility Service
Charges and Fees, is amended to read as follows:
13.20.440 Fees and charges.
A. Sewer Rates. The monthly sewer charge to city of Auburn sanitary sewer
customers consists of two separate fees. Auburn sanitary sewer utility imposes a
charge to maintain, expand and operate the utility's sewer conveyance facilities, and
King County imposes a separate fee for the service King County provides. No charge
shall be imposed by the city on the amount charged by King County, which amount the
city shall pass directly onto the customer as the cost of the service that King County is
providing.
Effective January 1, 2000, the monthly sewer rates for Auburn residents will be
as follows:

The rates beginning the first full billing cycle after January 1, 2003, reflect a 50
percent surcharge for single-family and nonsingle-family residential rates, outside city
limits.
Nonsingle-family accounts will be allowed to average winter water consumption
for the billing dates falling between December through May to determine the summer
sewer rates for the billing dates falling between July and October. Said allowance shall
be upon application and with appropriate justification that additional summer usage
does not enter the sewer system. The months of November through June shall be billed
per water used, at the rates noted above.
Nonsingle-family accounts without city water service shall be charged at the rate
as noted above for inside-the-city or outside-the-city non-single-family cu,~;tomers. The
customer shall have installed an approved city water meter or other acceptable means
of recording water use, by applying for a permit under ACC 13.04.110, which shall be
read by the water department to determine sewage charges on nonsingle-family pdvate
water systems.
B. Permit Fees. Permits for side sewer repair, replacement, inspection, or
tapping side sewers will require a nonrefundable deposit of $SO.O0in the amount set
forth in the City Fee Schedule. The deposit shall be paid to the director of finance at the
time an application is filed. The permit application shall be reviewed and a permit fee
shall be estimated based upon the required materials, staff time and current labor rates
effective in accordance with Chapter 3.18 ACC, Reimbursable Labor Rates. The
estimated permit fee shall be credited with the deposit and the remaining fee shall be

paid to the director of finance prior to issuing the permit. The city engineer shall review

Section 3. AMENDMENT TO CITY CODE.
That Section 13.40.050 of the Auburn City Code, relating to Utility Extension
Fees, is amended to read as follows:
13.40.050 Fees.
The fees for public facility extensions, and for any private streets and private
street draina,qe associated with Planned Unit Developments or Gated Communities,
shall be included among the Facility Extension Fees as established in the City of

Section 4. AMENDMENT TO CITY CODE.
That Section 13.41.030 of the Auburn City Code, relating to Utility System
Development Fees, is amended to read as follows:
13.41.030 Utility systems development charge imposed - Rates - Review.
A. A sanitary sewer and water utility systems development charge is imposed
upon all lands inside the boundary of the city, and all lands outside the boundary of the
city which utilize either sanitary sewer facilities or water facilities or both of the city, and
a storm drainage utility systems development charge is imposed upon all lands in the
city, except those lands exempted under this chapter, which fees and char.qes shall be
as set forth on the City of Auburn Fee Schedule.

B. The utility systems development charge as set forth in the City Fee Schedule
will be computed to consider the future and/or current value of the utility system's fixed
assets, excluding contributions by developers, and outstanding bonded indebtedness,
and will also consider an appropriate service unit.

C. The utility systems development charge imposed shaft be reviewed annually
by the city council end the charge shall be revised to reflect changes irt utility asset
value, depreciation of the utility system fixed assets, bonded indebtedness, and the

A. A storm drainage system inspection and connection permit fee shall cover the
inspection costs of the system to be connected and the permit to connect to a public
storm drainage system.

Section 7. AMENDMENT TO CITY CODE.
That Section 13.48.420 of the Auburn City Code, relating to Storm Water Utility
System Fees, is amended to read as follows:
13.48.420 Flood hazard areas - Flood control zone permits.
The public works department is authorized and directed to monitor and control all
new development within flood hazard areas in conformance with the requirements of
Chapter 15.68 ACC· A permit application shall be required for all such development
within this area. The public works department shall either issue or deny such permit
upon review of the application and shall have the authority to require all reasonable
mitigating measures deemed necessary due to the development. The cost for the flood

Section 8. AMENDMENT TO CITY CODE.
That Section 15.56.020 of the Auburn City Code, relating to Ala, rm Fees, is
amended to read as follows
15.56.020 Alarm users registration required.
A. Beginning January 1, 2000, no person shall operate or use an alarm system
on any 'premises within the city of Auburn, under that person's control, without first
having obtained from the police department, a separate registration for each premises
protected by an alarm system.

B. The police department may not respond to any alarm system for which a
registration has not first been obtained.
C. For the purposes of this section, a person shall be deemed to be an operator
or user of an alarm system if:
1. The person controls both the alarm system and the premises upon which it is
installed; or
2. The person controls the premises and is the subscriber, client or' tenant of the
system subscriber; or
3. The person is the system subscriber or alarm user.
D. All persons required to obtain a registration must complete a registration
application form that is provided by the police department. Information required to be
provided on the registration application form includes, but is not limited to:
1 Subscriber's and/or alarm user's name, address and telephone number(s);
2. Names and telephone numbers of three additional persons who will respond in
the event of alarm activation in the absence of the alarm user and said persons will
provide access to premises and be able to deactivate alarm, or said persons will provide
information on who to contact for access;
3. The name(s) of the alarm installation business and alarm monitoring business
responsible for regular maintenance and monitoring;
4. The information required in subsection (D)(3) of this section shall not apply to
alarms which are installed by the homeowner/tenant;
5. The information required in subsection (D)(3) of this section shall not apply to:
(a) existing alarms; or (b) alarms which are installed in multiple-tenant buildings.
E. Failure to complete the required information will result in automatic denial of
the registration.
F. Each registration shall be given a number which shall not be transferable.
G. Completed applications for an alarm user's registration and a fee as set forth
in .~.CC ~.5.5_~.030 th,e City of Auburn Fee Schedule shall be filed with the police
department, except that no fee shall be charged for alarms installed prior 11o enactment
of this chapter if a registration application for such existing alarm system is filed within
prior to January, 2000.
H. A penalty fee as set forth in the fee resolution will be charged, in addition to
the fee provided in subsection G of this section, to a user who fails to obtain a
registration within 30 days after the system becomes operative, or to a current user who
fails to obtain a registration.
I. Registration fees shall be payable to the city of Auburn and deposited into the
city's general fund.
J. Any person who owns, operates, or possesses any alarm system within the
city of Auburn, which does not conform to the requirements of this chapter, shall
disconnect that alarm and render it inoperable or alter it in accordance with this chapter
no later than 60 days after enactment of this chapter.

K. The following shall be required to obtain a registration under this article, but
shall not be required to pay any fee:
1. Businesses which are nonprofit organizations, including but ~not limited to
religious, civic, charitable, benevolent, nonprofit, cultural, governmental or youth
organizations.
L. Alarm user shall notify police department, within 10 days, of any change of
information from that contained on the registration application. (Ord. 5224 § 1, 1999.)
Section g. AMENDMENT TO CITY CODE.
That Section 15.56.030 of the Auburn City Code, relating to Alarm Fees, is
amended to read as follows:
15.56.030 Fees.
A. Fees will be assessed by the city as follows:

B. The city shall notify the alarm user upon their first false alarm, within any
calendar year. If payment of the registration fee, late registration fee penalty or the
appeal hearing cancellation fee is not received within 30 days of the day the notice of a
late fee is mailed, the city may initiate the enforcement of penalties and/or begin the
collection process. The city shall inform the alarm user of the right to appeal the validity
of the false alarm determination, as provided in ACC 15.56.080. (Ord. 57'16 § 2, 2002,

Section 10. AMENDMENT TO CITY FEE SCHEDULE.
That the City of Auburn Fee Schedule is amended as set forth in the schedule
attached hereto, marked as Exhibit "A" and incorporated herein by this reference.
Section 11. GENERAL SEVERABILITY.
That if any provision of this Ordinance or the application thereof to any person or
circumstance is held to be invalid, the remainder of such code, ordinance or regulation
or the application thereof to other person or circumstances shall not be affected.

The Mayor is hereby authorized to implement such administrative procedures as
may be necessary to carry out the directives of this legislation.
Section 13. EFFECTIVE DATE.
That this Ordinance shall be in full force and effect five (5) days after' publication

A surcharge of $3.00 per month is charged in addition to the base monllhly rental fees
provided in this section for all tiedown, hangar and storage rental fees to be used for the
provision of increased secudty at the Auburn Municipal Airport (approved by Ordinance
No. 5500 on January 16, 2001).
The above leases are subject to applicable leasehold taxes, which shall be paid by the
tenant. The total charge is reflected in monthly billing rates. Tenants shall be given
notice as required by Ordinance or lease agreements. The Airport Lease rates shall be
effective January 1, 2003.
Automatic gate electronic cards.
One automatic gate electronic card will be issued to each tenant free of charge.
Any additional electronic cards requested by a tenant are subject to a $25.00
refundable deposit charge. A $25.00 replacement fee will be assessed against
the tenant for all lost or damaged electronic cards. All electronic cards must be
returned to the airport at the time of lease expiration.
