PLT00-0003 Marshall Bain ) FINDINGS, CONCLUSIONS AND RECOMMENDATION For Approval of a Preliminary Plat. ) l SUMMARY OF RECOMMENDATION The Hearing Examiner recommends that the Auburn City Council APPROVE the request for a preliminary plat to subdivide 2.92 acres of land (tax parcels 272105-9158 and 272105-9185) into ten single-family residential lots. SUMMARY OF RECORD Re guest Marshall Bain (Applicant) requested approval of a preliminary plat to subdivide 2.92 acres of land (tax parcels 272105-9158 and 272105-9185) into ten single-family residential lots. The subject property is located on the west side of the 3800 block of Academy Drive SE in Auburn, Washington. Hearing Date The Hearing Examiner for the City of Auburn held an open record hearing on the request on May 18, 2004. Testimony The following individuals presented testimony under oath at the open record hearing: 1. Mr. Sean Martin. City of Auburn Planner 2. Mr. Marvin Seabrands, P.E., representing the Applicant Exhibits The following exhibits were admitted into the record: Exhibit 1 Staff Report dated May 3, 2004 Exhibit 2 Preliminary plat application, including legal description of property Exhibit 3 SEPA Checklist Application Exhibit 4 Notice of. Application, with vicinity map Exhibit 5 SEPA Final Mitigated Determination of Nonsignificance Exhibit 6 Final Staff Evaluation Exhibit 7 Notice of Public Hearing Exhibit 8 Preliminary Plat Map dated July 2002 (Seabrands Engineering) Upon consideration of the testimony and exhibits admitted at the open record hearing, the Hearing Examiner enters the following Findings and Conclusions: FINDINGS 1. The Applicant requested approval of a preliminary plat to subdivide 2.92 acres of land (tax parcels 272105-9158 and 272105-9185) into ten single-family residential lots. The subject property is located on the west side of the 3800 block of Academy Drive SE in Auburn, Washington. Exhibit 1, page 1; Exhibit 2; Exhibit 8. 2. The preliminary plat application was first submitted on March 29, 2000, then resubmitted on-June 1, 2000 and November 1, 2001. Exhibits 2 & 4. 3. The subject property is zoned Single-Family Residential (R-2). Exhibit 1, page 1. 4. Lot standards applicable to development in the R-2 zone include a minimum lot area of 6,000 square feet, a minimum lot width of 60 feet, and a minimum lot depth of 80 feet. ACC 18.14.040. Each of the proposed lots would meet or exceed these standards. The lots would range from 8,373 square feet to 12,443 square feet in area. Exhibit 8. 5. The City of Auburn Comprehensive Plan designation of the subject property is Single Family Residential. Exhibit 1, page 1. 6. The subject property has been designated by the City of Auburn as an aquifer recharge area. Exhibit 6 No limitations to development of the site due to the aquifer recharge area were identified during the SEPA environmental review process or at the open record hearing. See Exhibits 5 and 6 There are no other environmentally sensitive areas on site. Exhibit 6. 7. Access to the plat would be from Academy Drive SE. At the proposed plat entrance, Academy Drive SE currently has a right-of-way width of approximately 37.5 feet and a roadway width of approximately 20 feet. The Applicant proposes to dedicate ten feet of right-of-way along the property frontage and construct half-street improvements, including widening the roadway to 17 feet from the centerline and constructing a new curb and gutter, planter strip and cement concrete sidewalk. Exhibit 5 Exhibit 8. 8. Access to individual lots within the plat would be from a new cul-de-sac road (Bain Lane SE). The road would consist of 50 feet of right-of-way, 28 feet of pavement and half-foot wide curbs and gutters, five-foot wide sidewalks and 5.5-foot wide planter strips on both sides of the road. 1 Exhibit 8. A segment of Bain Lane SE would abut a parcel that is not part of the plat. Because this parcel would not be contributing right-of-way to Bain Lane SE, the sidewalk and planter strip would not extend across the parcel frontage. However, these amenities would be available on the opposite side of the street. Exhibit 8. Findings, Conclusions & Recommendation Hearing Examiner for the City of Auburn Bain Preliminary Plat. Pursuant to ACC 19.04.040, the Applicant would be required to pay traffic impact fees at the time of building permit issuance based on the fee schedule in effect at the time of building permit application. Exhibit 1, page 2; ACC 19.04.040. 10. Prior to drainage into the street storm water pipe on Bain Lane SE, runoff from the lots of the plat would be directed to individual swales for infiltration. As depicted on the revised plat map, Exhibit 8, stormwater runoff from Bain Lane SE would be piped to a grass-lined biofiltration swale for treatment prior to release into an infiltration gallery.. Exhibit 3; Exhibit 8: Testimony of Mr. Seabrands. I.I. Potable water and sanitary sewer would be provided by the City of Auburn. These utilities are available to serve the site. Utility service to individual lots would require the extension of eight-inch water and sewer lines. Exhibit 1, page 2; Exhibit 6 12. Development of the site is subject to the requirements of the City's Design and Construction Standards manual. Compliance with these standards would be determined through the civil plan review process. Per staff's preliminary review, the Applicant is capable of providing all required public infrastructure in accordance with City standards. Exhibit 1, pages 2-3. 13. Pursuant to ACC 17.12.260, the plat is exempt from the City's park and recreation mitigation requirements. Park and recreation mitigation is generally required of developments of 50 lots or more. Exhibit 1, page 2: ACC 17.12.260. 14. The subject property is located within the Auburn School District. Pursuant to ACC 19.02.070, the Applicant would be required to pay school impact fees prior to building permit issuance for each lot. Exhibit 1, page 2: ACC 19.02.070. 15. Pursuant to the State Environmental Policy Act (SEPA), the City of Auburn acted as lead agency for review of environmental impacts caused by the proposal. The City issued a Final Mitigated Determination of Nonsignificance (MDNS) on June 5, 2002. The MDNS contains three conditions addressing the establishment of a'haul route and the protection of cultural and historic resources. The SEPA Responsible Official based these conditions on Comprehensive Plan policies EN-16, EN-20, HP-1. HP-3 and HP-7.2 Exhibit 5. The MDNS was not appealed. CONCLUSIONS Jurisdiction The Hearing Examiner is granted authority to make a recommendation to the Auburn City Council on preliminary plat applications pursuant to ACC 14.03.040(A). Criteria for Review • For a preliminary plat application to be approved, the Applicant must show the following: '- Please refer to the MDNS.(Exhibit 5) for the text of these Comprehensive Plan policies. Adequate provisions are made for the public health, safety and general welfare and for open spaces, drainage ways, streets, alleys, other public ways, water supplies, sanitary wastes, parks, playgrounds and sites for schools and school grounds; 2. Conformance of the proposed subdivision to the general purposes of the comprehensive plan; 3. Conformance of the proposed subdivision to the general purposes of any other applicable policies or plans which have been adopted by the city council; 4. Conformance of the proposed subdivision to the general purposes of this title, as enumerated in ACC 17.02.030; 5. Conformance of the proposed subdivision to the Auburn zoning ordinance and any other applicable planning or engineering standards and specifications as adopted by the city, or as modified and approved as part of a PUD pursuant to Chapter 18.69 ACC; 6. The potential environmental impacts of the proposed subdivision are mitigated such that the preliminary plat will not have an unacceptable adverse effect upon the quality of the environment; 7. Adequate provisions are made so that the preliminary plat will prevent or abate public nuisances. Conclusions Based on Finding 1. Adequate provisions are made for the public health, safety and general welfare and for open spaces, drainage ways, streets, alleys, other public ways, water supplies, sanitary wastes, parks, playgrounds and sites for schools and school grounds. Findings of Fact Nos. 7, 8, 9, 10, 11, 13 and 14. 2. The proposed subdivision conforms to the general purposes of the comprehensive plan. The proposed single-family residential use of the property is consistent with the Single Family Residential Comprehensive Plan designation. Through the SEPA environmental review process conditions were imposed to ensure the subdivision's consistency with specific Comprehensive Plan policies. Findings of Fact Nos. 1. S & 15. 3. The proposed subdivision conforms to the general purposes of other applicable policies and plans. No other policies or plans that would affect development of the site were identified at the open record hearing. 4. The proposed subdivision conforms to the general purposes of the subdivision code. The purposes of the subdivision code are to prevent the overcrowding of land; lessen congestion and promote safe and convenient travel; promote the effective use of land; provide for adequate light and air: facilitate adequate provision of public infrastructure and services; Findings, Conclusions & Recommendation Hearing Examiner for the City of Auburn Bain Preliminary Plat, No. PL TOO-0003 Page 4 of 4 provide for proper ingress and egress; provide for the expeditious review and approval of land divisions; adequately provide for the. housing and commercial needs of citizens; require uniform monumenting of land divisions; implement the goals, objectives and policies of the Comprehensive Plan; and prevent or abate public nuisances. ACC 17.02.030. The proposed subdivision is consistent with these policies because the large lot sizes (larger than required in the R-2 zone) will prevent overcrowding and ensure adequate light and air; the payment of impact fees will contribute towards road and school improvements; dedication of right-of- way and construction of frontage improvements on Academy Drive will promote safe travel; and the construction of Bain Lane will provide for proper ingress and egress. Findings of Fact Nos. 4, 7, 8, 9 & 14. 5. The proposed subdivision conforms to the Auburn zoning ordinance and other applicable planning or engineering standards. Each of the lots will satisfy R-2 dimensional standards. Payment of impact fees will be required at the time of building permit issuance. No park mitigation is required. Compliance with the engineering standards will be determined at the time of civil plan review. Evidence was provided that the plat can comply with the applicable standards. Findings of Fact Nos. 3, 4, 9. 12, 13 & 14. 6. The potential environmental impacts of the proposed subdivision were mitigated through the SEPA process. Findings of Fact Nos. 6 & 15: 7. Adequate provisions are made so that the preliminary plat will prevent or abate public nuisances. Findings of Fact Nos. 1-15. RECOMMENDATION Based upon the preceding Findings and Conclusions, the request for approval of a preliminary plat to subdivide 2.92 acres of land (tax parcels 272105-9158 and 272105-9185) into ten single- family residential lots should be GRANTED. The applicant has requested approval of a 10-lot preliminary plat on approximately 124,146 square foot project site in a single phase. 2. The proposed project falls below the 50-lot threshold for requiring park and recreation mitigation. 3. The project site has direct frontage on Academy Drive SE and all lots have been designed to access an internal street, to be constructed as a component of the proposal. 4. The property was annexed into the City of Auburn in 1969, and the current R-2 (Single Family Residential) zoning-was established in 2000, at the request of the applicant as a privately initiated rezone request. 5. The City of Auburn will provide police protection, fire protection, water, sanitary sewer and storm drainage services. The plat is within the Auburn School District and the City collects impact fees for the school district. 6. The payment of transportation impact fees is required in accordance with Auburn City Code. 7. All lots created through the plat process must meet the development standards associated with the applicable R-2 zoning district. The preliminary plat, as defined by exhibit demonstrated compliance with those standards. 8. The construction of the internal street and storm drainage and utility service will be reviewed in detail through the civil plan review process. The applicant has demonstrated the ability to provide all public infrastructure in accordance with City requirements. Preliminary Plat Staff has concluded that the preliminary plat may be approved in that it is consistent with the following criteria necessary to approve a preliminary plat as outlined in Section 17.06.070 of the Land Division Ordinance. 1. Adequate provisions are made for the public health, safety and general welfare and for open spaces, drainage ways, streets, alleys, other public ways, water supplies, sanitary wastes, parks, playgrounds and sites for schools and school grounds. Adequate provisions have been or can be provided to serve the plat. Public utilities, public schools and new streets will serve the proposed plat. 2. Conformance of the proposed subdivision to the general purposes of the Comprehensive Plan. The proposed plat is consistent with the general purposes of the Comprehensive Plan. 3. Conformance of the proposed subdivision to the general purposes of any other applicable policies or plans that have been adopted by the City Council The proposed plat is consistent with adopted policies and plans. 4. Conformance of the proposed subdivision to the general purposes of the Land Division Ordinance as enumerated in ACC Section 17.02.030. The plat is consistent with the purpose of the Land Division Ordinance. 5. Conformance of the proposed subdivision to the Auburn Zoning Ordinance and any other applicable planning or engineering standards and specifications as adopted by the City. The plat has been or is capable of being designed in accordance with all applicable planning and engineering requirements including the City's Design and Construction Standards manual and all development standards of the Auburn Zoning Ordinance. 6. The potential environmental impacts of the proposed subdivision are mitigated such that the preliminary plat will not have an unacceptable adverse effect upon the quality of the environment. The proposal was evaluated under SEPA, City file no. SEP00-0017. The City of Auburn issued a Mitigated Determination of Non-Significance on June 5, 2004 for the proposal. B. Environmental Elements: 1. Earth: The 1973 USDA Soil Conservation Service's "Soil Survey for the King County Area, Washington', classifies the site's soils as Buckley sift loam (Bu). Buckley silt loam is made up of poorly drained soils that formed in Osceola mudflow on the level plain between the Green and White Rivers. The soil has the following characteristics: moderate permeability in the surface layer EXHiBiT 6 Final Staff Evaluation for Environmental Checklist SEP00-0017 - Page 2 and slow permeability in the subsoil, a seasonally water table at or near the surface in the winter season, high water capacity, slow runoff and a slight erosion hazard. The site is relatively flat. Under the proposal, it is estimated that the earthwork would consist of the importation of 3,200 cubic yards of fill for the sub-base under paving and to raise site to equal grades with adjacent rights of way and properties. Limited excavation will be necessary-for the installation of utilities and site preparation for construction. Exportation from the site is not anticipated. The site's soils and flatness do not themselves present an erosion hazard; however, the site preparation includes importation and placement of fill for construction. These proposed actions, if not properly controlled, could result in erosion and sedimentation impacts to adjacent properties or the surface drainage system. The City will require the preparation, review and approval of a temporary erosion and sedimentation control plan in accordance with the Chapter 6.03.1 of the City's Design and Construction Standards manual. 2. Air. Short-term impacts on air quality could occur during site preparation and paving operations. Construction activity, to include the transportation necessary for the importation of fill material will contribute to short-term increases in local suspended particulate levels. These impacts will be controlled through watering the site as necessary. Street cleaning in accordance with the City's Design and Construction Standards manual will also lessen'these impacts. Minimizing the increased levels of suspended particulates is a priority of the City. The City shall consider measures that will keep the levels of on-site and off-site dust emissions at acceptable levels. The Puget Sound Air Pollution Control Agency regulates impacts associated with exhaust from building ventilation systems. Applicable policies adopted and designated as a basis for the exercise of substantive authority under SEPA to approve, condition or deny proposed actions are noted as follows: The City shall seek to secure and maintain such levels of air quality as will protect human health, prevent injury to plant and animal life, prevent injury to property, foster the comfort and convenience of area inhabitants, and facilitate the enjoyment of the natural attractions of the area. [Policy EN-16, Auburn Comprehensive Plan (ACP)] The City shall consider the-impacts of new development on air quality as a part of its environmental review process and require any appropriate mitigating measures. (Policy EN- 20, ACP) 3. Water: There are no surface water features or wetlands on either parcel. The proposed development will result in approximately 26 percent impervious surface coverage of the project area. The increase in impervious surface will increase the amount of stormwater runoff. The volume of runoff created by the site's impervious surfaces will be managed through the construction of an on-site storm drainage system. Runoff would be collected via pipes and conveyed to a bioswale located in the southwest comer of the project site. A system designed in accordance with the guidelines prescribed in the City's Design and Construction Standards Final Staff Evaluation for Environmental Checklist SEP00-0017 - Page 3 manual will reduce the potential impacts related to surface runoff and water quality. The on-site stormwater management facility will be dedicated to the City as a Tract during at the time of Final Plat. 4. Plants: Concur with checklist. 5. Animals: Concur with checklist. 6. Historic and Cultural Preservation: There is an unknown potential for items of cultural significance on-site. The project area is proximate to a recorded archeological site (45KI495) as a result of an archeological survey conducted by BOAS, Inc on August 31, 2000. While the referenced survey had not identified any culturally significant artifacts, historical items were discovered. Because the site does contain an unknown potential, mitigation measures are necessary to ensure the protection of potentially significant artifacts. The applicant will be required to pay the applicable traffic impact fee at the time building permits are sought. The.applicant will be required to complete % street improvements including curb, gutter, sidewalk, illumination and landscaping along the Academy Drive SE frontage. An additional dedication of 10-foot of right-of-way is required to match the design corridor of Academy Drive SE. 15. Public Services: The proposed plat will require normal police and fire protection associated with this type of use. The increase in capacity can be accommodated by the existing operations. The applicant will be installing fire hydrants in accordance with City Code. 16. Utilities: All proposed utilities are generally available at the site. The proposed plat of the principal "parcel requires the extension of new 8-inch water and sewer lines to serve the new lots. Existing lines are proximate to the proposed plat. C. Conclusion: The proposal can be found to not have a probable significant adverse impact on the environment. The City reserves the right to review any future revisions or alterations to the site or to the proposal in order to determine the environmental significance or non-significance of the project at that point in time.
