Flag Salute Mayor Lewis called the meeting to order at 7:30 p.m. at the Auburn Justice Center located 340 East Main Street. Mayor Lewis led those in attendance in the Pledge of Allegiance. B. Roll Call Councilmembers present were: Rich Wagner, Gene Cerino, Nancy Backus, Bill Peloza, Roger Thordarson and Lynn Norman. Councilmember Sue Singer was excused. Staff members present included: City Attorney Daniel B. Heid, Information Services Director Lorrie Rempher, Assistant Fire Chief Mike Gerber, Police Chief Jim Kelly, Assistant Police Chief Bob Lee, Finance Director Shelley Coleman, Public Works Director Dennis Dowdy, Community Development Administrator David Osaki, Planner Jeff Dixon, Human Resources/Risk Management Director Brenda Heineman, Parks and Recreation Director Daryl Faber, and City Clerk Danielle Daskam. C. Announcements and Appointments 1. Announcements a) Auburn Justice Center Police Chief Kelly, on behalf of City staff, thanked the Mayor and City Council for their commitment and vision for the development of the new Justice Center building. Detective Brian Williams, representing the Auburn Police Officers Association, presented the Mayor and Page 1 City of Auburn Council Meeting Minutes November 15, 2004 City Council with a plaque commemorating the dedication of the new Justice Center. Additionally, he presented the Council with t-shirts with the image of the new Justice Center. Mayor Lewis presented Auburn Justice Center commemorative trivets to Councilmembers and Police Chief Jim Kelly, Assistant Police Chief Bob Lee, Finance Director Shelley Coleman, Information Services Director Lorrie Rempher, Planning and Community Development Director Paul Krauss, Human Resources/Risk Management Director Brenda Heineman, and Public Works Director Dennis Dowdy. Mayor Lewis presented to Jeff Oliphant of Auburn on Main and the developer of the Auburn Justice Center a commemorative clock in recognition for his dedication and work on the new Justice Center building. Councilmembers congratulated Mr. Oliphant on a successful project. b) Suburban Cities Association Karen Goroski, introduced herself as the new Executive Director of the Suburban Cities Association and addressed the City Council relating to activities of the Suburban Cities Association. Ms. Goroski spoke regarding her role as director of a 37-member city association and the potential for the Association’s future. She reminded the Council of the annual th membership meeting to be held November 17. Mayor Lewis recognized former Mayor Chuck Booth in attendance this evening, who recently served as interim Suburban Cities Association Executive Director. c) Stewart Kershaw, Auburn Symphony Orchestra Director Mayor Lewis read and presented a surprise proclamation honoring Stewart Kershaw, Director of the Auburn Symphony Orchestra, for his contributions to the community and his dedication to the arts. The proclamation recognized Mr. Kershaw as the artistic Page 2 City of Auburn Council Meeting Minutes November 15, 2004 and creative force behind the symphony’s existence. In addition, Mayor Lewis bestowed Mr. Kershaw an Honorary Citizen of the City of Auburn. Mayor Lewis and members of the City Council commended Mr. Kershaw for his dedication to the community. d) Boy Scout Troop 478 Mayor Lewis recognized members of Boy Scout Troop 478 in attendance this evening observing a Council meeting as they work towards achieving their citizenship in the community badge. 2. Appointments There were no appointments for Council consideration. D. Agenda Modifications There was no modification to the agenda. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. th Reverend Bill Andrews , 815 South 216 Street #67, Des Moines Reverend Andrews spoke in favor of the Wesley Homes’ applications for a rezone and conditional use permit (Ordinance th No. 5881) to allow a nursing home at 10805 SE 320 Street. Reverend Andrews resided in Auburn for over twenty-five years and now resides in a Wesley Homes complex in Des Moines. th Rollyn Kidd, 210 13 Street SE, Auburn Mr. Kidd thanked the Mayor and City Council for their efforts so far this year on such issues as motorized scooters and dangerous dogs. nd Russ Jones, 11018 SE 322 Street, Auburn Mr. Jones described incidents in recent weeks of traffic accidents th near the Muckleshoot Casino and on 320 Street SE where no Page 3 City of Auburn Council Meeting Minutes November 15, 2004 police traffic control was provided. Mr. Jones also reported on the number of red light violators he has observed and urged the Police Department to increase enforcement. Mr. Jones commented on the Wesley Homes’ applications for a rezone and conditional use permit. Mr. Jones expressed concern that the Hearing Examiner did not address the request for a variance appropriately. Mr. Jones believes the proposed building is out of character for the neighborhood. He requested that additional mitigation be required and additional buffers be provided on the east side of the property. Chuck Booth , 505 R Street NE, Auburn Former Mayor Chuck Booth spoke in favor of the Wesley Homes’ project to construct a nursing home campus on Lea Hill at 10805 th SE 320. He spoke of the need for elderly housing in the City of Auburn and urged the Council to support the project. th Alex Bremner, 32724 111 Place SE, Auburn Mr. Bremner spoke regarding the Wesley Homes’ applications (Ordinance No. 5881) and reiterated Mr. Jones’ previous comments. He expressed concern that the traffic issues associated with the project have not been sufficiently addressed. th Rhonda Bremner , 32724 111 Place SE, Auburn Ms. Bremner commented on the Wesley Homes’ applications for a rezone and conditional use permit (Ordinance No. 5881). She expressed concern with traffic issues on Lea Hill Road. She noted that several hundred homes have been constructed in the area and a new high school will be added soon, but no traffic improvements have been constructed. She urged the Council to provide traffic improvements in the area to improve safety. C. Correspondence There was no correspondence for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Cerino reported the Municipal Services Committee met this evening at 5:00. The Committee approved consent items and tabled Resolution No. 3780 pending further Committee review. The Committee also discussed solid waste rates and airport rental Page 4 City of Auburn Council Meeting Minutes November 15, 2004 rates. The next regular meeting of the Municipal Services Committee is scheduled for December 6, 2004. B. Planning & Community Development Vice Chair Norman reported the Planning and Community Development Committee met November 8, 2004. The Committee recommended approval of Resolution No. 3779 relating to a grant from the Cultural Development Authority of King County, and several other ordinances and resolutions which appear on the Council agenda this evening. The Committee discussed the 2004 Comprehensive Plan amendments, the proposed Critical Areas Ordinance, West Main Street improvements, the Latino Center and Olympic Middle School Leadership Academy, school impact fees, and an update on the City Hall plaza renovations. The next regular meeting of the Planning and Community Development Committee is scheduled for November 22, 2004 at 5:00 p.m. C. Public Works Chair Wagner reported the Public Works Committee met November 8, 2004. The Committee initiated projects for Terrace th Drive guardrails and 15 Street NW median improvements. The Committee also approved a budget amendment for the 2005 Equipment Rental Fund and recommended approval of the City- wide Sidewalk Improvement Project (C308A). Chair Wagner clarified that Project C308A is a City initiated and sponsored project even though there may be additional improvements which may involve contributions from property owners. The Committee reviewed the Airport storm drainage rates and storm facilities reclassification. The Committee discussed the transportation legislative agenda and suggested urging the State Legislature to pass law that would enable the City to establish a street utility. The Committee also received a presentation from Williams Pipeline Company relating to the causes and repairs to the sinkhole in Cameron Park. The next regular meeting of the Public Works Committee is scheduled for November 22, 2004 at 5:30 p.m. D. Finance Chair Backus reported the Finance Committee met this evening at 6:30 at the Auburn Justice Center. The Committee approved consent items including vouchers and a contract with NetVenture for wireless communications within the City. The Committee also discussed Ordinance No. 5878 relating to the levy of regular property taxes, Resolution No. 3782 with respect to courses of Page 5 City of Auburn Council Meeting Minutes November 15, 2004 action should streamlined sales tax proposals be implemented, and Ordinance No. 5879 relating to terms for board and commission members. The next regular meeting of the Finance Committee is scheduled for December 6, 2004 at 6:30 p.m. IV. COUNCILMEMBER REPORTS At this time Councilmembers may report on items not specifically described on the agenda, which are of interest to the community. th Councilmember Thordarson reported on his attendance at the 80 anniversary celebration of the Auburn Garden Club. Councilmember Thordarson also reported that he and Transportation Planner Joe Welsh arranged for a presentation by Metro Transit staff designed to educate seniors about the available transportation services in Auburn. Councilmember Thordarson also reported that he attended a fund raising event for Griefworks, a counseling service serving the community. Councilmember Peloza reported that he and Councilmember Thordarson attended the monthly Law Enforcement Officers and Fire Fighters (LEOFF) Disability Board meeting. Councilmember Peloza also reported on his attendance at the annual Auburn Food Bank breakfast, the City of Auburn 2005 budget workshop, a Chamber of Commerce fundraiser th banquet at Emerald Downs, the 80 anniversary celebration for the Auburn Garden Club, and the Green River Community College scholarship recognition dinner. Councilmember Peloza reported on several Veterans’ Day activities which he and other Councilmembers attended, including the American Legion breakfast at the Senior Center, Veterans’ Day services at Memorial Park, a Veterans’ luncheon and the Veterans’ Day Parade in downtown Auburn. Councilmember Peloza also reported that he had a recent opportunity to attend a session of the Auburn Municipal Court. Mayor Lewis reported on the Auburn Food Bank breakfast, which was attended by over 500 people and raised over $50,000 to assist families and children in the community. Mayor Lewis spoke of the need for a distribution center for the Auburn Food Bank food donations and a summer feeding program for school children in South King County. th Mayor Lewis reported that he attended the Auburn Garden Club 80 anniversary celebration and the Veterans’ Day activities held in the City th on November 6 including a luncheon in honor of submariners, a flag tribute at the Auburn Eagles Club, the Veterans’ Parade, and the high school battle of the bands. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes 1. Minutes of the November 1, 2004 regular City Council meeting. B. Vouchers F4.9.2,F4.9.5 1. Claims Claims check numbers 335811 through 386255 in the amount of $2,598,052.37 and dated November 15, 2004. 2. Payroll Payroll check numbers 510279 to 510426 in the amount of $621,965.26 and electronic deposit transmissions in the amount of $921,152.80 for a grand total of $1,543,118.06 for the pay period covering October 27, 2004 to November 10, 2004. C. Contract Administration 1. Agreement with NetVenture A3.16.12 City Council to grant permission to enter into an agreement with NetVenture, Inc. to design, install and test a proof of concept for a wireless communications network within the City and authorize expenditures not to exceed $30,000 for proof of concept for wireless networking. 2. Small Works Project Number MS 782 O2.6 City Council award Small Works Contract 04-23, Project Number MS 782, Fire Station 33 Carpeting, to Paasche Construction, Inc. on their low bid of $11,252.00 plus Washington State sales tax of $990.18 for a total contract price of $12,242.18. 3. Councilmember Wagner moved and Councilmember Cerino seconded to approve the consent agenda. MOTION CARRIED UNANIMOUSLY. 6-0. VI. UNFINISHED BUSINESS There was no unfinished business. VII. NEW BUSINESS There was no new business. VIII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5878 F6.6.3 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the levy of regular property taxes by the City of Auburn for collection in 2005 Councilmember Backus moved and Councilmember Norman seconded to introduce and adopt Ordinance No. 5878 MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 5879 A3.8 An Ordinance of the City Council of the City of Auburn, Washington, amending Sections 2.33.020, 2.36.020, 2.45.010, and 2.69.040 of the Auburn City Code, relating to terms for board and commission members Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 5879. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 5880 Page 8 City of Auburn Council Meeting Minutes November 15, 2004 O3.10.1 An Ordinance of the City of Auburn, King County, Washington, approving the issuance of a conditional use permit to expand an existing daycare center in an R-2, st Single Family Residential District located at 832 – 21 Street SE in Auburn, Washington. Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 5880. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 5881 O3.8 REZ04-0004, O3.10.1 CUP04-0004 An Ordinance of the City of Auburn, King County, Washington, approving the rezone request for 18.38 acres th at 10805 SE 320 Street in Auburn, Washington from LHR- 1, Lea Hill Singe Family Residential to LHR-2, Lea Hill Single Family Residential and approving the issuance of a conditional use permit to allow a nursing home in an LHR-2, Leah Hill Single Family Residential District to be located at th 10805 SE 320 Street in Auburn, Washington Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 5881. Councilmember Cerino noted that the final analysis of the project will come with the application for the building permit at which time the conditions of the permits would be applied. Councilmember Peloza spoke in favor of Ordinance No. 5881. He spoke about his experience in Des Moines where he lived near a Wesley Homes complex. Councilmember Peloza expressed concern with traffic on Lea Hill Road and a willingness to look into means to alleviate traffic in the area. Councilmember Norman also expressed concern with traffic on Lea Hill Road and expressed the hope that the Council will follow through with measures to alleviate traffic concerns in the area. Page 9 City of Auburn Council Meeting Minutes November 15, 2004 Councilmember Wagner spoke in favor of the Wesley Homes project. He indicated that a potential traffic signal will be a high priority for the Council and assured that the development applications will be reviewed thoroughly with regard to transportation and storm drainage issues. MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions 1. Resolution No. 3777 A3.16.7, O3.11.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an amendment to the Agreement with the State of Washington and the City of Kent, for the implementation of a CDBG Program for eligible housing repairs Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 3777. Councilmember Peloza spoke in favor of the housing repair program. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 3779 F5.5 A Resolution of the City Council of the City of Auburn, Washington, accepting the appropriation of Ten Thousand Five Hundred and no/100 Dollars in grant funds from the Cultural Development Authority of King County (“4 Culture”), and authorizing the Mayor and City Clerk to execute the contract with the CDA on behalf of the City and the Auburn Arts Commission Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 3779. Councilmember Norman noted that the grant funds from 4Culture go directly to the arts organization within the Auburn community. Resolution No. 3780 F2.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor to sign the adoption of the inter-jurisdictional Regional Hazard Mitigation Plan, as approved by the Federal Emergency Management Agency (FEMA) Resolution No. 3780 was tabled in Municipal Services Committee and therefore removed from the Council agenda. 4. Resolution No. 3781 O3.5 PLT04-0003 A Resolution of the City Council of the City of Auburn, Washington, approving the preliminary plat to subdivide four parcels comprising 13.04 acres into 12 lots Councilmember Norman moved and Councilmember Cerino seconded to adopt Resolution No. 3781. In response to questions from Councilmmeber Cerino, Public Works Director Dowdy advised that the subject parcels were involved in illegal clearing several years ago; and although drainage problems do exist, the proposal appears to adequately address the storm drainage issues. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 3782 F6.7 A Resolution of the City Council of the City of Auburn, Washington, stating the City’s position with respect to appropriate courses of action in the event that the streamlined sales tax proposals are implemented Councilmember Backus moved and Councilmember Norman seconded to adopt Resolution No. 3782. Mayor Lewis explained that streamlined sales tax is an effort to tax the internet. Because of the sales tax structure of the State, those cities that are heavy in industry, distribution and Page 11 City of Auburn Council Meeting Minutes November 15, 2004 warehousing will suffer greatly. It is estimated that if the streamlined sales tax proposal is implemented the City of Auburn has the potential to lose $2-$3 million a year in sales tax revenue; it is estimated that the City of Kent will lose approximately $5 million a year in sales tax revenue. Councilmember Cerino commented that streamlined sales tax is an attempt by Washington State to encourage a federal law relating to taxation of internet sales. Councilmember Backus stated that streamlined sale tax would become an administrative nightmare for businesses to track sales tax and a hardship on communities such as Auburn that have provided the infrastructure for the warehouse and distribution businesses. MOTION CARRIED UNANIMOUSLY. 6-0. IX. MAYOR’S REPORT A. Executive Session Mayor Lewis recessed the regular meeting at 8:38 p.m. for approximately thirty minutes in order to discuss potential and pending litigation and real estate acquisition, pursuant to RCW 43.30.110 (1) (b) and (i).
