Background Summary: Resolution No. 3784 revises and amends the City of Auburn Fee Schedule relating to the Auburn Municipal Airport lease fees. The new fees, except for outside tiedowns, are a 3 or 5 percent increase over the previous rate and are in line with the market for those types of hangars. Due to an effort to increase the current low occupancy of the outside tiedown space, this lease fee has been decreased. The Resolution also incorporates penalties for late payment. WHEREAS, the City of Auburn is engaged in various municipal functions, and the City provides various public services, a number of which entail fees; and WHEREAS, in order to provide for such fees, the City Council adopted its Ordinance No. 5707, providing for the initial fee schedule and authorizing amendments to it through Resolution; and WHEREAS, in the course of reviewing City fees, it is appropriate to revise and amend the fees for Auburn Municipal Airport lease fees. NOW THEREFORE, and pursuant to the authority granted in Ordinance No. 5707, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1. AMENDMENT TO CITY FEE SCHEDULE. The above leases are subject to applicable leasehold taxes, which shall be paid by the tenant. The total charges, including the above lease rates plus lease hold tax and surcharge shall be reflected in monthly billing rates. Tenants shall be given notice as required by Ordinance or lease agreements. The Airport Lease rates shall be effective Febnmry 1, 2004Januarv 1. 2005. Pavments. Pavments are due on the first of each month. past due as of the 5th and late as of the 15th. Pavments not received bv the 15th incur a $10.00 late fee. Pavments not received after 30 davs from the due date incur an additional $25.00 delinauencv fee. Automatic gate electronic cards. One automatic gate electronic card will be issued to each tenant free of charge. Any additional electronic cards requested by a tenant am subject to a $25.00 refundable deposit charge. A $25.00 replacement fee will be assessed against the tenant for all lost or damaged electronic cards. All electronic cards must be returned to the airport at the time of lease expiration. Section 2. GENERAL SEVERABILITY. That if any provision of this Resolution or the application thereof to any person or circumstance is held to be invalid, the remainder thereof or the application thereof to other persons or circumstances shall not be affectE!d. Section 3. IMPLEMENTATION The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 4.
