[] Other Reviewed by Departments & Divisions: [] Building [] M&O [] Cemetery [] Mayor [] Finance [] Parka [] Fire [] Planning [] Legal [] Police [] Public Works [] Human Resources Action: Committee Approval: r-lYes r-INo Council Approval: r~Yes I-INo Call for Public Hearing Referred to Until / / Tabled Until / / / / Councilmember: Singer Staff: Krauss Meeting Date: January 20, 2004 Item Number: Item VIII.A.2 AUBURN, MORE THAN YOU IMAGINED ORDINANCE NO. $ 8 2 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, EXTINGUISHING AND TERMINATING THE CONDITIONAL USE PERMIT PROVIDED FOR IN ORDINANCE NUMBERS 4535 AND 4693 WHEREAS, pursuant to CUP 0007-91, dated October 7, 1991, the then owners of the real property located at 340 East Main Street, within the City of Auburn, applied for a conditional use permit to allow forty to seventy mechanical amusement devices as a part of a family oriented sports theme entertainment facility known as the Auburn Family Sports Center; and, WHEREAS, the ownership of the property in question has been conveyed, and the new owners wish to utilize the property for other purposes, so that the conditional use permit is no longer needed nor desired; and, WHEREAS, it is, therefore, appropriate that the conditional use permit granted pursuant'to Ordinance numbers 4535 and 4693 be extinguished and terminated. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF" AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. That the conditional use permit allowing between forty and seventy amusement devices as a part of the family oriented sports theme entertainment facility known as Auburn Family Sports Center, located at 340 East Main, Auburn, Washington, legally described as follows: Ordinance No. 5820 Page 1 of 3 January 9, 2004 27, 28, and 29: lots 30 except the west 17.73 feet of alley; the east 182.27 feet of lots 32, 33, 34 and 35, all in river view addition to Auburn per the plat recorded in volume 9 of plats, page 90 records of King County Washington is extinguished and terminated, and any requirements therefor are of no future fine or effect. Section 2. That the City Clerk shall cause this Ordinance to be recorded with the office of the King County Recorder. Section 3. That the Mayor is authorized to implement such other administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid, the remainder of such code, ordinance or regulation or the application thereof to other person or circumstance ,,shall not be affected.
