NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Section 1, The Mayor is hereby authorized to execute an Interlocal Cooperative Agreement for Cooperative Purchasing with Douglas County, in substantial conformity with the agreement attached hereto, marked as Exhibit "A" and incorporated herein by this reference. That the Mayor is authorized to implement such other administrative procedures as may be necessary to carry out the directives of this legislation. Section 3. WHEREAS, the parties may from time to time purchase goods and services pursuant to competitive bidding; and WHEREAS, the parties wish to avoid the unnecessary expense and time delays of duplicative competitive bidding processes. NOW, THEREFORE, the -parties do hereby agree as follows: 1. Each party hereby agrees to extend to the other the right to purchase goods and services under contracts awarded through its competitive bidding process. 2. Each notice issued by a party requesting competitive bids for goods or services shall inform bidders of the right of other public entities to acquire goods and services from the successful bidder. 3. Neither party shall be responsible to the other for the performance of any vendor. INTERLOCAL COOPERATIVE AGREEMENT FOR COOPERATIVE PURCHASING (03272000) - 1 4. Neither party shall be responsible to the other for payment to any vendor. 5. Both parties reserve the right to independently contract for goods and services and may, without notice to the other, specifically exclude the other from purchasing under specific purchasing contracts. 6. Each party shall independently comply with any additional laws and other requirements regulating purchases of goods and services. 7. This Agreement shall remain force until terminated by thirty (30) days prior written notice from one party to the other. This Agreement is hereby approved by the respective Board of County Commissioners for each County.
