Backqround Summary: Ordinance No. 5876 amends Auburn City Code Chapter 13.06.360 pertaining to water rates and Auburn City Code 13.48.100 pertaining to storm drainage rates. The water and storm drainage rates are being amended to conform to a rate analysis prepared by Utility staff. At the request of Covington Water District and Water District No. 111, the Take or Pay Rate will be set on or before the first meeting in April 2005 after re-negotiating the Take or Pay water sales agreement. This information was presented to the Committee at their meeting on October 25, and the ordinance has been amended to reflect this request. Purpose. The purpose of this amendment is to incorporate changes in water rates and storm drainage rates for all customer classes. The water and storm drainage utility rates are being amended to conform with the rate analysis prepared by Utility staff based on historical cost of service studies. Section 2. In the event that the city determines that the operation and maintenance standards are not being complied with, the customl9r class shall be determined to be that of non-single-family only, until operation and maintenance of said facilities meet city standards; whereupon, the customer bE,ing billed may reapply for system inspection, in writing, for reclassification to the pr<evious class. The monthly charge for non-single-family parcels shall be based upon the following formula: BASE CHARGE + (TNESU· RATE) =Storm Drainage Charge, where TNESU" Total number of equivalent service units contained on the parcel. An equivalent service unit has been determined to be 2,600 square feet of imp~!rvìous surface, or any fraction thereof as defined in ACC 13.48.110. C. Developed Parcels. Only deyeloped parcels containing impervious surfaces as defined in ACC 13.48.010 shall be charged. D. Multiple Class Accounts. When a developed non-single-family parcel contains more than one customer class, the appropriate rate for each customer class will be calculated, and the aggregate total summed for billing. Severabilit}'. If any portion of this OrdinanCE' or its application to any person or circumstances is held invalid, the remaindEtr of the Ordinance or the application of the provision to other persons or circumstances shall not be affected. Section 6. Effective date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publicaltion, as provided by law.
