Background Summary:
Resolution No. 3751 authorizes the Mayor to execute a Design and Construction Services Agreement
with Safeway, Inc., relating to Project No. C326A, ‘C’ Street SW Improvements.
In August of 2002, the City and Safeway entered into a Development Agreement which included
provisions for the improvement of ‘C’ Street SW to be completed by Safeway. In September of 2003, the
City and Safeway entered into a Facility Extension Agreement which governs the design and construction
of road and utility improvements within the City’s rights-of-way.
In March of 2004, the City received an Economic Development grant in the amount of $2 million for
th
completion of improvements to ‘C’ Street SW between Ellingson Road and 15 Street NW. Since
Safeway’s planned improvements along ‘C’ Street SW lie within the planned City project, it is in the City’s
best interest to enter into the Design and Construction Services Agreement, which allows the City to
complete the improvements along ‘C’ Street SW with funding participation in the amount of $1.3 million
from Safeway, in lieu of Safeway completing the improvements which overlap with the City’s planned
project.
