circulation of a 60% petition for annexation.
Background Summary:
The City of Auburn has received a request from Evergreen Tucci (as Lakeland East, LLC) to start the
annexation process on several parcels of Pierce County property that is located east/southeast of the
Lakeland Hills South development. The entire area within the USA contains 63 separate parcels and
about 273 acres, and is partially bounded on the west by an area recently annexed to the City (Thuline
property).
Evergreen Tucci owns 9 parcels totaling approximately 26.5 acres and valued at approximately
$1,353,600. (See the attached map with parcel ownership.) As can be noted from the ownership patterns
on the attached map, annexing only the parcels owned by this corporation would result in an unwieldy city
boundary, and would perhaps require two separate annexation actions.
Planning and Community Development has reviewed the proposed annexation and has forwarded the
attached map for action. The strategy to annex the entire area has been discussed with representatives
from Evergreen Tucci, as well as with other developers in the area.
Upon annexation, much of the area would be zoned R1, which would be referenced on the general
petition for annexation. The properties owned by Evergreen Tucci and Polygon Northwest would be
zoned according to the Lakeland Hills South Planned Unit Development.

If the City wishes to go forward with the annexation, the Council would then need to authorize the
circulation of a general annexation petition. This general annexation petition would be a 60% annexation
petition.
The 60% petition must receive signatures from the owners representing 60% of the assessed valuation of
the property in the entire area. Assessed valuation is approximately $5,868,900. A successful petition
would require the signatures of all the developer -owned property in the area plus an estimated 2-3 private
homeowners.
A soon as adequate signatures have been received and confirmed by the Pierce County Assessor's
Office, the City Council will then hold a public hearing on the annexation. It would then be forwarded to
the Pierce County Boundary Review Board for its review. Following a 45 -day review period, if the BRB's
jurisdiction is not invoked, the City Council may act on the annexation and incorporate the referenced
properties into the City of Auburn.

NOTICE OF INTENTION TO COMMENCE ANNEXATION PROCEEDINGS
In accordance with and Chapter 35A.14.120-.150 RCW, we, the undersigned, who are the owners of property valued at not
less than ten percent (10%) of the assessed valuation of all the property proposed for annexation, wish to inform the
Honorable Mayor and Auburn City Council that we intend to commence the procedures for annexation to the City of
Auburn. By signing this petition, we legally acknowledge that: 1) we will be assessed for City services; 2) we may be
assessed for the City's existing bonded indebtedness including all outstanding bonds, levies, and loans; 3) we will be
regulated in compliance with the Auburn City Code; and 4) we may be responsible for infrastructure improvements within
the proposed annexation area as a condition of annexation to or development within the City of Auburn.
We understand that the decision of the council whether to "accept' the proposed annexation request (Notice of Intention) is
entirely within the council's discretion. By accepting a proposed annexation request (Notice of Intention), the council is not
committing itself to ultimately annexing the territory proposed when a sufficient petition is presented to it. The decision to
accept the Notice of Intention merely allows the annexation to go forward procedurally. If the council rejects the Notice of
Intention, the initiating parties have no right to appeal.
