Backqround Summary:
The City initiated a vacation of the entire 20 foot alleyway right-of-way. Upon staff review it is
recommended that only the southerly 10 feet of right-of-way be vacated to maintain access to the abutting
properties to the north.

STREET VACATION STAFF REPORT
Street Vacation Number V-07-03
Applicant:
Acting upon a request from Bruce Alverson the Public Works Committee agreed the City could
move forward with a City initiated Street Vacation for this area of Right-of-Way on January 26,
2004.
Property Location:
The southern half (10 feet) of a 20 foot alleyway located south of 1st Street SW, north of 2nd
Street SW, east of A Street SW and west of S Division Street.
Proposal:
Purpose of Street Vacation
If vacated, the ownership of the southerly half of the alleyway (10 feet) will transfer back to the
abutting properties to the south increasing the size of the properties and the viability for
redevelopment.
Implication of Denial
The City of Auburn will need to continue to maintain the Right-of-Way and will remain liable for
the 10 foot piece of property. Redeveloping the abutting properties to the south will be more
difficult and will cause them to have less economic viability.
Advertising/Posting:
The legal advertising and posting requirements for the proposed vacation have been met.
Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79.
· MUTCD standards - not affected by this proposal.
· City Code or Ordinances - meets requirements of ACC 12.48.
· Comprehensive Plan Policy - not affected.
· City Zoning Code - not affected (zoned "C2 - Central Business District").
Public
Benefit:
This street vacation decreases the Right-of-way maintenance obligation of the City.
The vacated area will be subject to property taxes.
This will increase the economic viability for redevelopment of the downtown by
increasing the lot size of the southern abutting properties.
Discussion:
1. The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West
Communications. The following comments were received:
A) Puget Sound Energy has underground and overhead electrical facilities and
underground natural gas facilities in the alleyway, an easement would be needed.

The vacation application was circulated to City staff. The following comments were
received:
A) Staff recommends the City obtain a Sanitary Sewer easement for existing and future
sewer lines.
Comments received from abutting property owners:
A) Bruce Alverson (only abutting property owner to the south of the alleyway): Mr. Alverson
concurs with and favors the vacation of the southerly half (10 feet) of the 20 foot
alleyway.
Comments received from property owners in the area:
A) Jim Huff (abutting property owner to the north of the alleyway): Mr. Huff has expressed
an objection to the vacation of the alleyway but has no objections to making the alleyway
a one way road.
B) Linda & William Crites (abutting property owners to the north of the alleyway): Mr. And
Mrs. Crites have expressed a general objection to the vacation of the alleyway.
Assessed Value:
RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised
value of the area vacated or, in the event the property or portions thereof were acquired at
public expense, compensation may be required in an amount equal to the full appraised value of
the area vacated (if City paid for ROW then the property owner might have to pay one-half or full
amount of fair market value depending on City Council's request).
The right-of-way was acquired by Plat Dedication on March 4, 1886.
Recommendation:
Staff recommends that if the street vacation is granted that the vacation be subject to the
following conditions:
1. Retain a public utility easement for the City's sewer utility.
2. Retain a private utility easement for Puget Sound Energy's overhead and underground
electrical and underground natural gas facilities.
3. If this vacation is granted then the vacated right-of-way shall maintain a public access
easement for ingress and egress.
4. If this vacation is granted and a future private development occurs where a structure is
proposed to be constructed over the vacated right-of-way then the developer shall
perform the following:
i. Relocate sanitary sewer utility.
ii. Relocate Puget Sound Energy electrical and natural gas facilities as required by the
utility. ·
iii. Relocate and create a westbound one-lane alleyway and provide and install
necessary signage and pavement markings.
iv. Provide at least a two foot public access easement on the north side of the vacated
10 foot right-of-way. This would allow for a westbound one-way 12 foot alleyway to
remain in place, providing public access.
