BACKGROUND The proposal is for water and sewer service for a 4.68 acre parcel ("Subject Property") which is zoned R4 in King County. The site will be used as a single family subdivision of 18 lots for 16 new homes (two existing homes are on site). The project is located within the City's Potential Annexation Area and requires City water and sewer. It is therefore subject to the requirements of City of Auburn Comprehensive Plan: City Expansion and Annexation (Chapter 13) Policy CE -3. Policy CE -3 states: "The City of Auburn shall require ... as a condition of extending sewer and/or water utility service to properties within the Potential Annexation Area ... (but not adjacent to the City limits) ... the signing of a legally binding agreement to support annexation to the City at such time as the City deems annexation appropriate. The property owner/developer shall demonstrate to the City's satisfaction that adequate urban governmental services (including but not limited to storm and sanitary sewer systems, streets and arterials, domestic water systems, parks and open spaces, fire and police protection services, emergency medical services, public schools and public transit services) will be provided to the development; and b. The City should pre -zone the subject property and the property owner/developer shall agree to comply with appropriate City policies, subdivision and zoning requirements where such requirements are not superseded by applicable County requirements (in the event of significant conflict between City and County requirements, the City may choose to not extend utility service).The prezoning will typically be to the City's designation which is most similar to the existing County designation. Whenever pre -zoning does not occur, land shall be zoned and given a Comprehensive Plan designation consistent with Comprehensive Plan policy CE -10 concurrent with annexation; and c. The property owner/developer shall agree to comply with appropriate City development standards and public facility specifications where such requirements are not superseded by applicable County requirements (in the event of significant conflict between City and County requirements, the City may choose to not extend utility service). Any facilities to be dedicated to the City of Auburn upon completion (e.g. sewer and water lines and appurtenances) shall be built strictly according to City standards and specifications... FINDINGS OF FACT 1. Proposal. Mr. Goodwin proposes to subdivide a 4.68 acre parcel into an 18 lot single-family subdivision on land zoned R4 in King County. 2. Auburn Comprehensive Plan and Pre -Zoning. The property is designated "Single Family Residential" on the City of Auburn Comprehensive Plan Map and is pre -zoned by the City as LHR2. 3. Water and sewer service is available at the property. The Public Works Department has determined that water and sewer service is or can be made available to the property. 4. The majority of the proposal is consistent with City development standards. No modification to City development standards was requested for the proposal by the applicant. The proposal is consistent or has been revised to be consistent with City development standards. 5. The proposal is consistent with the City Comprehensive Plan. In accordance with City policy for annexation and expansion of city services, the proponent has demonstrated that: • adequate urban services will be provided to the development; • development will comply with King County standards for zoning and permitting; and the City shall be allowed to review and inspect construction of all public improvements, regardless of eventual ownership. 6. The property cannot be annexed immediately. The property is not adjacent to existing City limits, and there are several intervening parcels. The property cannot therefore be annexed immediately. 7. The case file and its contents for WSC03-0019 are incorporated by reference into this staff report. 8. Request for modification of city standards. No requests for modification to City standards were made. CONCLUSIONS 1. The findings of fact indicate that the proposal, if conditioned, is consistent with City Comprehensive Plan Policy CE -3. 2. The applicant's proposal has met the criteria for the granting of a water/sewer availability certificate identified in ACC 14.18.070(A). Page 2 of 3 Agenda Subject Date: 2/10/2004 RECOMMENDATION Based on the facts and findings and conclusions of the staff report, staff recommends that Planning and Community Development Committee should recommend to the City Council approval of the development agreement which will enable the issuance of a water/sewer availability certificate to the applicant subject to the following conditions: 1. Water and sewer service can be made available to the property. Water service will require construction of an eight -inch (8") minimum water line to serve all lots and to provide adequate fire protection. The waterline shall loop from 130th Ave SE to 132nd Ave SE. 2. Installation of sewer will require construction of an eight -inch (8") gravity sewer main to serve all lots. The sewer main shall extend to and through the property in a location and with the appropriate easements to be determined at the time of the FAC (facility extension permit). 3. The internal road and cul-de-sac must be completed as a public street per Auburn City Standards. 4. Half -street requirements will be required on both 132nd Ave SE and 130th Ave SE, unless a delay is granted by the Auburn City Council. 5. Sidewalk and roads on 130th shall be designed to match and meet the road design/sidewalk to the north. 6. Fire hydrants shall be installed per Auburn City Standards at (ACC13.16.060). 7. Any impact fees calculated and paid to King County for either transportation or park impacts shall be reported to the City of Auburn. 8. Catch basin sumps, dead storage within the detention facility and oil/water separators would help to reduce these waste materials from entering the natural drainage system. d. If any: The storm drainage "detention" requirements as outlined within the Soos Creek Basin plan were established to substantially reduce urban storm impacts on the Soos Creek Basin. However, there are certain landscaping requirements within the communities plan that this project will have to adhere to. Additional landscaping will be provided as part of the normal course of construction of single family homes. 5. Animals a. Land and Shoreline Use a. What is the current use of the site and adjacent properties? The site currently has two single family homes and outbuildings, adjacent properties are single family. b. The existing garage will be demolished — The homes and barn will remain. e. What is the current zoning classification of the site: R6SO f. If so, specify: Based upon the King County Sensitive Areas Profolio, no portion of the site is classified "Sensitive Area". i. Based upon "The 1991 Growth Report" prepared by King County, the Soos Creek community is experiencing an average of 2.97 people per dwelling unit. Therefore, the completed project could house 53 people. j. Approximately how many people would the completed project displace? None. k. Proposed measures to ensure the proposal is compatible with existing and projected land uses and plans, if any: The proposal is to create 18 single family units. The density proposed is 4 dwelling units to the gross acre. This is compatible with the densities adopted by the Soos Creek Community Plan. 9 9. Housing a. Proposed measures to reduce or control aesthetic impacts, if any: Landscaping will be provided intemally as part of individual homes and additional street landscaping per the "P" suffix conditions of the Soos Creek Community Plan. Proposed measures to reduce or control transportation impacts, if any: Mitigation for transportation impacts will come in the form of mitigation payments per K. C. ordinance 9 74 7. 12 15. Public Services a. Would the project result in an increased need for public services (for example: fire protection, police protection, health care, schools, other)? If so, generally describe: Urbanization does create an increase demand on public services. These services are funded mainly in part by real estate taxes from housing. Therefore revenue would increase for public services as urbanization occurs. In a review of the public services within this area. It appears they are adequate per King County Standards: a Fire protection: King County Fire District #44 is located on the corner of SE 3125 Street and 124th Avenue SE. The station is fully staffed 24 hours a day and has a full compliment of firefighting equipment. The response time, as per the District to this project would be three minutes or less. V Emergenc Medical Services: The emergency Medical echnicians (EMT) are also stationed out of the District Fire Station #44. Their response time would be the same (three minutes). c) Police Protection: The police protection is provided by King CCounty from Precinct #3, Maple Valley. The average response time to Lea Hill is as follows: Priority 1 - 5 minutes Priorit 2 — 8-9 minutes Priority 3 — Greater than 9 minutes b. Proposed measures to reduce or control direct impacts on public services, if any: Increased tax base, mitigation fees. 16. Utilities a.
