Property Location: Alleyway located north of 1 st Street NW, south of 2nd Street NW, west of N Division Street and east of "A" Street NW. Proposal: Explanation of applicant's proposal (map attached). The City initiated a request for proposals for development of the property owned by the City and anticipates the alley will become part of a future development of the property. The City owns all parcels except for the northeast corner which is owned by the Auburn Medical Regional Center (AMRC). The Ordinance will be approved contingent upon the transfer of the City's property. What does the applicant feel is Qained bv the vacation? If vacated the alleyway will return to the ownership of the abutting parcels creating additional area for the redevelopment of the block, which is consistent with the City's Downtown Plan. What does the applicant feel is lost bv denial of the vacation? Redevelopment of the abutting properties are hindered by the existence of City right-of-way which segregates the property causing a reduction in the economic viability of the abutting parcels. Advertising/Posting: The legal advertising and posting requirements for the proposed vacation have been met. Applicable Policies & Regulations: · RCW's applicable to this situation - meets requirements of RCW 35.79. · MUTCD standards - not affected by this proposal. · City Code or Ordinances - meets requirements of ACC 12.48. · Comprehensive Plan Policy - not affected. · City Zoning Code - not affected (zoned "RO-H" Residential Office - Hospital). Public Benefit: · This street vacation decreases the Right-of-way maintenance obligation of the City. · The vacated area will be subject to property taxes. · This will increase the economic viability for redevelopment of the downtown by increasing the lot size of the abutting properties. Page 1 of3 STREET VACATION STAFF REPORT Discussion: The vacation application was circulated to Puget Sound Energy, Comcast, and U.S. West Communications. The following responses have been received: · Puget Sound Energy does have gas and electrical facilities in this alleyway making this vacation subject to easements for these facilities. · Com cast has an existing City I-Net fiber line that is in the process of being relocated. Due to this facility this vacation is subject to an easement. The vacation application was circulated to City staff. The following responses were received: · Since the vacation of the northerly portion of the alley will go back to ARMC, a condition of vacation should be that the Ordinance is not recorded until the Police/Court City Departments have moved out of the 101 N Division Street building, as the alley is used as access to the City facility. · There is an existing Water line in the alleyway that will make this vacation subject to an easement for this facility. When ARMC goes to construct in this area the water line will need to be removed and capped. · There is an existing 8" Sanitary Sewer line in the alleyway that will make this vacation subject to an easement for this facility. When ARMC goes to construct in this area the sanitary sewer line will need to be removed. · There is an existing City communications fiber lines in the alleyway that will make this vacation subject to an easement for this facility. When ARMC goes to construct in this area the communication fiber lines will need to be removed. · The alleyway is the only means for solid waste vehicles to have access to the existing Police/Court City Department's recycling containers located in the City's Public Parking lot. This vacation will be subject to an access easement. Once the Police/Court City Departments have moved out of the 101 N Division Street building these containers will be removed and the access easement will no longer be needed. Assessed Value: RCW 35.79 and ACC 12.48 allows the City to be compensated up to one-half the appraised value of the area vacated or, in the event the property or portions thereof were acquired at public expense, compensation may be required in an amount equal to the full appraised value of the area vacated (this is based on a new rule from 2002, if City paid for ROW then the property owner might have to pay one-half or full amount of fair market value depending on City Council's request). The right-of-way was acquired by plat dedication April 1, 1889. Page 2 of3 STREET VACATION STAFF REPORT Recommendation: Staff recommends that if the street vacation is granted it needs to be subject to the following conditions: 1. Since the vacation of the northerly portion of the alley will go back to ARMC the Ordinance should not be recorded until the Police/Court City Departments have moved out of the 101 N Division Street building, as the alley is used as access to the City facility. 2. Retain a public utility easement for the existing Water line with the condition that when ARMC goes to construct in this area the water line will need to be removed and capped. 3. Retain a public utility easement for the existing 8" Sanitary Sewer line with the condition that when ARMC goes to construct in this area the sanitary sewer line will need to be removed. 4. Retain a public utility easement for the existing City communications fiber lines with the condition that when ARMC goes to construct in this area the communication fiber lines will need to be removed. 5. Retain access for solid waste to get to the existing Police/Court City Department's recycling containers located in the City's Public Parking lot with the condition that once the Police/Court City Departments have moved out of the 101 N Division Street building these containers will be removed and this access will no longer be needed. 6. Retain a private utility easement for Puget Sound Energy's gas and electrical facilities. 7. Retain a private/public utility easement for the Comcast City's I-Net fiber line.
