Subject property is a through lot with street frontage on 124th Ave. SE and also on 121st Place SE. PARCEL NUMBER: 0921059042 PROPOSAL: Request for water and sewer availability certificate for a proposed two (2) lot short plat located in unincorporated King County. BACKGROUND The applicant is proposing to shod plat an existing 2.83 acre parcel into two lots. The project is located within the City's Potential Annexation Area and requires City water and sewer. It is therefore subject to the requirements of City of Auburn Comprehensive Plan: City Expansion and Annexation (Chapter 13) Policy CE-3. Policy CE-3 states: "The City of Auburn shall require...as a condition of extending sewer and/or water utility service to properties within the Potential Annexation Area...(but not adjacent to the City limits)...the signing of a legally binding agreement to support annexation to the City at such time as the City deems annexation appropriate. In these cases where immediate annexation is either not required or not possible, the following conditions shall apply: a. Any facilities to be dedicated to the City of Auburn upon completion (e.g. sewer and water lines and appurtenances) shall be built strictly according to City standards and specifications... FINDINGS OF FACT 1. The applicant is proposing to short plat an existing 2.83 acre (163' by 753') vacant parcel into two lots. As indicated on the site plan, proposed lot 1 is 1.08 acres and proposed lot 2 is 1.75 acres. The applicant indicates that there is no specific development proposal at this time. The property is being platted so that it may be sold. The property is zoned CB (Community Business in King County). The property is designated "Light Commercial" on the City of Auburn Comprehensive Plan map. No development is proposed at this time ACC 14.18.070(A) identifies the findings of fact that must be made in order to recommend the signing of a development agreement and states, "A. The development agreement shall be recommended for signing only if findings of fact are drawn to support the following: 1. The development is consistent with city development standards; and 2. The development is consistent with the city comprehensive plan; and 3. The property cannot be annexed immediately." 4. An analysis of the proposal against the criteria in ACC 14.18.070 (A) follows: The development is consistent with city development standards. The proposal is consistent with city development standards. Certain specific issues such as driveway access will be addressed the time a specific development proposal is made. The proposal is consistent with the Auburn Comprehensive Plan. The property is designated "Light Commercial" on the City of Auburn Comprehensive Plan Map. Commercial development of the property is likely given the County "CB" zoning. The property cannot be annexed immediately. The property is not adjacent to existing City limits, and there are several intervening parcels. The property cannot therefore be annexed immediately. Water and sewer service is available at the property. The Public Works Department has determined that water and sewer service is or can be made available to the property. Specifically, Page 2 of 3 Agenda Subiect WSC04-0002 Date: April 12, 2004 · Sewer service will be provided by a connection to an 8" main approximately 20 feet from the site. Sewer service shall be subject to applicable connection charges. Water service to the proposed easternmost lot will be by connecting to a 12" water main. A 12" water main will need to be constructed to the northern parcel line of the westernmost lot to serve development of that parcel. CONCLUSIONS 1. The findings of fact indicate that the proposal can be made consistent with City Comprehensive Plan Policy CE-3. · Adequate urban services will be provided to the development; · Development can comply with King County standards for zoning and permitting; and · The applicant shall comply with City public facility standards. 2. The applicant's proposal has met the criteria for the granting of a water/sewer availability certificate identified in ACC 14.18.070(A). RECOMMENDATION Based on the facts and findings and conclusions of the staff report, staff recommends that Planning and Community Development Committee recommend to the City Council approval of the development agreement subject to the following conditions: 1. Sewer service will be provided by a connection to an 8" main approximately 20 feet from the site. Sewer service shall be subject to applicable connection charges. 2. Water service to the proposed easternmost lot will be by connecting to a 12" water main. A 12" water main will need to be constructed to the northern parcel line of the westernmost lot to serve development of that parcel. 3. All other applicable city development standards shall be met. Short plat of an individual parcel to create two parcels. Dear Mr. Bastrom and Mr. Garvey: Thank you for your January 31, 2004 submittal of a water and sewer availability application that was supplemented by additional information on February 23, 2004. Our understanding is that the proposal involves the short plat of King County parcei number 0921059042 on Lea Hilt in unincorporated King County, into two (2) lots. BACKGROUND As you may know, the City of Auburn provides water and sewer service to areas located outside of the Auburn City limits but within its Potential Annexation Area (PAA). Consistent with the Washington State Growth Management Act (GMA), these areas are planned to eventually become part of the City of Auburn. Therefore, Auburn's policy is to only provide utilities if the proposal is consistent with the City of Auburn's development standards. The City of Auburn's water and sewer certificate availability process is intended to ensure City development standards are met. As a condition of water/sewer certificate (WSC) availability issuance, an applicant will also be required to enter into a developer agreement stating the conditions of water and sewer provision as well as entering into an agreement authorizing the City of Auburn to annex the subject property at any time the City deems the annexation appropriate. REVIEW COMMENTS The City of Auburn has completed its review of the water-sewer certificate application (WSC04-0002) based On the original submittal and the submittal of additional information and offers the following comments. Water and Sewer Availability Sewer: Sewer service will require connecting to an existing eight (8) inch line approximately 20 feet from the site. Connection charges will apply. Water: Water will be provided by service connection to an existing 12-inch water main for th~ proposed easternmost lot, and by the construction of a 12-inch water line to the north parcel Fine of the westernmost lot. Traffic/Streets . ~nd 121 ~ Place SE appear to be built out to current King County standards. The City is willing to defer to King County to determine whether or not the shod plat's proposed easterly lot may have direct access to 124~h Avenue SE. However, if direct access is not allowed, an access easement would be required to allow eastemmost lot legal access west to 121'~ Place SE. General To the extent that the proposal involves the shod platting of lots without a specific: development proposal, the City would like to be aware of future site-specific development proposals so that we may evaluate consistency with development specific City requirements. The City shall therefore be informed when development permit~ have been submitted for future development proposals for the properties. All other applicable development standards must be met. CONCLUSION Should the above items be acceptable conditions then please let me know at (253) 804- 5034. We can then move forward with scheduling a public hearing before the Planning and Community Development Committee of the Auburn City Council at their next available meeting consistent with our public hearing notice requirements. The City of Auburn has been asked to provide sewer and/or water to this project. In order to provide sewer and/or water to this project the City of Auburn must find that the proposal conforms to appropriate City development standards. Development standards typically include sewer, water and storm drainage utilities, street construction standards, access, etc. At this public hearing, the City will not be deciding or discussing whether the proposal is consistent with King County requirements such as zoning, land use, wetlands, or the environmental impacts the project may have upon surrounding properties or neighborhoods. Only Kine County has the authority to decide those issues through its land use process with the developer. Issues involving zoning, land use (i.e. density) and environmental impacts associated with this proposal must therefore be addressed to Kin,q County.
