Background Summary The City utility codes are being revised as a group to update language to match current practices, to clarify intent, to promote consistency between chapters of code and to transfer requirements from City Code to the City's design manual. Chapters 13.28 "Utility Bill Collection," and 15.72 "Drainage Plans," are being deleted since they are no longer utilized by the City. Chapter 12.66 "Right -of -Way Construction Requirements" is a new section, created to consolidate requirements that were previously covered in the water, sanitary sewer and storm drainage codes, and that were needed to regulate other right-of-way construction activities. This agenda bill covers all of the various ordinances involved in the revisions, which have been reviewed by the Public Works Committee. Comments made by the committee at their June 14, 2004 meeting have been incorporated in the attached documents. These revisions were developed as a "package" because it is appropriate that the ultimate ordinances not only reflect current practices, but also do so consistently. In order to ensure compatibility, if it is not the Council's intent to adopt all of the ordinances along the lines they were drafted, then it would be appropriate to redirect all of the ordinances back to staff for revision and for verification of compatibility and regulatory coverage. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Chapter 13.12 of the City of Auburn. Ordinance No. 5851 May 27, 2004 Page 1 13.12.010 Chapter purpose. This chapter, and the passage and enforcement thereof, is necessary for the protection of the municipally owned water supply system of the city and for the protection of the purity of such water supply. (1957 code § 10.12.010.) 13.12.015 Definitions. A. "City of Auburn desian and construction standards" means the requirements adopted under ACC 12.04 for storm drainage, sanitary sewer, street, and water design and construction. B. "Cross -connection" as used in ACC 13.12 means a connection between a source of contamination and the potable water supply. C. "Municipal water system" means the water sources, storage facilities, treatment facilities transmission and distribution lines and all appurtenances owned and maintained by the city water utility for the purpose of distributing potable water. D. "Washington State Department of Health", means the state_agencV that has been granted authority through formal agreement with the Environmental Protection Agency to enforce the requirements of the federal Safe Drinking Water Act within the State of Washington. 13.12.020 Coal GFeek Water division facilities - Trespassing on or interfering with prohibited. It is unlawful for any person to disturb, operate, interfere with or damage any water main, water pipe, valves, machinery, tools, meters or any other equipment or appurtenance belonging to, connected with or under the control of the city's municipal water system. 13.12.035 Fire hydrant — Unlawful acts. It is unlawful for anv person to obstruct the access to anv fire hvdrant by placin around or thereon any stone, brick, lumber, dirt, landscaping or other material, or to open or operate any fire hydrant, or draw or attempt to draw water there- from without a permit or to willfully or carelessly damage or deface the same. (Ord. 5216 § 1, 1999; Ord. 4878 § 3, 1996.) 13.12.040 Cross -connections prohibited. The installation or maintenance of across -connection which will endanger the water quality of the fresh city's municipal water supply of the oitsystem is prohibited. Any such cross -connection now existing or hereafter installed is a nuisance and shall be abated immediately. The control or elimination of cross - connections shall be in accordance with WAC 248 54-580246-290-490 or subsequent revisions, together with any future manuals of standard practice pertaining to the city's cross -connection control program approved by the general supe ,,, Gfcq _and e+ -the Washington State Department of Sasial-and Health Serv+ses. The water supply will be discontinued to any premises for failure to comply with the provisions of this section. (Ord. 2789 § 1, 1974; 1957 code § 10.12.031(A).) 13.12.050 Water service to noncomplying premises - Discontinuance or refusal. Service from the city's water supply system to any premises upon which a private water supply system is used or operated contrary to the provisions of this chapter may be discontinued or refused. Protective devices shall comply with requirements of the Washington State Department of Health, the city's cross -connection control program and the city's design and construction standards. (Ord. 2789 § 1, 1974; 1957 code § 10.12.032.) 13.12.080 Public health protection. The city shall conduct periodic inspections of the -both its water system and non-public water supply systems connected to the City's water system in coordination with the healthWashington State Department of Health. (Ord. 2789 § 1, 1974; 1957 code § 10.12.033.) 13.12.090 Violation - Penalty. Violation of the provisions of this chapter is an infraction, subject to penalties in accordance with ACC 1.25.050. (Ord. 5683 § 34, 2002; 1957 code § 10.12.050.) Section 2. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this ordinance. Section 3. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the Ordinance No. 5851 May 27, 2004 Page 4 application of the provision to other persons or circumstances shall not be affected. Section 4.
